Corbett Halts PA Exchange!

Dear Members and Friends,
Partially due to your efforts and phone calls, Governor Tom Corbett announced, a few hours ago, that he is refusing to set up a Health Insurance Exchange in Pennsylvania--despite having accepted Federal funds to research and study the issue. (He will return the balance of the money not used.)
He joins Republican Governors Chris Christie (who we also successfully lobbied), John Kasich (OH), Scott Walker (WI), and others from twenty states (and growing) in rejecting the idea of a state-run exchange.
Last week's news that Montgomery County Commissioner Bruce Castor was waiting in the wings to challenge Governor Corbett in the 2014 Republican Primary could have also positively influenced the Governor's decision.
At any rate, Governor Corbett cited the enormous potential costs associated with implementing the state exchange (as mentioned in our previously sent email below) as one of the main reasons for his refusal.
Please call the Governor's office at 717.787.2500 and thank him for doing the right thing.
While the Federal government will still attempt to set up exchanges in all the states that refuse to do it themselves--the refusal of the states might lead to the unraveling of ObamaCare due to its burdensome, unwieldy, and irrational 2,000 page provisions.

Dear Members and Friends,
Our good friend, WPHT Talk Show Host Dom Giordano, has two very important guests this Monday (December 10) and Next Monday (December 17).
This Monday, sometime between 9 & 11 AM, Dom will be interviewing the elected official currently at the center of our public policy universe--Governor Tom Corbett (R-PA).
(Last week, the center was Governor Chris Christie, who, with only a few hours to spare, vetoed the ObamaCare Health Insurance Exchange bill that had passed both Houses of the New Jersey Legislature earlier this fall. We are most grateful for your calls to Gov. Christie's office.)
Gov. Corbett has until Friday, December 14, to return the $33 million he
took, last May, to set up a Health Insurance Exchange in Pennsylvania.
(Nebraska government officials have estimated that it will cost that state over $600 million, over the next five years, to implement a Health Insurance Exchange. Nebraska is the only state, so far, to conduct a cost analysis.)
We are hoping you will to listen to Gov. Corbett this Monday--then call or fax his office and ask him to return the $33 million and to tell the Obama Administration that he will not authorize Pennsylvania to set up the Exchange.
He does not need legislative approval to do this. In this case, as head of the Executive Branch of PA Government, he can act unilaterally.
Already, 22 other states have refused to set up exchanges.
While you are at it, please ask the Governor to back State Representative Matt Baker's Healthcare Freedom Act which would allow PA to completely opt out of ObamaCare.

Also, as you probably know, in honor of our troops, we are conducting a Help-A-Vet Money Drop for two local charities dedicated to assisting veterans in need.
The Homeless Veterans Project, a program run by the Broad Street Ministries,
provides meals and other services to homeless vets. Association friend,
Joe Eastman, is one of its biggest boosters.
The Philadelphia Veterans Comfort House provides shelter for homeless vets. Another Association friend, Chris Hill, is heavily involved with this charity.
So far, we have raised $600. We hope to raise at least $1000 for these fine charities by Monday evening.

Today Governor Corbett made the decision and said no to setting up a state-run Healthcare Exchange as per the ObamaCare law. In so doing, Governor Corbett is preventing hard-working Pennsylvanians from being responsible for an unknown amount of money to operate a system under rules that have not been fully written.

Conservatives need answers. Four Republicans were removed from their respective committees for voting against House Republican Leaders. As has now been well chronicled, the excuses for why the removals happened keeps changing.
It is time for conservatives to start fighting back. As House Republicans continue to surrender and out negotiate themselves, we must demand answers. Go here now and start calling Steering Committee members.
Ask if they supported the removal and demand that they put these conservatives back on their respective committees immediately. Log the answers and I will make them public.
If we do not hang together on this, House Republican leaders will indeed sell us out.

Here's the problem. The Morning Briefing that you're getting this morning and RedState itself are both available to everyone, free. That's a good thing for both our readers and our country, but it makes it hard for us to manage our day to day business and continue to grow at the same time.
Yes, we work hard to sell advertising to help cover our costs (thanks, by the way, for putting up with that!) and we get a big assist from our parent company, but as you probably know, it's pretty hard for us, as a free website, to cover many costs such as server hosting, rent, IT support, etc. If every RedStater could donate $1 each month, we'd be golden. That, of course, isn't going to happen. But we hope some of you might consider a contribution.
We have readers in every state of the union and in many countries around the world helping spread our mission to educate, motivate, and activate true conservatives. Given the state of affairs in DC and in statehouses across the country, you know we all have our work cut out for us. 1. The Republicans Have Failed the Nation
Over the next couple of years, Barack Obama wants to raise the national debt to $18.9 trillion or so.
John Boehner, Mitch McConnell, and the congressional Republicans want to raise the national debt to $18.4 trillion or so.
The present leadership of the Republican Party has gone from making the case that government is the problem and the American people are the solution to making the case that Democratic controlled government is the problem and Republican controlled government is the solution.
By giving up on making the case that government is the problem and pivoting to "Democrats are the problem," the Republican Party has failed the American people. Historically, when parties lost, their leadership went and hid for an appropriate amount of time under a rock after an acceptance of blame and a resignation.
The present Republican leaders in Washington, instead of hiding under a rock, have taken to standing on the rock and demanding conservatives self flagellate. Neither John Boehner nor Mitch McConnell are visionaries. They are survivors. They survive by recognizing the biggest threat to them and trying to befriend it or neutralize it.
Right now, both see conservatives as their biggest threat, not Barack Obama. Why? Because while Barack Obama maintains the White House, John Boehner and Mitch McConnell maintain their positions of power. They exist for power, not for vision. The visions they articulate are routinely backpedaled. Remember the pledge to nowhere the House Republicans concocted in 2010 as a second coming of the Contract With America? Within two months of returning to the majority they'd already ditched their pledge faster than a frat boy fleeing a one night stand. 2. Whodunit? Conservatives need answers. Four Republicans were removed from their respective committees for voting against House Republican Leaders. As has now been well chronicled, the excuses for why the removals happened keeps changing. It is time for conservatives to start fighting back. More than a week since several conservative House members were kicked off their committees, they have finally received a personal note from Boehner. During last week's conference meeting, Boehner explicitly told members that there was a purge based upon voting records, that he was a part of it, and that other members who deviate from the big government echo chamber would be next. . . . please click here for the rest of the post → 4. 600 Workers To Be Fired As Controversial Activist Judge Sides With Obama-NLRB & SEIU Strikers A Democrat-appointed federal judge with a controversial past and a "weird record of empathy for those accused of sexual crimes involving children" has sided with Barack Obama's National Labor Relations Board and the Service Employees International Union by ordering a nursing home chain whose SEIU workers are striking to reinstate the strikers. The judge's decision to side with the NLRB and SEIU will cause more than 600 replacement caregivers' employment to be terminated. To make matters worse, among those who will be reinstated will be SEIU strikers who are alleged to have committed acts of sabotage against nursing home residents (including Alzheimer's patients) when the union struck back in July. . . . please click here for the rest of the post → 5. Bob Menendez's illegal immigrant sex offender intern arrested. The Associated Press, in this one particular case at least, gets right to the point: "Sen. Robert Menendez employed as an unpaid intern in his Senate office an illegal immigrant who was a registered sex offender, now under arrest by immigration authorities, The Associated Press has learned. The Homeland Security Department instructed federal agents not to arrest him until after Election Day, a U.S. official involved in the case told the AP." . . . please click here for the rest of the post → 6. Picking Fights Throughout the last two years, Erick, Drew Ryun and myself have introduced RedStaters to many problems within the leadership of the Texas State House. Supporting evidence has been provided, most recently with Erick's exclusive a few weeks ago, showing the Speaker's office as the catalyst behind the war against house conservatives. It's not a new fight but with the January vote on House leadership looming, it's time to saddle up. Straus' was brought to the Speaker's chair by liberal Republicans and Democrats. Since his rise to power, the Speaker has demonstrated himself to be more than proficient at rewarding his friends and punishing his enemies. As a liberal Republican, those enemies fall uniformly to his right. From his staff sending vulgar emails describing tea partiers and conservative representatives, to intimidating representatives with threats of redistricting, to fighting conservatives in contested primary elections, Joe Straus has proven himself time and again to be a petty and vindictive man. . . . please click here for the rest of the post →

North Korea Threatens with Successful Missile Launch
North Korea successfully launched a missile early Wednesday-a big step toward achieving the capability to hit targets in the United States. Under the transparent public cover story of a satellite launch, North Korea tested a missile that is the same as an intercontinental ballistic missile (ICBM). Even though the missile was not armed, the launch violates U.N. Security Council resolutions. And the country has been claiming that it is close to arming this type of missile with a nuclear warhead that could reach U.S. territory. Bruce Klingner, Heritage's Senior Research Fellow for Northeast Asia, wrote this morning that "The international community must take firm action against North Korea's provocative act." The U.N. Security Council will consult on the launch today, and Klingner says the U.S. should submit a new resolution that "allows for enforcement by military means. This would enable naval ships to intercept and board North Korean ships suspected of transporting precluded nuclear, missile, and conventional arms, components, or technology." This would be in addition to other sanctions:
Washington should lead the charge for more comprehensive international sanctions against Pyongyang as well as the banks, businesses, and countries that facilitate North Korean nuclear and missile proliferation. The U.S. should also work with its allies toward a comprehensive integrated missile defense network in Asia.
As Klingner notes, coordinating the response with the United Nations will be a challenge for Susan Rice, the U.S. Ambassador to the U.N., who has been in the hot seat since her media appearances on the Benghazi terrorist attack. She has been rumored a favorite of President Obama's for Secretary of State in his second term. One of Rice's main problems will be the Administration's China policy, Klingner explains, because "Beijing has been the principal roadblock to meaningful action. China blocked any meaningful U.N. action in 2010 in response to North Korea's two acts of war against South Korea and Pyongyang's unveiling of a uranium enrichment facility." North Korea's aggression should drive home the necessity of robust missile defense systems for the U.S. and South Korea. Klingner says:
The United States should encourage South Korea to deploy a multilayered missile defense system. This system should be interoperable with a U.S. regional missile network to provide for a more coherent and effective defense of allied military facilities and the South Korean populace. The U.S. should also encourage Seoul to engage in trilateral missile defense cooperation and exercises with the U.S. and Japan.

While the missile launch was timed to mark important dates in North Korea-the December 17 anniversary of the death of previous leader Kim Jong-il and the ascension to power of new leader Kim Jong-un-it will also have broad effects in the region, as both Japan and South Korea have national elections in just a few days. It is clear that the young leader Kim Jong-un is taking an aggressive stance toward the rest of the world. The international response should be just as clear. Phase Out Unlimited Bank Deposit Guarantees
In 2008, in the midst of a financial crisis, federal regulators extended bank deposit guarantees beyond the statutory $250,000 limit to cover all "transaction," or checking, deposits. Later codified by Congress, the Transaction Account Guarantee (TAG) program is due to expire on December 31, 2012. Congress is considering a two-year extension. It should not do so.

Obama's greedy worshipers will cheer ANYTHING he says

At this point it seems like Barack Obama's worshipers will cheer at anything he says. Imagine him speaking at one of his daily campaign rallies and saying the following.
"What we need now is to take a good long look at slavery. We know many folks don't want a job but that bums the rest of us out. When we bring back slavery everybody will be accounted for. Everybody will have a job and be secure in the knowledge that they are contributing to the greater good of the state. Our slaves would be well feed; have great healthcare and birth control devices. They would be off every other Sunday and one full week in the summer plus all federal holidays. Now how does that sound?"
The crowd would cheer but Obama is just revving up.

Don't Criticize the Taliban!

The Wall Street Journal obtained a copy of a new Army handbook for soldiers destined for Afghanistan. The draft handbook has not yet been put into use, but is described as a "final coordinating draft" that was sent out for review in November. The manual instructs soldiers on how to get along with their counterparts in the Afghan Army. It reflects the view, held by some officers but generally deemed highly controversial, that increasing numbers of attacks on American troops by supposedly friendly Afghan soldiers are the result of cultural conflicts, rather than Taliban infiltration.
Some of the manual's recommendations are ludicrous:
The draft handbook offers a list of "taboo conversation topics" that soldiers should avoid, including "making derogatory comments about the Taliban," "advocating women's rights," "any criticism of pedophilia," "directing any criticism towards Afghans," "mentioning homosexuality and homosexual conduct" or "anything related to Islam."
This list of "taboo" topics paints an unintentionally revealing picture of Afghanistan and our supposed allies there: the Taliban, pedophilia, homosexuality, women's rights, or "anything related to Islam." All in the name of cultural sensitivity! The manual also warns against negative stereotypes of the Afghans:
A summary includes views of some U.S. soldiers that Afghan forces engage in thievery, are "gutless in combat," are "basically stupid," "profoundly dishonest," and engage in "treasonous collusion and alliances with enemy forces."
Speaking for myself, I've heard about enough.
The new manual evidently reflects a conflict within the armed forces. While it has not yet been finalized, and our senior commander in Afghanistan, Marine General John Allen, says he will not approve it, the handbook reflects and partially incorporates a 2011 report titled "A Crisis of Trust and Cultural Incompatibility," which some in the Army said was characterized by "unprofessional rhetoric and sensationalism." There evidently is faction within the Army that wants to blame our own soldiers' lack of sensitivity for the fact that they are being murdered in increasing numbers by members of the Afghan armed forces.

The fiscal cliff: is there a better battlefield?

President Obama's goal in the fiscal cliff negotiations seems clear. He wants to force the Republicans to swallow increases in the tax rates of high-earners and thereby bring in at least one trillion dollars in revenue. Alternatively, if the Republicans won't swallow rate increases for the "wealthy," he wants to see everyone's taxes go up and be able to blame Republicans for it.
The Republican goal also seems clear. They want to make headway on cutting government spending and, in particular, to get started with meaningful entitlement reform.
Speaker Boehner's negotiating strategy, I assume, is to induce Obama into some spending cuts and some sort of start on entitlement reform in exchange for giving ground on tax rates. In other words, the impending trip over the fiscal cliff is supposed to provide Boehner with enough leverage to make headway on spending cuts.
Unfortunately, that leverage is limited because Republicans likely will be blamed if we go over the cliff. This places Obama in something like a win-win situation, or so he may perceive.
The question becomes whether events other than the fiscal cliff deadline can provide Republicans with the leverage needed to force seriousness about spending cuts. The question takes on particular urgency to the extent that there isn't enough time before the cliff arrives to hammer out meaningful spending reform, even if Obama is willing to do so.
An alternative "forcing" mechanism does exist - the need to extend the debt ceiling, which will arise early in 2013. Thus, according to Joshua Green of Bloomberg, some conservatives now believe they might be better off accepting the inevitable tax hikes and building their strategy around threatening not to increase the debt limit.
By doing so, Republicans could take on spending without having to play the villain in a scenario that results in a tax hike for the middle class. With taxes off the table, perhaps Republicans could finally get the nation focused on spending, where their position seems stronger politically.
But there are two problems with this strategy. First, as Green points out, the threat of a default on the debt is probably more draconian than the fiscal cliff. If Republicans are seen as the villains in a true default scenario, their public standing would take an enormous hit.
To be sure, Obama likely fears a default more than he does the fiscal cliff, which contains elements that he probably likes. Indeed, we know that the threat of default gained the Republicans leverage in 2011.
But the election has given Obama new confidence in his ability to boss Republicans. A Republican retreat in fiscal cliff negotiations would add to that confidence. Thus, it's unlikely that Republicans successfully could execute a reprise of the 2011 default threat in early 2013.
Second, Green notes that the public isn't really in love with meaningful entitlement reform. Polls, he says, "show that Americans overwhelmingly favor raising taxes on the rich while preserving such programs as Medicare and Social Security." Voters don't seem to understand that raising taxes on the rich won't preserve Medicare and Social Security in their present form.
If Green is right, then for now, the Republicans hold two losing hands: taxes and serious entitlement reform. One could argue that it still would be better, from a political standpoint, to fold the losing hand on taxes and leave the fight on entitlement reform for another day. But, as noted, a fight a few months from now involving a potential default doesn't seem like a winning proposition either.
Green concludes that "the GOP's best hope to cut entitlements is to negotiate for them now with a president more willing to concede them than most Republicans seem to understand." Green may be right about the Republicans' "best hope," but I'd be interested to know why believes Obama is willing to concede cuts in entitlements.

"We Can't Fix the Budget In Secret"

No more back-room deals
When I talk to conservatives and even not-so-conservative independents about the nation's current fiscal crisis, I find a great deal of sympathy with the idea that Congressional Republicans should stop negotiating secret deals. Experience tells us that 11th-hour back room agreements never end well for Republicans, and that they also blur accountability, as both parties wind up taking joint responsibility for all aspects of the deal. So the Republicans' best path forward, in my view, is for the House to pass a budget (which, of course, they have already done, unlike the Senate) along with tax legislation and whatever additional legislation is appropriate to implement that budget, and then pass the ball to Harry Reid. If Obama and Reid refuse to act, then the "fiscal cliff"-which actually isn't so bad, except for the cuts in defense spending-comes to pass. But not because of any fault on the part of Republicans; they passed legislation and the Democrats didn't. Or, if the Senate does respond by enacting a Democratic tax-and-spending proposal, at least the parties' positions will be out in the open and voters will be able to see who wanted what. At that point there would be compromise. But publicly negotiated compromise, following an articulation of a principled position in the form of legislation, is very different from a secret back-room deal.
In this morning's Wall Street Journal, Senator Jeff Sessions has an op-ed titled "We Can't Fix the Budget In Secret." Here it is:

The United States is on an unsustainable spending and debt course. Without reform, it will lead to economic disaster. Yet a fundamental alteration in U.S. policy won't occur until the American people understand the depth of the danger and the scale of change required. One thing is already clear: Such change can begin only with extensive, messy and even contentious legislative work carried on for months in the open light of day.
This is the exact opposite of the hidden negotiations to avert the so-called fiscal cliff. Washington has become possessed by the idea that a small group of negotiators, meeting in secret, can solve the deep, painful and systemic problems plaguing this country with a single "grand bargain," produced at the 59th minute of the 11th hour. This is a siren song. The Senate was once called the world's greatest deliberative body. But the democratic process-which leads to consensus, truce or compromise-has been set aside. So for three straight years the Senate has produced no budget, no plan, no long-term proposal of any kind. Instead, we have seen an endless series of secret conclaves: gangs of six, committees of 12, meetings at the White House, at Blair House, in the Capitol's labyrinth of hallways and hideaways. Meetings everywhere but in the committee room and the open air of the Senate floor. No one denies that good people have been trying hard, but what have all these secret talks produced? Temporary fixes, stopgap measures and another set of emergency deadlines. One wise observer has said that the Senate now operates like the Russian Duma, where officials meet behind closed doors, put out the word, and the overwhelming votes materialize. Today in Washington-where we're faced with the consequences of our last secret deal, the Budget Control Act of 2011-the next round of secret meetings and hushed negotiations is under way. Members of the Senate must reassert their chamber's historic role as the national institution where the great challenges of our time are debated, clarified and ultimately resolved in public view. Unfortunately, Majority Leader Harry Reid has executed a brilliant partisan strategy of protecting his members from public accountability by avoiding the public workings of the legislative process. Following their victories in the historic midterm elections of 2010, Republican leaders too readily accommodated Sen. Reid's craven strategy. The country and their own party's political fortunes suffered as a result. What we need is more distinction, not less. On these great issues of the economy and debt, the voters have sent Washington mixed signals and a divided Congress. It is thus all the more critical that the facts and choices be clarified. The Senate is the perfect institution-created for just such a time as this-to provide that clarity and consensus. Proposals should be worked up in committee, where senators appointed by their colleagues have developed expertise in the issues that come before them. Amendments should be offered as part of an open process to modify and perfect legislation. The debate should be brought to the Senate floor. It may take dozens of votes, even scores, to reach a consensus. But the American people need to be in on the process and have the opportunity to voice their opinion on concrete proposals. Have we forgotten that it is their future that is at stake? At a minimum, any short-term fix that may be devised in order to avert the January cliff must spend at least one week on the Senate floor in order to give senators the time they need-and that the subject warrants-for amendment and debate. No Christmas Eve "deal" should be rushed through, using the threat of financial panic to secure its hurried passage. Next year, the Senate should return to regular order, beginning with the production of its first budget plan in four years. Every senator, whose one vote is equal to that of every other, must stand up and call a halt to government by secret committee. Under Sen. Reid's leadership-without sufficient resistance from the GOP-the Senate has suppressed the needed debate and dodged the accountability that comes from casting and defending votes. Nothing will do more to restore respect for the Senate than for the American people to see it engaged in full, honest and passionate debate. If some of our constituents are disappointed in the results or the votes cast by their senator, at least they can know that nothing was hidden from them, that everything was laid on the line for the future of this great Republic. They will know which senators gave their all to deal wisely and courageously with the great challenge of our time-and they can hold accountable those who did not.

Does Anybody Besides Boehner Know What Boehner Is Doing?
Everybody's got advice for House speaker John Boehner. I suspect Marc Thiessen represents a new level of urgency and frustration within the GOP grassroots, as they see days slipping by, the fiscal cliff approaching, and few if any good options for the party:
Go on the offensive. Immediately put forward a plan to fundamentally reform the tax code. You will be able to outbid Obama and the Democrats in any tax-cut fight. And the intellectual groundwork has already been done. During the supercommittee negotiations last year, Sen. Pat Toomey (R-Pa.) put forward a plan to lower rates, raise revenue and limit deductions. Sen. Rob Portman (R-Ohio) has a revenue-neutral corporate tax reform plan that lowers the rate to 25 percent and moves to a territorial system.
On the spending side, "soak the rich" by getting rid of the billions of dollars in government benefits, taxpayer subsidies and corporate welfare the wealthy receive each year and don't need, and by means-testing government programs from unemployment benefits to farm subsidies.
On entitlements, put forward a plan to save Social Security and Medicare through structural reforms and by reducing benefits for well-off retirees and eliminating them entirely for the wealthiest seniors. Propose a "Buffett Rule" of your own: Warren Buffett does not need taxpayers to subsidize his retirement and health care.
On his radio program Monday, Sean Hannity was grinding his teeth over this aspect, arguing that it amounted to theft of wealthy people who had spent their lives paying into entitlement programs.
I suppose you could see it that way, but perhaps it's good to go back and consider the purpose of these programs in the first place. Why do we have Social Security? To provide income for retirees who can't take care of themselves. Why do we have Medicare? To provide health care for retirees who can't take care of themselves. Once you have a sufficiently high net worth, you can take care of yourself. So why shouldn't Social Security benefits be eliminated for the wealthiest retirees? The Left has always resisted this, fearing that if some citizens didn't collect their benefits, they might not see it as a universal system and the public might be more amenable to additional reforms of the system.
Why yes, they would, wouldn't they?
Anyway, back to Theissen:
STEP THREE: Pass your plans. If the president refuses to negotiate and no progress is made by February, inform him that you will attach all or part of your plan to legislation raising the debt limit and pass it in the House. Then do so. Obama will sign it. Here is why:
Unlike with the fiscal cliff, Republicans have all the leverage when it comes to the debt limit. Today, Obama is perfectly willing to go over the fiscal cliff and blame the GOP for the resulting tax increases on the middle class. But when it comes to the debt limit, he does not have that luxury. He can't default on our debt - the consequences are too catastrophic. So in the end he will cave.
Raise your hand if you think you've spotted a flaw in the strategy here. Wow, lots of hands. Yes, you in the back.
"President Obama doesn't fear catastrophic consequences, he embraces them! Because economic instability increases the general public's dependency upon government, in a variation of the Cloward-Piven strategy to shift America to a more socialist system of economics!"
Yup, something like that. I don't know just how committed Obama is to policies that undermine America's economic health, but we know he doesn't blink upon running up more than $5 trillion in debt in less than four years, $3.4 billion to $4 billion per day. We know he loves, loves, loves blaming Republicans for everything. We know he's willing to blame Republicans for failure to pass immigration reform, bad jobs numbers, the deficit, the continuing housing crisis, gridlock in Washington, the debt panel's failure to reach a deal, the difficulty of life for the unemployed, and the inability to build the Keystone Pipeline.
Now at some point, the public may get really tired of his "it's never my fault" routine, and Obama might find himself in deep doo-doo. But so far, that hasn't happened.
So if the House Republicans dig in their heels on a debt-ceiling fight, all the way up to the deadline, Obama might be okay with default and the ability to use them as a scapegoat for the remainder of his presidency, or he'll embrace the various theories that there need not be a congressionally controlled debt limit at all:
If Obama should fail to secure a long-term solution to the debt ceiling in the context of the current fiscal-cliff negotiations, there is another way out - invoking the US Constitution.
In the wake of the Civil War, the government wanted to make clear that loans to the US government were still good (while Confederate debt would not be honored). Accordingly, the 14th Amendment includes the following provision: "The validity of the public debt of the United States, authorized by law . . . shall not be questioned."
In a 1935 case (Perry v. US) the Supreme Court determined that Congress does not have the authority to renege on its obligations to its lenders. The president, then, could declare as unconstitutional the current debt-ceiling law - which requires congressional approval to raise the limit - or at least use such a threat as leverage.
Maybe I'm not privy to some sort of really brilliant strategy on the part of Speaker Boehner. But right now, doesn't it look like . . . nothing's happening?
I thought Guy Benson had a good idea with his Hail Mary pass of having the GOP adopt Simpson-Bowles.
(Leave it to Ezra Klein to spell out all the reasons conservatives might not want to do that, such as $2.6 trillion in tax increases over ten years and $1.4 trillion in defense cuts, worse than would be enacted under sequester. Still, as far as optics and negotiation leverage goes, this would probably do the most to blow up the "stubborn uncompromising Republicans" argument.)
So Boehner offered "the Bowles plan" and . . . Obama rejected it, with no discernible consequence.
Shouldn't House Republicans be in session, and holding votes, one after the other, on all of these options? Would that be doing more to add to the argument that they're taking actions to avert going over the fiscal cliff, and that Obama's the one being unreasonable and stubborn and refusing to compromise?
Meanwhile, in Syria . . .
You notice nobody seems to be wanting to bet a lot on Syrian dictator Bashar Assad not using chemical weapons. Certainly not his old buddies . . .
A former top general in Syria's chemical weapons program says he doesn't doubt for a moment that President Bashar al-Assad will deploy his chemical weapons arsenal as he tries to hold onto power and crush the uprising that started almost two years ago.
"The regime started to fall and deteriorate. It's coming to its end," said retired Major General Adnan Sillou in an interview in a hotel near Antakya, on Turkey's southern border with Syria. "It's highly possible that he'll start using [chemical weapons] to kill his own people because this regime is a killer."
Until September 2008, Sillou told ABC News he was chief of staff on the defensive side of the chemical weapons program. He said he was in charge of training soldiers against attacks and contact with the weapons, as well as procuring safety equipment to guard against them.
He listed mustard gas along with the sarin, VX and tabun nerve agents as the main elements in Syria's chemical arsenal, whose existence Syria doesn't even acknowledge. Foreign intelligence officials and analysts have focused on the first three as the main threats, and last week U.S. officials said there was evidence sarin had not only been moved, but its binary components, usually stored separately, had been combined and placed into bombs for use.
Then there's the analysis of retired general Barry McCaffrey, Monday afternoon: "I've been an expert on chemical warfare for 25 years. They don't work very well at all against well-trained, well-equipped military forces, such as our own. Having said that, if these weapons were used against Syrian civilian populations to include these rebels, it could be devastating. The VX nerve agents are enormously lethal and almost impossible to deal with it if you don't have the technology both protective gear as well as antidotes if you are exposed. You know, I think Assad is about to go down catastrophically here in the coming year . . . The army is going to turn on him. It will be tempting for him -- he has already murdered 40,000 people -- to use these chemical weapons during the final days."
Then again, here's the opposition: "The clip that was posted by rebel websites appears to a show a boy around the age of 12-to-15 years old decapitating a man with a large sword on behalf of some rebel group. The victim was allegedly a commander of Syria forces who helped lead one of several assaults that devastated the city of Homs. The video is extremely graphic, so watch at your own risk, but keep in mind that there have been a number of fake videos circulated by both sides throughout this entire conflict. (A famous one, of a prisoner being beheaded by a chain saw, was actually a video shot by Mexican drug gangs several years ago and re-dubbed with Arabic voices.)"

What would it have taken for Obama to say: "Eh, flash-in-the-pan one-hit-wonder, kind of out of place at a Christmas concert to begin with. Perhaps the 'Christmas in Washington' concert event organizers should consider dropping him from the program or maybe this year the president doesn't feel such a need to attend this concert"?
And how many Obama critics might have warmed to President Obama a little for taking such a stand?

Wednesday, December 12, 2012 To: Friends & Supporters From: Gary L. Bauer Media Bias: Union Violence Ignored There's an old saying in journalism, "If it bleeds, it leads." In other words, violence makes headlines. Unless, of course, it is left-wing violence against conservatives. In that case, the media collectively shrug and spike the story. That was the case in Michigan yesterday as union thugs went on a rampage outside the state capitol after the legislature passed a right-to-work law. We reported yesterday that a tent sponsored by a conservative organization was torn down while people were still inside. But unless you were watching Fox News, you probably saw nothing about the attack on Steven Crowder, a conservative comedian and Fox commentator. Crowder was pummeled by union thugs. The vitriol and the vicious attack were caught on tape. You can watch it here. Crowder wasn't the only one. Clint Tarver, a hot dog vender, had his cart trashed and was called "Uncle Tom" and a "ni--er" because he was selling hot dogs to conservatives. Yet even with one Democrat legislator warning, "There will be blood" as a result of the vote, there wasn't a single story about this left-wing union violence on CBS News last night. I raise this to once again demonstrate the incredible bias conservatives are confronting in the "main stream" media. When the Tea Party movement began in early 2009 around the idea of reducing federal spending, polls showed favorable public support for the movement. Then the media smear machine went to work. Almost immediately Tea Party supporters, largely middle-aged and senior citizens, were portrayed as semi-fascists who were trying to hijack the democratic process. Two years later, after a barrage of distorted lies by the media, the public had soured on the Tea Party. Consider this excerpt from an April ABC News report about the polling data:
"While overall support is roughly balanced with overall opposition, 'strong' opponents outnumber strong supporters by 2-1. But perhaps most damaging is the buzz: Fifty percent of Americans say the more they hear about the Tea Party, the less they like it; just 27 percent say they like it more."
When there was a massive anti-Obamacare rally in Washington, D.C., the media went wild with claims that black members of Congress were subjected to racial slurs and that one was spit on by a Tea Party member. Despite thousands of people present with cell phone video cameras, there was never any proof the allegations were true. In fact, videos taken of the event refuted the allegations, but the left-wing narrative stuck. "Defend And Reform" Yesterday I attended a strategy session sponsored by Concerned Veterans for America and The Weekly Standard about the future of America's defense spending. Senators Kelly Ayotte of New Hampshire and Lindsey Graham addressed the audience, as did national security experts from leading Washington think tanks. While I have disagreements with Senator Graham on a number of issues, he is spot on when it comes to national defense and America's role in the world. Politico reports today that a growing number of congressional Republicans are embracing the idea of cutting the Defense budget. Should we look for savings in the Defense budget? Of course. There is "fat" throughout the bureaucracy. But providing for our national defense is the primary obligation of our government. Today, defense spending is approximately 20% of the federal budget. Fifty years ago, it accounted for nearly half the budget. As Senator Graham said, we don't know how the "Iranian movie" will end. We don't know what China's true intentions are. But for the sake of argument, let's just assume that world peace breaks out next year and we completely zero out spending on national defense. The savings would cut Obama's $1.2 trillion deficit only in half. Throw in his tax hikes on the "rich" and you get another $100 billion at best. With no money for defense and higher taxes, we're still $500 billion short of a balanced budget. Obviously we are not going to zero out the Pentagon's budget. But to prevent America from facing a fiscal crash like Greece, we are going to have to get serious about entitlement spending and be smart about defense spending. Some Democrats Now Oppose Tax Hikes They Voted For! Former Speaker of the House Nancy Pelosi famously said that her Democrat-led Congress would have to pass Obamacare so we could find out what was in it. The more we find out, it seems there is a lot in Obamacare that even her fellow Democrats don't like. Last week, 16 Senate Democrats and two incoming freshmen sent a letter to Harry Reid asking for a delay in Obamacare tax increases on medical devices which are set to kick in on January 1st. Several of the signers support fully repealing the tax increase, and their names would surprise you: Al Franken (D-MN), John Kerry (D-MA), Charles Schumer (D-NY) and Elizabeth Warren (D-MA) were among the signers. The signers warned Senator Reid about the "uncertainty" and potential risk to jobs and exports caused by this tax on medical devices. If only someone had warned Pelosi and her liberal colleagues about the negative consequences to jobs and the economy of all those tax hikes BEFORE she passed Obamacare. Oh, right -- conservatives were yelling as loudly as we could, but no one in Washington's liberal establishment would listen or cared. By the way, in June the GOP-led House of Representatives voted overwhelmingly to repeal Obamacare's medical device tax hike. Thirty-seven House Democrats voted to repeal the tax, proving yet again that the only bi-partisan aspect of Obamacare is the opposition to it, which is why the media largely ignored the vote. 2013 Speeches One of the best aspects of my job is the opportunity to travel around the country to speak at fundraisers and annual dinners for crisis pregnancy centers, state Family Policy Councils, conservative groups and business conventions. Supreme Court to Hear Defense of Marriage Act Challenges in 2013
It's official: The Supreme Court announced last week that it will take up the Defense of Marriage Act (DOMA) this term.
As we previously noted, the High Court was almost certain to hear one or more of these cases after two federal circuit courts struck down DOMA as a violation of equal protection and since the Court almost invariably grants review when a major piece of federal legislation is struck down on constitutional grounds.
Federal circuit courts of appeals are not bound by the decisions of the other circuits; thus, for the sake of uniform application of the law across the circuits, the justices need to determine the constitutionality of DOMA.
Congress passed DOMA by an overwhelming bipartisan majority in 1996 in response to a Hawaii Supreme Court decision that held that the denial of a marriage license to a same-sex couple was subject to strict scrutiny under the state's constitution. Strict scrutiny, Justice Lewis Powell once quipped, is "strict in theory, but fatal in fact," since nearly all laws subject to strict scrutiny have been struck down.
The portion of the law under attack is Section 3, which defines "marriage" as a union between one man and one woman-but only for purposes of federal programs and funding. DOMA leaves each state free to decide whether to recognize same-sex marriages for purposes of that state's laws, but it provides in Section 2-which has not been challenged-that no state is required to give effect to another state's recognition of same-sex marriages.
The primary issues the Court will evaluate in Windsor v. United States is what level of scrutiny applies to equal protection challenges in this context and whether the proffered rationales for DOMA satisfy that level of scrutiny. The three levels of review are strict scrutiny, intermediate or heightened scrutiny, and rational basis review, which we previously detailed. While the Second Circuit applied intermediate scrutiny in Windsor, every other court that has considered the issue has applied rational basis review.
In February 2011, Attorney General Eric Holder announced that the Justice Department would no longer defend the constitutionality of DOMA-although it would continue to enforce it-and that, in its view, same-sex unions warranted "heightened scrutiny." Consequently, the House of Representatives hired former Solicitor General Paul Clement to defend DOMA in pending cases.
Although the briefing and argument schedule has not been set, given the Court's current docket, it could hear oral argument as early as March and issue a decision by the end of June.

Madigan: The Second Amendment and the States Case Yesterday, in a major win for Second Amendment rights, the U.S. Seventh Circuit Court of Appeals threw out Illinois's virtual ban on the carrying of any guns. While the state of Illinois claimed that there was no historical evidence of a "generally recognized private right to carry arms in public," the appeals court concluded that self-defense "is as important outside the home as inside."
