Iran aims biological warheads at Israel
Source confirms missiles in underground silos target Tel Aviv\

Iran has 170 ballistic missiles aimed at Tel Aviv, many with biological warheads, WND has learned.
According to a source who served in Iran's Intelligence Ministry and who recently defected, the Islamic regime has armed hundreds of its ballistic missiles with biological warheads, and 170 of them are targeting Tel Aviv from underground missile silos.
The Islamic regime ruling Iran has prepared for the total destruction of Israel, he said.
As reported in the Washington Times in August, a commentary in Mashregh, the media outlet of Iran's Revolutionary Guards, confirmed that the Islamic regime not only has weapons of mass destruction but has armed its terrorist proxies with them, including Hezbollah and Islamic Jihad. The commentary warned Israel that if the fighting in Syria does not stop, an all-out attack on the Jewish state will be launched and that at zero hour, Tel Aviv will be the first city to be destroyed.
A senior Iranian cleric, Ayatollah Ahmad Khatami, warned then that Tel Aviv "will burn to ashes," and the regime's supreme leader, Ayatollah Ali Khamenei, promised "the superfluous and fake Zionist regime will disappear from the landscape of geography."
The source, talking to WND, confirmed that Iran has made significant advances on several fronts - chemical, biological, nuclear and electronic warfare - and that the regime is looking at the deterioration in Syria and the possibility of an attack on Iran's nuclear facilities with the intent of setting Israel and the region on fire.

The father of a former Navy SEAL killed in the Sept. 11 terrorist attack on the U.S. Consulate in Benghazi, Libya, says he learned the details of his son's bravery not from the Obama administration, but in an email from an American whose life was saved by his son. Tyrone Woods, 41, was found "slumped over his machine gun, which was caked with blood," Charles Woods, the former SEAL's father, said during a telephone interview from his home in Hawaii. "He had continued to fire until he had no blood left and was unable to fire anymore," Mr. Woods said. He did not identify the email's sender but said he later spoke with the person who "told me how Ty died." Washington politics has largely shifted attention from what actually happened nearly three months ago in the Benghazi attack, in which U.S. Ambassador J. Christopher Stevens, former SEAL Glen Doherty and State Department officer Sean Smith also were slain.

 Merry Crony-mas! It's time to pass out the goodies. While President Obama's lips champion the middle class, his administration's old hands are preparing to lavish rewards on the creme de la campaign creme: his wealthiest political donors.
Several media outlets reported this week that the White House is considering fashion doyenne Anna Wintour for a possible appointment as U.S. ambassador to Great Britain or France.
The rumored short list also includes Obama campaign finance chairman Matthew Barzun and investment banker Marc Lasry. The three share one common, er, "qualification": Each raked in more than $500,000 for Team Obama 2012.
As previously reported in this column, Wintour held multiple million-dollar fundraisers for Obama in Hollywood, New York, London and Paris -- raking in the fourth highest amount for the Man of the (Glamorous) People. Wintour's $40,000-per-plate dinners attracted Hollywood's biggest leftist celebs.
She went further than just passing around the fashion plate, though. Before Election Day, the fashion world buzzed over the British-born Vogue editor's behind-the-scenes campaign to intimidate designers into spurning GOP women. Such Chicago-style diplomacy will fit in perfectly with the brass-knuckle-wielder-in-chief.

Fiscal Cliff Notes: Part II The Patriot Post | By Thomas Sowell | December 5, 2012
 One of the big advantages that President Obama has, as he plays "chicken" with the Congressional Republicans along the "fiscal cliff," is that Obama is a master of the plausible lie, which will never be exposed by the mainstream media-- nor, apparently, by the Republicans.
A key lie that has been repeated over and over, largely unanswered, is that President Bush's "tax cuts for the rich" cost the government so much lost tax revenue that this added to the budget deficit-- so that the government cannot afford to allow the cost of letting the Bush tax rates continue for "the rich."
It sounds very plausible, and constant repetition without a challenge may well be enough to convince the voting public that, if the Republican-controlled House of Representatives does not go along with Barack Obama's demands for more spending and higher tax rates on the top 2 percent, it just shows that they care more for "the rich" than for the other 98 percent.
What is remarkable is how easy it is to show how completely false Obama's argument is.

Former Republican House Majority Leader Dick Armey says he has left the prominent conservative Tea Party group FreedomWorks because of what he calls an internal split over the group's future direction. That split - which was made official in a resignation letter from November and obtained by the liberal outlet Mother Jones this week - is now focusing on an $8 million contract that FreedomWorks tells TheBlaze is being misrepresented. . . . .
National Media outlets appear to have fixated on Armey's takeaway package, though, a Washington Post headline reading: "FreedomWorks Chairman Dick Armey quits Tea Party group in secret deal that pays him $8 million." But TheBlaze spoke with a FreedomWorks representative Tuesday, who clarified that the $8 million sum is a contract between two private parties, and it is not coming from donations to FreedomWorks.

Senate rejects UN treaty for disabled rights in 61-38 vote By Ramsey Cox and Julian Pecquet
A United Nations treaty to ban discrimination against people with disabilities went down to defeat in the Senate on Tuesday in a 61-38 vote.
The treaty backed by President Obama and former Senate Majority Leader Bob Dole (R-Kansas) fell 5 votes short of the two-thirds needed for confirmation as dozens of Senate Republicans objected that it would create new abortion rights and impede the ability of people to home-school disabled children.
Sen. James Inhofe (R-Okla.) argued the treaty would infringe on U.S. sovereignty, an argument echoed by other opponents.
"This unelected bureaucratic body would pass recommendations that would be forced upon the United States if we were a signatory," he said.
Supporters of the treaty argued that the Convention on the Rights of Persons with Disabilities would simply require the rest of the world to meet the standards that Americans already enjoy under the 1990 Americans with Disabilities Act.
The treaty was negotiated and first signed under President George W. Bush and signed again by Obama in 2009. At least 153 other countries have signed it.
Republican Sens. Kelly Ayotte (N.H.), John Barrasso (Wyo.), Scott Brown (Mass.), Susan Collins (Maine), Dick Lugar (Ind.), John McCain (Ariz.) and Lisa Murkowski (Alaska) voted with Democrats in favor of the treaty.

Tell Governor Corbett NO to healthcare exchanges

The Corner States Should Absolutely Refuse to Set Up Obamacare Exchanges By Mario Loyola November 13, 2012 Proponents of Obamacare are making one argument that some conservatives may find appealing - namely that it is much better, from a states' rights point of view, to set up state-based exchanges than to let the feds come in and do it themselves. This argument is absolutely wrong. Allowing your states to be deputized as instruments of federal policy is just as bad as bowing to federal commandeering of state agencies, which is unconstitutional. Let's begin with the principle that the federal government is not allowed to command states or their officials to do anything. That was settled in the two modern commandeering cases, New York v. United States (1992) and Printz v. United States (1997). The federal government has gotten around that through a variety of schemes under the general category of "cooperative federalism." The Supreme Court has generally taken a permissive attitude of these schemes, only because the states supposedly retain freedom of choice, "both in theory and in fact." But it is increasingly clear that their choice is not really free, because they are penalized if they don't comply with the federal program. This problem is clear with programs like Medicaid: The feds tax money away from the states (or they borrow it from the capital markets) and then offer to give it back to the states on condition that they comply with federal preferences. In the Obamacare decision, the Supreme Court ruled that the feds can't present states with the "loaded gun" of losing existing Medicaid funds if they don't comply with the Medicaid expansion requirements. But states still lose the money Obamacare "offers" for the Medicaid expansion itself, hence there is still a draconian penalty. With the exchanges, there is also federal conditional "aid" in play, but the real penalty the states face if they don't bow to the will of Obamacare is that the feds will come in and take over the health-care market. But it's much easier for the feds to do that in a handful of states than for them to do it in most of the states. Feds might not be able to do it in a large number of states without asking Congress for more money or for amendments to the law. That would strengthen the position of the House of Representatives, and its GOP majority. State governors should be under no illusions: You are not preserving one iota of state autonomy by setting up your own Obamacare exchange. On the contrary, you are letting the feds deputize you as instruments of federal policy. Let the feds set up the exchanges themselves; they can pay for them and be accountable for the results. That will impose a real limit on federal power, and provide leverage for rolling back some of Obamacare. In the meantime the message of state governments to the Department of Health and Human Services should be an absolute and unequivocal "NO." As mentioned on the conference call, we are one step away from getting what we want...which is Corbett to FULLY close the door on the state exchange...and YOUR HARD WORK helped get him to where we need him to be. So use this opportunity to once again educate and ask Corbett to be a champion for us. 2.) The wheels of change, especially in government, turn very, very, very slowly. Don't be frustrated. Well...you can be frustrated...but don't give up and hold steady on the course. You are doing the right thing and it is making a difference. 3.) A recent news item has come out saying that the federal government and the insurance companies are saying that premiums for states that do not adopt the exchange will be increased. Here is a great way to answer this when speaking with the Governor or legislators: "We understand the insurance companies are threatening to raise premiums on states that do not adopt exchanges...but let's not kid ourselves...premiums and everything else associated with healthcare are going to increase dramatically, now that Obamacare is law for the foreseeable future. That is a given...so this is nothing new. Furthermore, nothing will cost us more than having our state "own" this exchange when the federal funding runs out in 2015. It will cost the average family over $3000 a year. Do you want to know what $3,000 means for my family? It means I could pay for xxxxx (insert what you could or actually do do with $3,000 a year. For instance: it is a years worth of Catholic school education, it is a year's water bill, it is a year's IRA contribution etc)." 4.) When you make your calls, please make sure you mention you are working with Americans for Prosperity in Pennsylvania. It is so important to continue to build your group by showing that you are part of a larger coalition. AFP is working across the country to defeat the exchanges. When I was first informed of iGive, I was skeptical. I've seen these ideas come and go. Often, they're too good to be true. Or there are all kinds of glitches and problems. The Great Betrayal: Obama's Wars and the War in Iraq

Daniel Greenfield's new Freedom Center pamphlet, The Great Betrayal: Obama's Wars and the War in Iraq, is an effort to understand the politics of the "war on terror" which has now reached a final punctuation point with the U.S. decision to speed its withdrawal from the battlefields of Iraq and Afghanistan (where success was once deemed so crucial to national security), and to practice an incoherent form of regime change in Libya while ignoring more serious threats in Syria and Iran.
The war on terror began, Greenfield shows, as an admirable bipartisan commitment soon after the tragedy of 9/11-an effort to transcend party lines not only to punish those who attacked our country but also to interrupt planning for further attacks and try to stop the international spread of the Islamic jihad behind the attacks. But the Democratic Party, with the honorable exception of a few individuals like Richard Gephardt and Joe Lieberman, turned its back on a war soon after authorizing it, and did so at a time when American troops were facing hostile enemy fire.
Although Senate Democrats on the intelligence oversight committee had been granted access to every piece of data available to the White House, they now accused President Bush of tricking them to secure their approval. In fact, their own about-face was entirely dictated by political considerations when a Sixties antiwar activist, Howard Dean, surged ahead in the Democratic primary polls and it appeared for a moment that Americans were on the side of retreat and capitulation.
Although regime change in Iraq had been official U.S. policy since Bill Clinton signed the Iraq Liberation Act of 1998, Democratic senators such as John Kerry who only months earlier had supported the war effort now launched demoralizing attacks on the American commander-in-chief and his troops in the field, stigmatizing it as "the wrong war in the wrong place at the wrong time." If the truth was the first casualty of their war against the Bush administration, the second casualty was the principle of bi-partisanship that had guided foreign policy debates throughout the Cold War, the principle that "politics stops at the water's edge." Now partisan politics trumped security.
The unrestrained attacks on the Iraq War as illegal and unjustified went largely unanswered by Republicans who failed to call the Democratic saboteurs of the nation's war effort to account or to decry the risk their cynical attacks posed to American servicemen and women on the battlefield. As Greenfield demonstrates, the Democrats' partisanship had consequences not only in Iraq but elsewhere in the region: the paralysis that resulted from their "anti-war" campaign led straight to the destruction of Lebanon and the installation of a terrorist army, Hezbollah, there as a regime within a regime. And it emboldened an overtly Islamofascist regime in Iran not only to supply the IEDs responsible for most of our troop fatalities in Iraq but also to proceed with a nuclear program aimed directly at Israel and the West.
The Great Betrayal shows that Barack Obama's abandonment of Iraq is a betrayal of all the Americans and Iraqis who gave their lives to establish freedom in that country. And the result of his policies in Afghanistan has been as disastrous. While the President presented his rationale for pursuing war there as the pursuit of al-Qaeda, after abandoning his "surge" (which resulted in two thirds of all America's Afghan casualties there and the resurgence of the Taliban allies of al-Qaeda), he blithely prepared for withdrawal as if national objectives had been met.

McConnell declines to endorse Boehner deficit plan By Alexander Bolton
Senate Republican Leader Mitch McConnell (Ky.) on Tuesday declined to endorse a proposal issued the day before from Speaker John Boehner (R-Ohio) that would raise revenue by $800 billion.
McConnell kept his distance from a proposal that received a hail of criticism from conservatives, including Sen. Jim DeMint (R-S.C.), a prominent voice in the Senate GOP conference.
Instead, McConnell praised Boehner for showing leadership and scolded the president for not taking a more active role.
"I have no particular observation other than that I commend the House Republican leadership for trying to move the process along and getting to a point where I hope we can have a real discussion," McConnell told reporters after the weekly Republican lunch.
McConnell said behind-the-scenes talks between Boehner and senior White House officials have stalled.

"It's not just a rumor. Aid will come from some of the Arab states," predicted a black San Francisco lawyer who has close ties to officials of the Organization of Petroleum Exporting Countries (OPEC). "The first indications of Arab help to American blacks may be announced in December." said Khalid Abdullah Tariq Al-Mansour, formerly known as Donald Warden, of the Holmes and Warden law firm. Al-Mansour is the lawyer who filed a friend-of-the-court brief in support of OPEC last winter when the International Association of Machinists and Aerospace Workers (IAM) filed an antitrust suit against the 13 OPEC countries in U.S. District Court in Los Angeles. The OPEC countries did not answer the price-fixing charges on the grounds that a U.S. court did not have jurisdiction over a foreign country. However, Al-Mansour argued for OPEC as chairman of the Concerned Black Americans in Suppport of Africa and the Middle East. The suit was dismissed on Aug. 22. Al-Mansour, 39, for several years has urged the rich Arab kingdoms to cultivate stronger ties to America's blacks by supporting black businesses and black colleges and giving financial help to disadvantaged students. Well, that was a short honeymoon.
The honeymoon in question, of course, being the one between Prime Minister Binyamin Netanyahu and US President Barack Obama that lasted for the duration of Operation Pillar of Defense.
Obama, in a move that surprised many who thought he would "take revenge" on Netanyahu for the widely held perception that the prime minister favored Republican candidate Mitt Romney in the US elections, backed Israel during the military operation, saying loudly that Israel had the natural right to defend itself from Gaza rockets.
Obama's rhetorical support was critical, setting the tone for others in the international community. Israeli officials said the support Obama gave Netanyahu over the phone was even stronger then what was heard in public. Despite reports to the contrary, the officials said Obama did not warn Netanyahu against launching a ground incursion into Gaza.
Barely a week passed and talk of a honeymoon has, at least in the media, turned into talk of a divorce. First came the announcement in Jerusalem Friday of construction in the settlements and planning in the E1 neighborhood, in response to the Palestinian's upgrade at the UN, and then came leaked comments by Chicago Mayor and former Obama chief of staff Rahm Emanuel.

This is best illustrated by the life of Glamor Magazine's 2009 nominee for woman of the year, Susan Elizabeth Rice. In the late 1990s, Rice was working for Bill Clinton as the Assistant Secretary of State for African Affairs. The African continent was hers to rule, and she put her foot down on the necks of her rivals on more than one occasion. One such foot to the neck was in regards to a little-known terrorist by the name of Osama Bin Laden. In the late 1990s, Bin Laden was living in Khartoum, Sudan. Although the Sudanese government was engaged in a long and bloody civil war, their intelligence service, the Mukhabarat, was exemplary and knew all about the terrorist activities of Bin Laden. They wanted to give the information to the United States and at one point wanted to turn him over. Who overruled this? Who plugged her ears and refused to hear about Bin Laden? How history has repeated itself is that Rice blamed bad CIA intelligence for not listening to the Sudanese. The CIA had wrongly stated that Sudan was sponsoring terrorism, so Rice refused to hear. Again, with the Benghazi attack, Rice has blamed the CIA for feeding bad information to her: that it was the CIA and not her who pointed the finger towards an obscure anti-Muslim YouTube video and subsequent "protest turned violent." Like her boss, she likes to blame others for her mistakes. Susan Rice is in effect partly responsible for 9/11. She let Osama Bin Laden get away. She truly has blood on her hands.

The age of the encyclopedia salesman and the vacuum cleaner salesman peddling heavy bundles of books and snakelike cables door to door is done. But the age of the democracy salesman has taken its place. No longer do bright young lads tote along everything there is to know about the letter E in one omnibus volume or demonstrate how the latest Suck-O-Zoom can get stains out of any carpet as an introduction to the wonders of free enterprise. Instead, if they haven't been sidetracked by the siren lure of the dot com or the minimum wage job, they, like the late Christopher Stevens, jet off to foreign climes with FDR's Four Freedoms under one arm and a local dictionary under the other to convince the natives that their lives will be freer, brighter and shinier with the Demo-O-Vote as the arbiter of their holy wars. Like a lot of salesmen, the democracy salesman has never really stopped to wonder why any of his prospective customers should want to buy democracy for only twelve easy payments of bloody civil war? Born in a society where democracy has been idolized for the last century, where cleanliness and godliness may have gone by the wayside, but democracy is still one of those faded old virtues that the arbiters of the Living Constitution haven't taken out back and put a bullet in its head in between elections and commercial breaks, they have never thought to consider that anyone might not want their democracy. In an amoral society, democracy is one of the few things left to us by dead white men that is held to be a virtue, rather than a vice. It goes unquestioned because to most people it represents the power of the common man over his rulers, even if the common man no more rules his rulers than he did some two-hundred years ago. Taxes: GOP Surrenders Last Issue Advantage |

For most of my adult life, there has been one thing I could rely on with the Republican Party; they weren't going to raise my taxes. Sure, President George H.W. Bush did it in 1990, but his shock reelection loss quickly taught the party a lesson. Tax policy was one clear issue advantage the GOP had over the Democrats. Yesterday, Speaker Boehner released a Democrat-inspired "fiscal cliff" offer that finally surrenders this advantage. The GOP is now the party of "slightly less tax hikes."
In 2012 exit polls, 63% of voters said taxes "shouldn't be raised to help cut the deficit." Romney won these voters by 24-points, 61-37. Over a third of voters, 35%, said income tax rates should not be increased for any taxpayers, even the "wealthy." Romney won these voters by 52-points, 75-23. Taxes were the third "biggest challenge" facing voters. Romney won this group by 34-points, 66-32.

A "Fast and Furious" culprit resigns from Justice Department

Gary Grindler, Attorney General Eric Holder's chief of staff, has resigned from the Justice Department effective tomorrow. Grindler leaves after less than two years in that position.
Grindler oversaw the Bureau of Alcohol, Tobacco, Firearms and Explosives, which led "Fast and Furious," the failed and criminally stupid "gun-walking" operation that allowed Mexican cartels to obtain hundreds of illegally purchased weapons. The DOJ's Inspector General faulted Grindler for hiding the connection between Fast and Furious and the murder of a Border Patrol Agent from Holder and from the Department of Homeland Security. Whether Grindler actually did hide the connection from Holder is questionable. In any case, the IG recommended that Grindler be disciplined.
Rep. Darrell Issa, chairman of the House Committee investigating Fast and Furious, has singled out Grindler for criticism, stating that he "passed the buck to underlings" and failed to take charge of the department. Naturally, Issa greeted Grindler's resignation with approval and said he expected more departures and/or discipline in connection with Fast Furious.
The resignation most urgently required is that of Holder. He has been a terrible Attorney General in multiple respects, one of which I will write about soon.

Dumb and Dumber: The Stupid Party Marches On (with comment by Paul)

In his Commentary cover story this month on "The Way Forward," John Podhoretz notes that the modern conservative movement comprises four parts: intellectuals, activists, media, and the Republican Party. "Of all these," he adds, "the least healthy is the Republican Party."
Almost as if on cue, David Welch, a former research director for the Republican National Committee, takes to the pages of the New York Times today to prove John's point. Reading Welch's supercilious article, "Where Have You Gone, Bill Buckley?", reminded me of why I never give money to the RNC.
Welch begins by celebrating Buckley's long-ago role of marginalizing the John Birch Society, something which, ahem, the Republican establishment of the time was utterly unable to do. Keep this sweet irony in mind as you take on board what's next from Welch:
Fast forward half a century. The modern-day Birchers are the Tea Party. By loudly espousing extreme rhetoric, yet holding untenable beliefs, they have run virtually unchallenged by the Republican leadership, aided by irresponsible radio talk-show hosts and right-wing pundits. While the Tea Party grew, respected moderate voices in the party were further pushed toward extinction.
Come again? "The modern-day Birchers are the Tea Party"?? I won't even bother debunking this.
It gets worse. For instance:
The absence of a Buckley-esque gatekeeper today has allowed extreme, untested candidates to take center stage and then commit predictable gaffes and issue moon-bat pronouncements.
This is brand new in the 21st century? Really? I guess Welch is too young to recall GOP Senate disasters like Max Rafferty in California in 1968, who could be said to have been the Tea Party candidate before there was a Tea Party. (Rafferty took out liberal GOP incumbent Senator Thomas Kuchel-the Richard Lugar of his time-in the primary and then lost badly to Alan Cranston in the general election, thus surrendering a GOP Senate seat to a left-liberal who lasted for two decades.) They probably don't remember this, and other inferior candidate debacles of the pre-tea Party Age, in the research department at the RNC.
More Welch's sour-grape juice: "Dare I say it, or should I just whisper the word? We need 'the Establishment.'"
Would that be "the Establishment" that gave us used-up, past-their-sell-by-date Establishment candidates like Tommy Thompson in Wisconsin?
I am generally a pro-establishment person, but not when it's a brain dead as this. The Stupid Party indeed. Maybe these guys should be installed to run the RNC:
PAUL ADDS: I agree generally with Steve's take down of David Welch, but want to say a word in partial defense of my one-time law partner, Tommy Thompson. In August, when Thompson was nominated by Wisconsin primary voters, most polls showed him to be at least as strong a candidate (and probably stronger) than all of his Republican rivals for the nomination. In fact, all published polls taken around that time showed Thompson to be ahead of Baldwin.
Thompson turned out not to be a great candidate. However, he did not underperform in relation to Mitt Romney, the way so many Republican Senate candidates in hotly contested states (e.g., Ohio, Florida, Virginia, Indiana, Arizona, and Missouri) did. In fact, he outperformed Romney, losing to Tammy Baldwin by 5.5 points, while Romney lost to Obama in Wisconsin by 6.7. And Thompson outperformed Romney even though Wisconsinite Paul Ryan was Romney's running mate.
So if the "establishment" can be said to have "given us" Tommy Thompson, I don't think it should take a hit for that particular selection.

Thinking about the fiscal cliff, and the political one

Each of the following 20 propositions are, I think, true:
1. Either there will be a deal between President Obama and the Republicans or there will be no deal and we will go over the "fiscal cliff." This choice can be postponed until next year, but it probably can't be avoided altogether.
2. In all likelihood, Obama won't agree to a deal unless the tax rates of very top earners are increased.
3. An increase in the tax rates of very top earners would likely would slow the economy down.
4. Voting to increase the tax rates of very top earners (or voting "present" on a proposal to raise these rates) would hurt Republicans because those who vote "yes" or "present" might well be challenged in primaries and the resulting division would be harmful to the Party.
5. Republicans should only accept (or permit) an outcome that that entails the negative consequences described in propositions 3 and 4 in exchange for very significant concessions from the White House on spending cuts and entitlement reform OR if not accepting that outcome would send Republicans over the political cliff.
6. Going over the financial cliff would be bad for the country because it very likely would slow the economy down significantly and because the resulting defense cuts would be harmful.
7. Going over the financial cliff might or might not hurt Republicans, depending on which party receives most of the blame for not having reached a deal.
8. The Republicans have a great deal to lose if the public assigns primary blame to them for not reaching a deal. In that event, the Republicans likely will lose control of the House in 2014, leaving the Democrats in control of the White House and both chambers of Congress.
9. The extent to which the public assigns primary blame to Republicans for not reaching a deal, and thus for going over the fiscal cliff, will depend on how reasonable the Republicans' last best offer seems to the public.
10. In the battle over public perception, the Democrats have a built-in advantage, thanks to media bias. But media bias is not necessrily a decisive advantage for the Dems, as we have seen with respect to Obamacare. Nor should Obama's electoral victory overly cow Republicans. It does not entail the kind of popularity that will convert a losing policy hand into a winning one, as we saw following the elections of 2004 and 2008
11. The public favors an approach to debt reduction that includes meaningful spending cuts. After all, Obama was reelected on a promise to reduce the debt through a "balanced approach."
12. Most Americans, including even a significant number of Obama voters, want to get control of the deficit primarily by cutting spending.
13. Most Americans also like bipartisanship and bipartisan commissions.
14. Bowles-Simpson is a bipartisan proposal that springs from a commission appointed by Obama.
15. Bowles-Simpson provides a balanced approach to debt reduction, and one that relies mostly on cutting spending.
16. Given propositions 11-15, there's a good chance that, if Bowles-Simpson is the Republicans' last best offer, the public will consider it a reasonable one, and thus place most of the blame for failure to reach a deal on Obama.
17. Because proposition 16 is by no means a certainty, and because going over the fiscal cliff would be bad for the country (see proposition 6), the number 1 option for Republicans should probably be a negotiated deal that raises tax rates for very top earners (but by less than what Obama proposes) in exchange for very significant concessions from the White House on spending cuts and entitlement reform.
18. Option 2 should be going over the financial cliff with Bowles-Simpson as the Republicans last best offer to avoid the cliff.
19. Option 1 is probably a non-starter for Obama.
20. Though far from ideal, option 2 probably would not be a bad place for Republicans to end up.

Bob Costas on gun control - no big deal

Three years ago, Brit Hume, speaking on Fox News, expressed his hope that Tiger Woods will convert to Christianity because it offers a forgiveness and redemption that cannot be found in Woods' religion, Buddhism. Hume's comments provoked an uproar the essence of which was that news commentators shouldn't use their network forum to express their view about the superiority of one religion over another.
I agreed with the sentiment but not the uproar. I argued that Hume's statement was "no big deal" because Hume does not regularly use Fox News to offer religious commentary. Rather, his statement about (or to) Woods was a one-off instance in which his heart poured over into his commentary.
I feel the same way about the comment this weekend by sports show host Bob Costas about guns. Addressing the murder-suicide involving Kansas City Chiefs linebacker Jovan Belcher, Costas quoted with approval the following views of Kansas City sportwriter:
Our current gun culture simply ensures that more and more domestic disputes will end in the ultimate tragedy, and that more convenience-store confrontations over loud music coming from a car will leave more teenage boys bloodied and dead. In the coming days, Belcher's actions will be analyzed through the lens of concussions and head injuries. Who knows? Maybe brain damage triggered his violent overreaction to a fight with his girlfriend. What I believe is, if he didn't possess/own a gun, he and Kasandra Perkins would both be alive today. That is the message I wish Chiefs players, professional athletes and all of us would focus on Sunday and moving forward. Handguns do not enhance our safety. They exacerbate our flaws, tempt us to escalate arguments, and bait us into embracing confrontation rather than avoiding it.
Costas' comments were inappropriate. Obviously, a football telecast is not the place for commentary on political issues.
However, calls for Costas to be fired or reprimanded are silly. Television personalities are people too. Given enough appearances on TV, it is natural that, once in a while, in an emotionally charged situation, they will find themselves expressing a deeply held personal view that exceeds the bounds of what they should be talking about.
The appropriate response is to shake our head and make a note of the transgression, not to make a case out of it. Surely, we aren't so brittle as a nation that folks need to go on the warpath over a one-off inappropriately political expression like Costas'.

Why Are Republicans Losing the Tax Debate?-Part 2

Further to yesterday's post on Why Republicans Are Losing the Tax Debate ("It's the fairness, stupid"), let's take account of the best argument of the Left on the matter. In response to the data showing that tax rate reductions have shifted the income tax burden to the wealthy, the Left responds that the share of total income accruing to the richest 1 or 10 percent of Americans has soared, by so much that even with the total tax burden shifted, the rich are still woefully undertaxed. Their chief analysis is shown in this chart, which juxtaposes top marginal income tax rates with the share of national income going to the top 1 percent:
One can, and should, have a good argument here about what this chart actually proves. The Left points to an inverse correlation between low marginal income tax rates and high share of income going to the top 1 percent. But it could be used to demonstrate the supply-side argument that high rates (which few people actually paid anyway) cause high income people to avoid realizing income, by investing in unproductive tax shelters that artificially lower reported income, or other subterfuges. It was possible, for example, right up to the late Clinton years, for a high net worth person to realize huge gains with no income or capital gains tax liability at all, through the simple expedient of going "short against the box" on large stock positions. (A billionaire once explained this to me; it was lost on most journalists and people in Washington, and Clinton only moved to close the loophole when Robert Rubin told him about it and betrayed his Goldman Sachs pals.) Recognize that when you use tax shelters or other gimmicks, you skew the data that goes into this chart, because those gains don't count as "income" in the official statistics on which this chart is based. In other words, it is likely that this chart is completely wrong. Supply siders have always argued that lower marginal rates cause the wealthy to realize and report more income, and this chart offers evidence they are right.
Or you can ask yourself this question: Does anyone think the Kennedy family ever paid the 91 percent marginal income tax rate of the 1950s so beloved of Paul Krugman? Please. Or perhaps the Kennedy library would like to prove me wrong by releasing some old tax returns of Jack and Joe Kennedy from the 1950s. I'm not going to hold my breath. There's a reason, as Peter Schweizer explained in Do As I Say, that the Kennedy family has its assets domiciled predominantly offshore, though this only seems to be a political handicap if your name is Romney.
The ur-text of the Left
But this argument is beside the point as well as futile, because the Left's argument is that the high share of income earned by the 1 percent is unfair on its face, because it is more than they need. (I stress "earned" here because "distributed" is an insidious semantic base-stealing we need to stop the Left from using. But that's a separate post.) The theoretical argument behind the Left's crusade for taking the wealth of the rich and giving it to their clients is based on the ur-text of the contemporary Left, John Rawls' Theory of Justice. Press a liberal intellectual, and eventually they will repair to Rawls's "difference principle," which holds that inequality of wealth of income is only just if it benefits the less well-off. It may be an intelligible principle of justice in the abstract, but it is unintelligible in practice; one of the defects of Rawls is that in 600 pages he never moves from the abstract to an applicable rule of policy guidance, or even a vague framework for setting tax rates. There is no "Krugman-Rawls Curve" analogous to the Laffer Curve, for example.

And one of the oldest principles of justice, stretching back to Plato and Aristotle, and which Rawls accepts, is that justice must move beyond the abstract to particular situations and individuals. So let's see how Rawls's principle might apply to some real live individuals. Does Bill Gates's immense wealth violate the "difference principle"? It is not obvious what the answer is. It seems to me even Gates's extraordinary case can be reconciled with Rawls's difference principle. Didn't the means by which Gates rapidly gained his vast fortune involve improving the lives and productivity of millions of people around the world? Was his financial reward incommensurate with the benefits that accrued to the less well-off of the world?
Let's refine this further. Take Gates or Warren Buffett, the two wealthiest Americans who happen to be liberal Democrats. I'd like a liberal to explain in precise terms whether they acquired their fortunes unjustly? And if they didn't acquire their wealth unjustly, then a second query must be answered: at what point did the size of their fortunes go from just to unjust? Was it $1 billion? $10 billion?
I expect liberals cannot or will not give specific answers to these interrogatories, but will change the subject.
P.S. By the way, if you want to see Buffett change his tune on taxes, just borrow an old FDR idea and propose an undistributed profits tax on corporations that hoard their cash rather than reinvesting it or returning it to shareholders. I guarantee you Buffett will take his first private jet trip of the day to the White House to kill that idea.

Obama Rejects House Offer Yesterday afternoon, House GOP leaders sent a letter to President Obama offering a compromise on the fiscal cliff. House Republicans offered $800 billion in additional tax revenues achieved through tax reform, not higher tax rates. In addition, they proposed $1.4 trillion in savings through spending cuts and entitlement reforms. The White House immediately rejected the offer. Press Secretary Jay Carney said, "[Tax] rates have to rise, and the Republicans have to acknowledge that." So higher tax rates, not necessarily higher revenues, appears to be non-negotiable for Barack Obama. Meanwhile, conservatives, including the Heritage Foundation and Senator Jim DeMint, criticized the House offer as giving up too much. We have made this point repeatedly, but it cannot be stated often enough. We cannot tax our way out of this problem. The problem is too much spending. As columnist Thomas Sowell wrote, "Raising the tax rates on everybody in the top 2% will not get enough additional tax revenue to run the government for 10 days. And what will the government do to pay for the other 355 days in the year?" Nor are the Bush tax cuts the cause of this current crisis. For the record, federal tax revenues peaked in 2007. Let me restate that: Years after the 2001 and 2003 Bush tax cuts were enacted, federal revenues hit an all-time high. The deficit in 2007 was just $163 billion. That's a lot of money, but nowhere near Obama's 2011 deficit of $1.3 trillion or $1,300 billion! Here's another point to keep in mind. The White House's $1.6 trillion fiscal cliff offer was modeled after Obama's February budget proposal. That budget plan got exactly zero votes in Congress. Not a single House or Senate Democrat voted for it earlier this year. Yet now we're supposed to accept it as a serious proposal? Only in Washington, D.C. Now here's a bit of admittedly self-serving advice. With each passing day there is more uncertainty about the fiscal cliff. But it is certain that tax rates on dividends and capitals gains are going up. There is also serious talk about limiting deductions for charitable donations as part of any tax agreement. As you are thinking about your year-end charitable donations, I hope you will keep my non-profit organization American Values in mind. In fact, I would urge you to consider the example of Costco and other major corporations that are paying out special dividends this year in order to avoid higher tax rates next year. Your generous tax-deductible gift to American Values before the end of 2012 may be a good way to maximize future tax savings! Cultural Chaos The nation was stunned this weekend when news broke that Kansas City Chiefs linebacker Jovan Belcher shot his girlfriend, the mother of his 3-month old daughter, nine times and then took his own life. Proving once again that there is no tragedy the left is unwilling to exploit, NBC's Bob Costas and other commentators have put all the blame on an inanimate object -- the gun. According to a variety of reports, Belcher was apparently an alcoholic and drug abuser. He was not married to the mother of his baby, and had a very troubled relationship with her. In short, the life they were living was a reflection of the breakdown of the family that is the eating away at wide swaths of American society. Our Second Amendment freedoms are not the problem. Rather it is a culture that says marriage is outdated. Bullets are not the problem. It is a society that has so cheapened human life by elevating abortion that the taking of innocent life is now considered a constitutional right. It isn't the gun. The problem is a society more upset by the possibility someone will see the Ten Commandments in a park or school than the fact that seven people were killed in random street violence in Chicago last weekend. Liberals who think gun control and less freedom are the answer should consider the example of our nation's capital. For years the District of Columbia had the most stringent anti-gun laws. It also had the nation's highest murder rate. Why? Thugs knew that no law abiding citizen had a gun! A few years ago the Supreme Court overturned those absurd laws. At the time, the same liberals who are exploiting this tragic murder/suicide were suggesting that D.C. would turn into a shooting gallery. The result has been the exact opposite -- murders are down to historic lows. They were wrong then and they are wrong now. Either we will follow the path of the decline of Rome -- where every social ill led to bigger government and less freedom -- or we will follow the path of our Founding Fathers, who believed that only a virtuous people could remain free. The choice is stark and time is running out. Lastly, here's some unsolicited advice to all my friends in Congress, on talk radio and libertarians far and wide: If the America you hope to someday govern or influence is the America that I described, of complete cultural and moral breakdown, good luck. It is doubtful you will ever win another election. If you truly want to be the governing party of the United States, the last thing you should be doing is running away from values issues. Yes, America needs a strong, vibrant party that believes in individual liberty, competition and free markets. But there is no government program that can make up for the meltdown of the family. Strong, stable families are the best solution to the big government welfare state. You can read more at my Human Events column. Petraeus For President? No, this isn't about 2016. According to a story in today's Washington Post, Roger Ailes, the chairman of Fox News, tried to persuade General David Petraeus to jump into the 2012 presidential race. During a 90-minute conversation in the spring of 2011, Fox contributor K.T. McFarland told Petraeus that Ailes wanted him to reject Obama's offer to lead the CIA and instead run for the White House. McFarland also implied that Rupert Murdoch would bankroll the campaign. There was a lot of speculation in 2011 about Petraeus running for president. Today's report suggests there may have been more than mere speculation. We raise this because it brings up another interesting angle given all that has happened to General Petraeus recently. There were rumors weeks ago that he gave misleading testimony to Congress because he was afraid that if he didn't Obama's henchmen would leak the news of his affair. Given the way this administration operates, it does not seem at all implausible that it would offer him the directorship of the CIA in order to keep him out of the political arena. And now after the election, he's out of public service completely because of a scandal.

On initial examination, the House Republicans' counter-offer to address the looming "fiscal cliff" tax hikes and spending cuts "appears little more than categorical, preemptive capitulation," Heritage Foundation experts Alison Fraser and J.D. Foster argue.
First, the proposal fails to address the real source of our nation's fiscal crisis: massive overspending, especially on rapidly-expanding entitlement programs like Medicare, Medicaid and Social Security.
"Beyond disappointing, the House Republican counteroffer appears at best to suggest incremental tweaks to these programs," Fraser and Foster write. "Without real entitlement reform-not just spending cuts-we will never fix the underlying problem."

While preferable in general to raising tax rates, this proposal largely dooms future efforts at tax reform based on the sound principle of broadening the tax base to lower the rates. Instead, this proposal would broaden the base, not to lower rates, but to raise revenues. So much for improved economic growth.

While the GOP plan does profess its continued support for the principled budget the House passed this year, Fraser and Foster deem it "a dud. It is utterly unacceptable. It is bad policy, bad economics, and, if we may say so, highly questionable as a negotiating tactic."

For three newly-elected members of Congress, this past weekend's Heritage Foundation briefings for freshmen lawmakers should have been a refresher. That's because they participated in Heritage's educational programs before.

Senate Majority Leader Harry Reid (D-NV) is attempting to change the filibuster process, dubbing it "filibuster reform," in order to shut out the voices of the minority party.
Reid's "filibuster reform" would "allow less time for deliberation on legislation and nominations for Senators, meaning less time for the American public to view that deliberation," The Heritage Foundation's Brian Darling reports.
In addition, Darling explains, in trying to "squelch the rights of individual members of the U.S. Senate...Reid has to ignore the letter of the rules to 'reform' them with a simple-majority party-line vote."

House Republicans Cave on Tax Increases and Punt Entitlements
When President Obama put forth his first offer on the fiscal cliff, House Speaker John Boehner (R-OH) said, "You can't be serious." We could say the same thing to the Speaker after his counteroffer yesterday. In a letter signed by House Republican leadership, including Majority Leader Eric Cantor (R-VA) and Budget Committee Chairman Paul Ryan (R-WI), Boehner offered to raise taxes by $800 billion and cut spending by $1.2 trillion, with no substantive reforms to the entitlement programs that are driving U.S. spending and debt. Heritage's Alison Fraser, director of the Roe Institute for Economic Policy Studies, and J.D. Foster, the Norman B. Ture Senior Fellow in the Economics of Fiscal Policy, quickly responded that "the Republican counteroffer, to the extent it can be interpreted from the hazy details now available, is a dud. It is utterly unacceptable. It is bad policy, bad economics." Boehner's letter to the President actually said that the Republicans were not going to make their more serious proposal, which has already passed the House.
If we were to take your Administration's proposal at face value, then we would counter with the House-passed Budget Resolution. It assumes an overhaul of our tax code with revenue remaining at historically normal levels and proposes structural reforms to preserve and protect the Nation's entitlement programs, ensuring they are sustainable for the long-term rather than continuing to grow out of control.
But, they said, "we recognize it would be counterproductive to publicly or privately propose entitlement reforms that you and the leaders of your party appear unwilling to support in the near-term." This is precisely the time for laying out bold reforms, showing the nation the principles, vision and policies conservatives share to dig out of this budget mess, today and for the long term. Instead, the leadership pointed to a plan they said was suggested by Erskine Bowles, the co-chair of President Obama's debt commission and formerly Bill Clinton's White House Chief of Staff. It raises taxes, but not by raising tax rates-instead, by lowering the amount or number of tax deductions or exemptions available. This misses the point of the tax reform America really needs, said Fraser and Foster:

Essentially, it appears the Republican leadership caved on raising taxes and first steps toward fundamental entitlement reforms that are desperately needed to keep Social Security, Medicare, and Medicaid going. To be sure, the Boehner letter is short on details. But, as Fraser and Foster put it, "Beyond disappointing, the House Republican counteroffer appears at best to suggest incremental tweaks to these programs. Without real entitlement reform-not just spending cuts-we will never fix the underlying problem." Not only would this be the right course to take, but Americans polled just after the election have these priorities more in order than the President and Congress. Just a few days after the election, Gallup asked people to rank a list of 12 issues by importance for the President's second term. Restoring "a strong economy and job market" was No. 1, with entitlement reform-"take major steps to ensure the long-term stability of Social Security and Medicare"-No. 2. "Make major cuts in federal spending" was No. 6 on the list, while raising taxes on people making more than $250,000 a year was way down the list at priority No. 10. Now is the time for leaders to get serious. That means serious entitlement reforms that will deliver real savings and improve the programs. The President and House Republicans should both start over and work together toward solutions the nation truly needs.

What the President Can't Do With the Debt
As the federal government once again approaches the debt ceiling, partisans are pulling out the heavy artillery: Don't bother negotiating with Republicans on taxes and spending, they tell the President, just declare the debt ceiling in violation of the Fourteenth Amendment and ignore it.
As a matter of law, that gambit is just as wrongheaded as it was when this came up last year. As Heritage explained at the time:
Section four of the Fourteenth Amendment provides, "The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned."
This clause simply means that Congress and the President cannot question the validity of debt that is already incurred, but it in no way requires the nation to incur more debt. Even if it precludes temporary default-which is far from clear-it could not authorize the President to incur additional debt.
At most, this clause might require the federal government to prioritize debt payments on existing debt, but no one doubts there is enough tax revenue to cover service on existing debt-without incurring more debt. Besides, the President's unilateral action to add new debt in violation of a debt limit would not be "authorized by law" and so would be the opposite of what the clause requires.
In addition, unilateral action by the President to take on additional debt would be a clear violation of the Constitution's separation of powers. After all, the Constitution vests in Congress-and withholds from the Executive-the power to commit to spending, to raise revenue by enacting taxes, and to incur public debt. The Fourteenth Amendment did not alter this. Congressional control of borrowing, through the debt limit, and section four of the amendment are in unison, not tension.
The law here isn't complicated, and, aside from a few rabid partisans, there's not even much disagreement on this point. Dean Erwin Chemerinsky, a reliable liberal on most matters, concedes, "there is no plausible way to read this provision [Section 4 of the Fourteenth Amendment] as providing the president the ability to increase the debt ceiling without congressional action."
Professor Larry Tribe, the constitutional litigator and treatise author who has regularly advised President Obama on matters of constitutional law, agrees, writing, "Nothing in the Fourteenth Amendment or in any other constitutional provision suggests that the president may usurp legislative power to prevent a violation of the Constitution," including a default.
Add to that list of doubters our Constitutional-Law-Professor-in-Chief: Obama says the Fourteenth Amendment is not "a winning argument." And the President's spokesman admits, "There are no tricks, there is no citing of the Constitution that suddenly allow us to borrow." (Treasury Secretary Tim Geithner, too.)
More than bad law, disregarding the debt policy would be terrible policy. Perhaps the most risible preemptive justification comes from the Jamelle Bouie in The Washington Post, who cites "potential...damage to the economy" from another debt standoff as reason for the President to shrug off the debt limit. But any risk to the economy from a late-in-the-day debt deal would be counterbalanced, and then some, by the massive political, legal, and financial upheaval that would follow exercise of this nuclear option. Even among those who believe the debt-limit mechanism to be sometimes dysfunctional, does anyone really think that smashing it with a sledgehammer is somehow more responsible than just reaching a deal with Congress?
Tossing the text of the Constitution and centuries of constitutional practice by the wayside isn't something to be done lightly, and surely not for something so ephemeral as strengthening the President's "negotiating position" with Congress-which Bouie identifies as his chief object. And judging by their rhetoric-Members of Congress who seek to cut spending are "hostage takers" and worse-others in the smasher camp seem to share his focus on short-term political dividends, while paying little mind to the consequences.
For the sake of our Constitution and our finances, may cooler heads prevail.

The murder suicide committed by selfish coddled phony Kansas City Chief's linebacker Jovan Belcher was a tragedy for two people. His live-in girlfriend murder victim, 22 year old Kasandra Perkins, of course, but more so their 3 month old baby daughter Zoey who is now left an orphan because her father could not deal with hearing the word "No."
Of course we don't know exactly what was being argued over when the frustration of being told "No" must have overtaken Belcher. Nevertheless, in the aftermath what we can see and hear gives us a fair idea of what we couldn't see or hear as the fatal argument unfolded in the couple's home last week. Ms. Perkins made the fatal choice to say "No" to Belcher and lost her life for it.
