Voters approve Agenda 21/Sustainable Development style bill in central Pennsylvania
On election day I was surprised to find a referendum in Ferguson Twp (State College area) that called for the voters to approve an "Environmental Bill of Rights," that would actually amend the township's home rule charter and, in many cases, seek to trump private property rights. The measure passed in Ferguson Twp, 4272 to 3896. The township board of supervisors is very much against this measure because it likely is counter to State laws on private property use. This sure sounded like an Agenda 21 - style effort so I did a little homework. Here is what I learned (below). Am wondering of any of you know more and if we at freedom works have any initiatives to counter these efforts?
According to the Centre Daily Times:
1. The measure outlines citizen rights to things like clean air, clean water, and sustainable communities. It also declares a ban on natural gas drilling and all actions related to the fracking industry.
2. Township Supervisor Drew Clemson said the board will meet with legal counsel and determine how to proceed. "When you read through the referendum point by point, there are portions that can possibly be unlawful to enforce," he said.
3. Members of Groundswell PA, a group advocating for sustainable communities, successfully petitioned to get the environmental bill of rights on the Nov. 6 ballot. The group did the same in State College last year, and voters approved the provision.
4. The measure would amend the township's home rule charter to state that residents have rights to clean air and water, self-government and a sustainable energy future. It also would ban hydraulic fracturing, or fracking, the process being used across the state to produce natural gas.
5. When the petition first was presented for inclusion on the ballot, Ferguson Township officials planned to file an injunction in county court, seeking a ruling on the question's constitutionality. However, solicitor Lewis Steinberg advised that residents must first have their say. If the bill of rights is approved, the township may decide to challenge it, if deemed appropriate.
6. "If the proposed amendment were to pass, Ferguson Township's Board of Supervisors would be placed in the untenable position of having to go to the expense of attempting to defend a law which it knew was not enforceable," Steinberg said in a township news release Wednesday.
7. The township information tells voters that the amendment would change "landowner rights, opens the (t)ownship to lawsuits, and puts the future of our community in financial jeopardy."

Do you know that because you made the calls and then blasted your groups we made over 1,000 calls to the Governor and legislators today? IS THAT AMAZING OR WHAT????? Now I know some of you feel you are getting conflicting information from your legislators or the Governor. That happens alot...but with the 2700 page Obamacare and its ramifications at the state level? It's going to happen ALL THE TIME. So here what's happening now: 1.) Governor Corbett said he would allow the federal government to set up an exchange (which is what we want...see ourFAQ for why we support that position) but he is open to have the state set one up too. We think he may want to do a joint federal-state exchange. All of these positions have different deadlines. We reject all them OTHER than to have Corbett refuse to set up a state exchange ever and work with leadership to pass HB 2655 to remove any Governor's power to ever do so. 2.) We have to make sure the House re-introduces HB 2655 in the January session. But we can't wait until January. We have to keep the pressure on these legisators clear through Christmas. So, for the three days before Thanksgiving, we are going to go after FIVE LEGISLATORS that we think can not only re-introduce the bill, but also get it passed.
Governor Corbett is asking for clarification from the federal government (good luck) and crunching the numbers. Maybe you could save him some time by telling him he will come up short because Obamacare is a failure, no matter which way you slice it. Let's not rest on our laurels.
So here is what you have to do:
a.) Follow b. and c. below and then ask two people to do the same.
Be sure to share this only with people who support this cause.
b.) Give Governor Corbett a call at 717-787-2500 and tell him
you DO NOT WANT him to implement the exchanges. Ask him to support HB2655.
It is time for the Governor to stand for Pennsylvania and reject the creation of this exchange.
c.) Our efforts to pass HB 2655will be focused in the House. Please call your representative in the house and here are the names and numbers of the leadership you need to call. Don't worry if they are not in your district, call them anyway. If they are leaders in the General Assembly, then they need to focus on how all of Pennsylvania feels about HB 2655, not just their constituents.

Was The Boston Tea Party Terrorism? Texas Schools Are Teaching Just That (And More)

In less than a month (December 16th), we will mark the 239th anniversary of the Boston Tea Party. This well-known protest against "taxation without representation" is almost universally recognized as the moment that sparked the American Revolution.
In many Texas public schools, the Boston Tea Party is now being taught as an example of an act of terrorism.
Here's an excerpt from a Texas school system's World History / Social Studies lesson plan. It purports to be helping teachers become more efficient, but many people are upset with the content of the lesson and the lack of parental review. In this specific instance, teachers are instructed to read the story to their classes as if it were a news report that had just happened within the past hour:
News report: New Act of Terrorism A local militia, believed to be a terrorist organization, attacked the property of private citizens today at our nation's busiest port. Although no one was injured in the attack, a large quantity of merchandise, considered to be valuable to its owners and loathsome to the perpetrators, was destroyed. The terrorists, dressed in disguise and apparently intoxicated, were able to escape into the night with the help of local citizens who harbor these fugitives and conceal their identities from the authorities. It is believed that the terrorist attack was a response to the policies enacted by the occupying country's government. Even stronger policies are anticipated by the local citizens.

Dems Seek to Expand and Redeploy Obama's Voter Data Mine: 'The Most Sophisticated Voter List in American Political History'

The president of the United States has amassed a massive voter data mine with "files" on millions of American citizens. The president's presidential campaign utilized this data, including voters' magazine subscriptions, car registrations, housing values and hunting licenses, to formulate scores that help identify and motivate likely voters.
Yes, that would make a fantastic plot for a political thriller novel, but Barack Obama's voter database is real - and it's growing in size and implementation. Even though Obama won the election less than a month ago, Democrats already want to "expand and redeploy the most sophisticated voter list in American political history," The Washington Post reports. The Left will apparently start by using the database in the Virginia and New Jersey gubernational races in 2013 and then in various campaigns in the future.

The original targets of the Ku Klux Klan were Republicans, both black and white, according to a new television program and book, which describe how the Democrats started the KKK and for decades harassed the GOP with lynchings and threats.
An estimated 3,446 blacks and 1,297 whites died at the end of KKK ropes from 1882 to 1964.
The documentation has been assembled by David Barton of Wallbuilders and published in his book "Setting the Record Straight: American History in Black & White," which reveals that not only did the Democrats work hand-in-glove with the Ku Klux Klan for generations, they started the KKK and endorsed its mayhem.
"Of all forms of violent intimidation, lynchings were by far the most effective," Barton said in his book. "Republicans often led the efforts to pass federal anti-lynching laws and their platforms consistently called for a ban on lynching. Democrats successfully blocked those bills and their platforms never did condemn lynchings."
Further, the first grand wizard of the KKK was honored at the 1868 Democratic National Convention, no Democrats voted for the 14th Amendment to grant citizenship to former slaves and, to this day, the party website ignores those decades of racism, he said.

The Great Betrayal: Obama's Wars and the War in Iraq

Daniel Greenfield's new Freedom Center pamphlet, The Great Betrayal: Obama's Wars and the War in Iraq, is an effort to understand the politics of the "war on terror" which has now reached a final punctuation point with the U.S. decision to speed its withdrawal from the battlefields of Iraq and Afghanistan (where success was once deemed so crucial to national security), and to practice an incoherent form of regime change in Libya while ignoring more serious threats in Syria and Iran.
The war on terror began, Greenfield shows, as an admirable bipartisan commitment soon after the tragedy of 9/11-an effort to transcend party lines not only to punish those who attacked our country but also to interrupt planning for further attacks and try to stop the international spread of the Islamic jihad behind the attacks. But the Democratic Party, with the honorable exception of a few individuals like Richard Gephardt and Joe Lieberman, turned its back on a war soon after authorizing it, and did so at a time when American troops were facing hostile enemy fire.
Although Senate Democrats on the intelligence oversight committee had been granted access to every piece of data available to the White House, they now accused President Bush of tricking them to secure their approval. In fact, their own about-face was entirely dictated by political considerations when a Sixties antiwar activist, Howard Dean, surged ahead in the Democratic primary polls and it appeared for a moment that Americans were on the side of retreat and capitulation.
Although regime change in Iraq had been official U.S. policy since Bill Clinton signed the Iraq Liberation Act of 1998, Democratic senators such as John Kerry who only months earlier had supported the war effort now launched demoralizing attacks on the American commander-in-chief and his troops in the field, stigmatizing it as "the wrong war in the wrong place at the wrong time." If the truth was the first casualty of their war against the Bush administration, the second casualty was the principle of bi-partisanship that had guided foreign policy debates throughout the Cold War, the principle that "politics stops at the water's edge." Now partisan politics trumped security.
The unrestrained attacks on the Iraq War as illegal and unjustified went largely unanswered by Republicans who failed to call the Democratic saboteurs of the nation's war effort to account or to decry the risk their cynical attacks posed to American servicemen and women on the battlefield. As Greenfield demonstrates, the Democrats' partisanship had consequences not only in Iraq but elsewhere in the region: the paralysis that resulted from their "anti-war" campaign led straight to the destruction of Lebanon and the installation of a terrorist army, Hezbollah, there as a regime within a regime. And it emboldened an overtly Islamofascist regime in Iran not only to supply the IEDs responsible for most of our troop fatalities in Iraq but also to proceed with a nuclear program aimed directly at Israel and the West.
The Great Betrayal shows that Barack Obama's abandonment of Iraq is a betrayal of all the Americans and Iraqis who gave their lives to establish freedom in that country. And the result of his policies in Afghanistan has been as disastrous. While the President presented his rationale for pursuing war there as the pursuit of al-Qaeda, after abandoning his "surge" (which resulted in two thirds of all America's Afghan casualties there and the resurgence of the Taliban allies of al-Qaeda), he blithely prepared for withdrawal as if national objectives had been met.

1. I Believe and Am Thankful
Marco Rubio is getting beaten up by the press for not decisively and convincingly saying he thinks the world is billions of years old. The press gave Barack Obama a pass for largely the same answer. This issue has become the new litmus test in the media for conservative politicians. Believing what was believed to be literally true for a few thousand years is now nutty. Christian homeschool kids, often taught that the world is not as old as some believe and who routinely kick the rear ends of the ivy prep kids in academics, are considered stupid.
Truth be told, I think the world is billions of years old, but I have no doubt God created it. . . .
But let's not stop with creation. Because once every Christian politician in the country has answered that question, the secular set will just move on. Let me move on first.
Yes, I believe there was an Adam and I believe there was an Eve.
Yes, I believe there were two cities named Sodom and Gomorrah and yes I do believe they were destroyed for rampant sin including deviating from God's intentions sexually.
Yes, I believe there was a man named Noah who spent 100 years building a giant boat and I do believe there was a great flood and the survivors of which were all on that boat.
And yes, I do believe there was a man named Jonah who was swallowed up by a great big fish and survived.
Above all those things, I do believe God came down to Earth in the form of Jesus . . . . I absolutely believe it. I absolutely believe if by that time a person has not chosen Christ, he will end up in a very bad place. I believe in Heaven and Hell and the battle that rages between the two on a higher plane than we can often see.

2. Um . . . Heck Yeah We Are the Latter "A deliberate choice is going to have to be made," he said. A whopping 37% of voters selected 'rising prices' as their most important issue in the election, yet amazingly, they split their votes evenly between Romney and Obama. Hence, the arsonist behind the high prices for food, fuel, healthcare, and every other vital product and service affected by his tax and regulatory regime, was regarded as the firefighter by half the electorate. The single most regressive market-distorting policy to ever emanate from Washington is the absurd tendentious treatment of ethanol. Over the past decade, ethanol has been the poster child for the worst aspects of big-government crony capitalism. The ethanol industry has used the fist of government to mandate that fuel blenders use their product, to subsidize their production with refundable tax credits, and to impose tariffs on more efficient sugar-based ethanol from Brazil. These policies have distorted the market for corn to such a degree that 44% of all corn grown in the country is diverted towards motor fuel blends. The endless wars with Israel are not really about the Jewish State. Nor are the wars about the Arabs living in the territories that Israel lost in 1948 to Jordan and Egypt and recaptured from them in 1967. The rest of the Muslim world cares no more about them than Hitler cared about the Sudeten Germans or Japan really believed in the rights of Chinese and Koreans. Israel is a sideline in a regional struggle by fractured populations, divided by ethnicity and religion, by language and natural resources, to unite into a single commonality. It is a natural target because its population consists of a people who are members of a different religious and ethnic group than the dominant religious and ethnic groups of the region. Unlike the Persians and Turks, the Jews are not Muslims, not even Shiites, and unlike the Christian Arabs, the Jews are not even of the same ethnicity as the regional majority. Jews are neither Muslims nor Arabs and that makes them unique and alien in a region where every country is dominated by either an Arab or Muslim identity. Or both. To the Arab Nationalist, the Persian and Turk is an alien, but the Christian Arab is a brother. To the Islamist, the Christian Arab is a Dhimmi or an infidel, but the Turk is a brother in faith. But to both, the Jew and the Jewish State are an alien presence in the region that must be removed for their own version of regional unity to flourish. The Post-Colonial contest in the Middle East has been over how to unite the fractured ethnic minorities and the religious splits together into a single region. What do the tribal oil monarchies have in common with the former colonies ruled by military strongmen? What do any of them have in common with the Persians and the Turks? Uniting behind something is difficult, as even the Islamists must admit. Islam split over issues of succession not too long after Mohammed's death. But uniting against something is fairly easy. The Jews are the most alien of all the groups in the region. Unable to unite on love, the Middle East unites on hate and hating Israel gives everyone in the region a feeling of having something in common.

Over the last five days, Hamas militants in Gaza have fired over 800 rockets at Israel. These rockets have reached the outer limits of the densely populated cities of Tel Aviv and Jerusalem.
The rockets are believed to have been smuggled into Gaza from Iran, and as The Heritage Foundation's James Phillips explains, "the increasing range and sophistication of Palestinian rockets has expanded the reach of terrorists, who now can threaten up to half of Israel's population."
So far, Israel has successfully intercepted 302 of the rockets fired at the nation through the use of their Iron Dome missile defense system.
In a statement earlier this week, President Obama said Israel has the right to defend its citizens, but cautioned Israel from engaging in a ground assault in Gaza. Phillips explains how this public statement was detrimental to the future of peace in the Middle East:

This public statement will only strengthen Hamas's determination to continue its rocket terrorism and reap the propaganda benefits from Israeli retaliatory air strikes, because the President's statement lowers the perceived risks of an Israeli ground intervention. Moreover, it is continued Palestinian terrorism that is the chief barrier to peace, not Israel's legitimate efforts to protect its own citizens from indiscriminate Palestinian terrorist attacks... If they genuinely wanted to stop the bloodshed, then these leaders should pressure Hamas to stop the bombardment, which triggered the crisis.

The United States needs to show it will stand with its Israeli ally against terrorism, and President Obama should speak to restraining Hamas, not Israel.

The Department of Energy gives grants to companies that produce clean energy. Recently the department gave nearly $1 million in grant funds to a battery company on the very day the company filed for bankruptcy. And where do the funds for the grant come? Your taxes.
The Heritage Foundation's Lachlan Markay, investigative reporter for Heritage's Center for Media and Public Policy, explains this grievous waste of taxpayer dollars was given to the battery making company, A123 Systems Inc.
The DOE agreed to give the company a $249 million clean energy grant, of which, as Lachlan explains: "As of November 14, $115.8 million of the A123's grant remained outstanding."

Twinkies, Ho Ho's, Dingdongs and CupCakes might soon become a thing of the past due to a Baker Union strike. According to the Hostess website, "Hostess Brands, Inc. has been forced by a Bakers Union strike to shut down all operations."
The Hostess factories are just one high profile example of unions wielding their power and intervening in the free market. In addition to a lack of Twinkies and Wonderbread, union strikes are causing upsets in other industries as well.
President Obama has been a long time ally of union leaders and made a point of taking one of his first meetings after re-election with union leaders who spent heavily in the past election.

No Higher Power: The Treacherous Trio of Myths Spawned by "Separation of Church and State," II
With their victories in the 2012 elections, Reconstructionists (Liberals/Humanists) may be expected to intensify their attacks on America's Judeo-Christian foundations and our Judeo-Christian Constitution. The recent elections therefore make it even more imperative (if possible) that we Constitutionalists understand, and are prepared to repel, a group of the Reconstructionists' most potent weapons - the "treacherous Trio of Myths" - which we introduced in our last "Court Watch Briefing."
Spawned by the mythical idea of "separation of church and state," this "Treacherous Trio" includes the following: (1) There are no absolutes and therefore no inevitable, fixed relationships between different worldviews; (2) America must be a "pluralistic" (i.e., "diverse") nation - a culture embracing all different views and values concerning worldviews; (3) given propositions (1) and (2), we must be tolerant of the "diversity" in America. "Relativism" is a belief; "pluralism" is a condition; and "tolerance" is an attitude. In our last "Briefing," we demolished Myth #1 with Constitutionalist arguments supporting the "Absolutism of Relativism." In this "Briefing," we tackle Reconstructionists' propositions #2 and #3. First, we consider the "Dogma of Diversity" (i.e., "pluralism"). Reconstructionists profess an undying loyalty to "pluralism" or "diversity" which they purport to define as the peaceful coexistence in America of views and values which are disparate and sometimes polemically opposed to one another. The Truth About Gaza
I was wrong to support Israel's 'disengagement' from the Strip in 2005.

Sometimes it behooves even a pundit to acknowledge his mistakes. In 2004 as editor of the Jerusalem Post, and in 2006 in this column, I made the case that Israel was smart to withdraw its soldiers and settlers from the Gaza Strip. I was wrong.
My error was to confuse a good argument with good policy; to suppose that mere self-justification is a form of strategic prudence. It isn't. Israel is obviously within its rights to defend itself now against a swarm of rockets and mortars from Gaza. But if it had maintained a military presence in the Strip, it would not now be living under this massive barrage.
Or, to put it another way: The diplomatic and public-relations benefit Israel derives from being able to defend itself from across a "border" and without having to get into an argument about settlements isn't worth the price Israelis have had to pay in lives and terror.
That is not the way it seemed to me in 2004, when then-Prime Minister Ariel Sharon decided to pull up stakes, reversing the very policy he had done so much to promote as a general and politician in the 1970s. Gaza, I argued, was vital neither to the Jewish state's security nor to its identity. It was a drain on Israel's moral, military, political and diplomatic resources. Getting out of the Strip meant shaving off nearly half of the Palestinian population (and the population with the highest birthrate), thereby largely solving Israel's demographic challenge.
Withdrawal also meant putting the notion of land-for-peace to a real-world test. Would Gazans turn the Strip into a showcase Palestinian state, a Mediterranean Dubai, or into another Beirut circa 1982? If the former, then Israel could withdraw from the West Bank with some confidence. If the latter, it would put illusions to rest, both within Israel and throughout the Western world.
Finally, I argued that while direct negotiations with the Palestinians had proved fruitless for Israel, Jerusalem could use its withdrawal from Gaza to obtain political and security guarantees from the United States. That's just what Mr. Sharon appeared to get through an exchange of formal letters with George W. Bush in April 2004.
Things didn't work out as I had hoped. To say the least.
Within six months of Israel's withdrawal, Hamas won Palestinian parliamentary elections. Within two years, Hamas seized control of the Strip from the ostensible moderates of Fatah after a brief civil war.
In 2004, the last full year in which Israel had a security presence in Gaza, Gazans fired 281 rockets into Israel. By 2006 that figure had risen to 1,777. The Strip became a terrorist bazaar, home not only to Hamas but also Islamic Jihad and Ansar al-Sunna, an al Qaeda affiliate.
In late 2008, Israel finally tried to put a stop to attacks from Gaza with Operation Cast Lead. The limited action-Israeli troops didn't go into heavily populated areas and refrained from targeting Hamas's senior leadership-was met with broad condemnation, including a U.N. report (since recanted by its lead author) accusing Israel of possible "crimes against humanity."
Nor did the reality of post-occupation Gaza do much to dent the appetite of the Obama administration for yet another effort to broker Israeli-Palestinian peace. That included a settlement freeze in the West Bank (observed by the government of Benjamin Netanyahu, to zero benefit) and calls by President Obama for Israel to withdraw to its 1967 lines "with mutually agreed swaps."
In 2009, Hillary Clinton disavowed the Bush-Sharon exchange of letters, saying they "did not become part of the official position of the United States government." Even today, the Obama administration considers Gaza to be "occupied" territory, a position disavowed even by Hamas.
Put simply, Israel's withdrawal from Gaza yielded less security, greater diplomatic isolation, and a Palestinian regime even more radical and emboldened than it had been before. As strategic failures go, it was nearly perfect.
Now Israel may be on the cusp of purchasing yet another long-term strategic failure for the sake of a short-term tactical success. The Israeli government wants to bomb Hamas into a cease-fire-hopefully lasting, probably orchestrated in Cairo. That way Israel gets the quiet it seeks, especially on the eve of elections in January, and the Egyptians get the responsibility for holding the leash on Hamas.
That is largely how it played out during Cast Lead. But as one leading Israeli political figure told me in January 2009, just as the last cease-fire had been declared, "Notwithstanding the blows to the Hamas, it's still in Gaza, it's still ruling Gaza, and the Philadelphi corridor [which runs along Gaza's border with Egypt] is still porous, and . . . Hamas can smuggle new rockets unless [the corridor] is closed, to fire at Israel in the future."
That leading political figure was Benjamin Netanyahu, just before he returned to office as prime minister. He might now consider taking his own advice. Israel can afford to watch only so many reruns of this same, sordid show.

The Israeli tactic is to make the Hamas leadership pay directly for these terror attacks on Israel rather than to make the population of Gaza pay. Israeli targeting was extremely careful, and by Friday afternoon there had been several hundred strikes by the Israeli Air Force but fewer than two dozen Palestinian deaths -- and very few accidental hits at civilians that Hamas could turn to propaganda advantage. ... Not only will there be Syria, the violence coming from Gaza, a Muslim Brotherhood government in Egypt whose commitment to democracy is at best unproved, and an increasing sense of instability in Jordan, but looming over all this will be Iran. ... The next three to six months in the Middle East will make Obama administration officials look back to 2012 with nostalgia as a quiet time when they were able to focus on the campaign. Rules released requiring pre-existing conditions coverage By Sam Baker
The Obama administration released new regulations Tuesday that require insurance companies to cover people with pre-existing conditions.
The new rules represent one of the first steps taken by the Health and Human Services Department to implement some of the most popular - and most expensive - provisions of President Obama's signature healthcare law.
HHS also began putting in place new limits on how much insurers can vary their premiums - for example, allowing them to charge older patients only three times more than younger customers. The law prohibits insurers from varying premiums at all based on some factors, including gender and health status.

MSNBC Did No Negative Stories About Obama or Positive Ones About Romney Last Week of Campaign

This is all Americans need to know about just how disgraceful a "news network" MSNBC is.
A new study just released by the Pew Research Center found that in the final week of the just-ended presidential campaign, the "Lean Forward" network did absolutely no negative stories about President Obama or positive ones about Mitt Romney.
MSNBC's coverage of Romney during the final week (68% negative with no positive stories in the sample), was far more negative than the overall press, and even more negative than it had been during October 1 to 28 when 5% was positive and 57% was negative.
For Obama, meanwhile, the coverage improved in the last week. From October 1 to 28, 33% was positive and 13% negative. During the campaign's final week, fully 51% of MSNBC's stories were positive while there were no negative stories at all in the sample.
How disgraceful!

The president is convinced Americans need to pay more in taxes. Here's what he said yesterday. "I think everybody out there understood that was an important debate and the majority of voters agreed with me. By the way, more voters agreed with me on this issue than voted for me! So we've got a clear majority of the American people who recognize if we're gonna be serious about deficit reduction we gotta do it in a balanced way."
But let me tell you, come January 1, you're probably not going to be happy with the amount of taxes you're paying. That's because it's not just Federal taxes that you pay. A middle class taxpayer pays 25% percent of their income in Federal Income Tax. Sounds, ok? Then there is the Federal Social Security and Medicare payroll tax of 13.3%. You pick up 5.65% while you're employer pays 7.65%. Add them up and that's 38.3% of middle class family incomes going to Uncle Sam. But we aren't done, not by a long shot.

CBS News claims that Office of the DNI removed references to al Qaeda and terrorism

Citing "an intelligence source," CBS News reports that the "Office of the Director of National Intelligence (DNI)" cut references to "al Qaeda" and "terrorism" from the unclassified talking points given to Ambassador Susan Rice on the Benghazi consulate attack, and did so with the agreement of the CIA and FBI. Neither the State Department nor the White House made these changes, according to CBS. But the DNI himself, James Clapper, has testified before Congress. Based on the comments of some of the legislators who were present at the hearing, it did not appear that Clapper changed the CIA's report or knew who did. Moreover, Gen. Petraeus reportedly testified that he had no idea who changed his report. It seems unlikely that the CIA would sign off on changes without consulting Petraeus. So there may be a disconnect here. Congress needs to find out who within the Office of the DIA made the changes and who within the CIA approved them, if in fact anyone did. Meanwhile, the reason offered up for changing the CIA's report makes no sense. Supposedly, the links to al Qaeda were deemed too "tenuous" to make public, because there was not strong confidence in the person providing the intelligence. Such lack of confidence, if any there really was, might suffice as a basis for removing references to al Qaeda. Congress needs to find out whether there really was a jutified lack of confidence in those who linked the Benghazi attacks to al Qaeda. Read More . . .

The Israeli public overwhelmingly backs its government's decision to launch operation Pillar of Defense in response to Hamas' rocket attacks against southern Israel. A poll taken for the Israeli Center for Political Training found that 85 percent of Israelis believe embarking on the operation was the correct decision. Israelis divide, however, on the question of what should happen next. According to the same poll, 45 percent favor continuing the air strikes; 25 percent think Israel should commence a ground war in Gaza; and 22 percent want a cease-fire agreement. A poll taken for Ha'aretz found essentially the same thing. 84 percent support the military operation; 39 percent want it to be continued by air; 30 percent back a ground invasion; and 19 percent call for an immediate cease fire. These poll results help explain, I think, why Israel has not launched a ground operation even though, on the merits, it is probably the most sensible course. Can Hostess Save the Twinkies from the Union?
Taking down the Twinkie. Clogging Wal-Mart parking lots on Black Friday. Messing with a major airport on the day before Thanksgiving. If unions are trying to be more popular with the American people, they're doing it wrong. Americans have gone crazy over the possible loss of Twinkies, Ho Ho's, Ding Dongs, and Hostess CupCakes after the company said it was shutting down because its bakers' union opted to walk off the job for a strike. People are already asking exorbitant prices on eBay for boxes of the packaged treats. Hostess and the Bakery, Confectionery, Tobacco Workers and Grain Millers International Union (BCTGM) have agreed to enter mediation with a bankruptcy judge, who said there are "serious questions as to the logic behind the decision to strike." More than 18,000 jobs are at stake. A Washington Post blogger says that "The AFL-CIO plans to try to turn this into a 'teachable moment' and a 'national discussion.'" Union membership has been declining in the private sector, and the groups are desperate to reverse that trend. But shutting down one of America's beloved brands certainly isn't going to win lots of friends. Obviously, poor management helped get Hostess to this point, and contested payouts for managers are causing controversy. Megan McArdle explains that paying incentives to managers to stay on during a rough bankruptcy transition isn't unusual-it's hard to convince people to stay and steer a sinking ship. Unfortunately, sometimes that means senior leaders could try to take advantage of this situation to get more money for themselves on the way down. But McArdle reports that the current management "opened the books to the unions, paid senior management virtually nothing, and tried to cut deals that would save the company and salvage something of the grossly underfunded multi-employer pension plans of which they were a part." The new managers did everything unions typically ask for in such situations. It was enough to satisfy the Teamsters, who also represent employees involved in distributing the products. They came to a deal with the company to continue work. Yet the bakers walked out. Their union didn't file any objections to the bankruptcy plan when the judge proposed it in August. Instead, the union's leaders called for a strike. The strike was authorized with a voice vote-a public vote in the union halls-and the union leadership refused the Teamsters' request for a secret ballot vote on returning to work. Why would the union do this? James Sherk, Heritage's senior policy analyst in labor economics, says:
Either the union leadership was (a) utterly incompetent, or (b) was willing to sacrifice its members' jobs at Hostess in order to send a message to other firms that it would play hardball and they should not ask for concessions. Either way, it was not looking out for its members at Hostess.
Hostess is just the latest in the upward trend of labor strikes. After falling for decades, the number of strikes in the U.S. is climbing. In 2009, there were five major work stoppages (involving 1,000 or more employees). In 2011, there were 19. Even when workers don't walk off the job, unions are looking to cause chaos. A union-backed group is planning to stage protests at Wal-Mart stores on Black Friday. And unionized workers with the Service Employees International Union (SEIU) are planning a protest at Los Angeles International Airport tomorrow-one of the busiest travel days of the year. The aviation company in that case says the majority of its workers voted last year to leave the union. "Our employees are now earning more per hour than under SEIU and are happy to be free of them," said Joe Conlon, Aviation Safeguards' regional vice president. Many Hostess employees probably wish they had the same opportunity to vote. However, they never got that choice. Once they're in, unions remain certified indefinitely; they do not have to stand for re-election. Instead, new workers must accept the union's representation as a condition of employment. Just 7 percent of private-sector union members voted to belong to their union. The only way to get rid of a union is by filing for decertification-an extremely difficult legal process. Had Hostess workers gotten to vote, they might have opted for a more reasonable representative who would actually look out for them. This is why union representation should be voluntary-or, at the very least, unions should have to regularly stand for re-election. Unfortunately, the Obama Administration is moving in the opposite direction. His National Labor Relations Board (NLRB) recently changed the rules so that unions can cherry-pick who gets to vote in union elections. This will allow unions to disenfranchise those workers who don't want to take the risk of strikes bankrupting their company, too. When the President returned to Washington after the election, one of his first meetings was with union leaders. After spending heavily in the election, the unions are keen to use the political process to boost their ranks. Their membership may be dropping, but union power in Washington is growing.

Make no mistake the election results clearly say it: we got pasted. We can point fingers and wring our hands but the truth is we got flogged. Nevertheless, there are no permanent winners or permanent losers in the political American system.
Conservatism did not necessarily lose. We got about 48% of the vote but there may be another 5% who understand economies and can be convinced to vote for a conservative Republican in 2016. We held the House and some observers are saying although our numbers are smaller we have a more conservative caucus than we had in the last Congress.
We have more governorship, (30) now which is more than we have had in a long time. This edge presents a possibility that they will hold the line on implementing state healthcare systems. As reports flood the web about massive voter fraud in the presidential election, a statewide appeal in Florida is going out today to all Tea Party members, conservatives, and independents to contact Governor Rick Scott to urge him to NOT certify election results in tomorrow's deadline. Florida's U.S.18th Congressional Race is still up for grabs because reportedly the Golden Gate Precinct #93, a mobile home park on the border with St. Lucie and Martin counties, had some 900 votes cast with only SEVEN people registered to vote!
An over- night flash Email is stating that "In St. Lucie County, FL, there were 175,574 registered eligible voters but 247,713 votes cast." Volunteer recount watchers yesterday were upset when the delayed canvassing board recount missed the noon Sunday deadline, and Patrick Murphy was named winner.

It's Never Over
|
Like most of you, we at the ACRU are still stunned by the election results and what they mean for our country. Now is not the time to retreat, however, but to redouble our efforts to bring America back to constitutional principles. The first order of business will be to truly secure the integrity of the ballot box.
It's imperative that we enact more safeguards, since vote fraud almost certainly played a role in the November 6 election in some jurisdictions.
The ACRU is co-hosting with the Heritage Foundation a strategic conference December 12 to 14 in Colorado Springs with several secretaries of state and experts who have been outspoken advocates for voter photo ID laws and other electoral reforms. Among the invited guests are John Fund, Hans von Spakovsky, Colorado Secretary of State Scott Gessler, Kansas Secretary of State Kris Kobach and ACRU Senior Fellow Ken Blackwell, a former Ohio Secretary of State. I'll let you know what transpired there in a future issue of The Clarion.
In Pennsylvania, a state judge issued a ruling in October blocking the state photo ID law. Maybe that's why 59 wards in Philadelphia, according to the Philadelphia Inquirer, reported a total of 19,605 votes for Barack Obama and zero for Mitt Romney. In Ohio's Cuyahoga County, 100 precincts reported more than 99 percent for Barack Obama, with some reporting 100 percent. I don't have to tell you that the odds of that happening are astronomical.
In Florida, Republican Rep. Allen West is contesting Democrat Patrick Murphy's razor-thin margin in the 18th Congressional District following a partial recount. As the Washington Times editorialized,
"On election night, Mr. West had maintained a district-wide lead of nearly 2,000 votes until the St. Lucie County Supervisor of Elections inexplicably 'recounted' thousands of early ballots, resulting in an awfully convenient 4,400-vote shift in favor of the challenger. Observers on the scene charged incompetence, intimidation and possible fraud...." In Maryland, some voters reported difficulty with machines not allowing them to vote "no" on the same-sex "marriage" question. As reports keep coming in, we'll keep you apprised of what the "mainstream" media are ignoring.
By the way, given the media's liberal bias, you probably didn't hear that Ohio Republicans won 12 of 16 congressional seats, control the state Senate 23 to 10 and the state House 60 to 39, and hold all statewide elected offices. It's a bit early to declare our two-party system dead.

ACRU Asks Court to Hear Colleges' Case against HHS Mandate
|
Lower federal courts erred in dismissing two colleges' challenges to the Obama Administration's contraception mandate, the ACRU argues in an amicus brief filed on Oct. 12 at the U.S. Supreme Court.
Written by ACRU General Counsel Peter Ferrara, the brief in Wheaton College and Belmont Abbey College v. Kathleen Sebelius notes that the rulings place the colleges in "legal limbo" and "deny them a chance to question the constitutionality of the final regulation--all while facing immediate and undeniable harm." Oral arguments have not yet been scheduled.

Court May Hear Obamacare Challenge
|
In a case with profound implications, the U.S. Supreme Court is weighing whether to hear Liberty University's lawsuit against the Affordable Care Act (Obamacare), which the Court upheld under Congress's taxing power in NFIB v. Sebelius.
ACRU Senior Legal Analyst Ken Klukowski, who is on faculty at Liberty University School of Law, noted in a Breitbart.com column that the Justice Department voiced no objection, and that:
"Liberty argues that ... Obamacare violates its First Amendment religious freedoms through its funding of abortions and other practices that are contradictory to the religious mission of the university. The lawsuit also challenges one of the other major provisions of Obamacare - the Employer Mandate."
The Court is expected to decide whether to hear the case by the end of November.

Supremes to Hear Challenge to Voting Rights Act
|
In another important case to be heard next year, the Supreme Court will revisit Section 5 of the Voting Rights Act of 1965. The law requires the U.S. Justice Department or a three-judge federal panel in the District of Columbia to approve any changes in election laws or districting in Southern states and in some local jurisdictions around the nation. Congress enacted the law to prevent racially-motivated voting rights violations.
In a 1966 case, South Carolina v. Katzenbach, "the Court held that the problems of racial hostility and voter suppression were so egregious and widespread in that part of the country that the Fifteenth Amendment permitted such an intense intrusion into state sovereignty," Mr. Klukowski wrote in a Nov. 9 column. "But it was also made clear in Katzenbach that if the facts involving racial equality significantly changed, Section 5 might no longer be authorized by the Fifteenth Amendment."
Citing the Voting Rights Act, the U.S. Justice Department under Eric H. Holder, Jr. blocked new photo ID voter laws in South Carolina and Texas.

There are plenty of things to be thankful for this week, and this year as well.
Yes, after our country's recent elections, big government remains the rule here in the United States and throughout the West. Yet the language used by the candidates (both talked of reducing federal spending and creating jobs, for example) and the closeness of the race proved that, in the U.S. at least, conservatism remains a powerful force.
Conservative thinkers present a compelling, principled alternative to liberal ideas. Right-leaning politicians retained control of the House of Representatives, where they'll control all spending bills and be able to push back against the expansion of government. GOP governors will run 30 states, and can use their offices to thwart federal overreach. Many governors, for example, have already announced they won't set up Obamacare insurance exchanges, which will save the states money and may doom the entire federal power-grab.
Rather than despair, conservatives should use this holiday season to count our blessings, review our plans, and further our agenda in 2013.
But the act of giving thanks requires someone or something to give thanks to. So it's also worth noting that Thanksgiving highlights the importance of religion in public life, and that our unique founding ensures that religion remains a key pillar of American greatness. President Abraham Lincoln created the modern Thanksgiving Day tradition when he announced, in 1863, that the third Thursday of November would henceforth be celebrated as an official national holiday.
Lincoln unapologetically cited "the gracious gifts of the Most High God, who, while dealing with us in anger for our sins, hath nevertheless remembered mercy." Long before that, President George Washington named Nov. 26, 1789 as a day of thanksgiving devoted to: "the service of that great and glorious Being who is the beneficent Author of all the good that was, that is, or that will be."
Famously, God went unmentioned last year. Yet President Obama has made it a point in years past to direct thanks to God. "As we stand at the close of one year and look to the promise of the next, we lift up our hearts in gratitude to God for our many blessings, for one another, and for our Nation," read his Thanksgiving Presidential Proclamation in 2010.
Regardless of whether God gets a shout-out this year, there's certain to be controversy. Some will surely cite a "wall of separation between church and state" that doesn't actually exist in the Constitution.
As Daniel Dreisbach explains in a First Principles essay, this figure of speech actually dates to a letter written by President Thomas Jefferson in 1802. In reality, the First Amendment didn't aim to protect people from ever being exposed to any religion. It only aimed to ensure that the federal government wouldn't establish a state-run church, such as the Church of England.
Dreisbach cites Jefferson's second inaugural address, when the third president declared: "In matters of religion, I have considered that its free exercise is placed by the constitution independent of the powers of the general [i.e., federal] government. I have therefore undertaken, on no occasion, to prescribe the religious exercises suited to it; but have left them, as the constitution found them, under the direction and discipline of State or Church authorities acknowledged by the several religious societies."
Although the First Amendment prevents Congress from establishing a religion or prohibiting its free exercise, presidents, as well as Congress, have always recognized the American regard for sacred practices and beliefs. Jefferson himself actively supported religious institutions. While in office, he personally approved federally funded programs that built churches and supported Christian missionaries who worked with the Indians.
This Thursday, instead of replaying our disappointments, let's focus on the great things about our exceptional nation. The American people are still self-governing citizens. Our Constitution is still the most successful constitution known to man. American churches continue to save souls and, along the way, save lives through good works, while Europe's state-supported churches struggle to fill its pews. That's worth pausing to give thanks for- this week and every week.
