Why Bother With Congress When You Make 66 Regulations a Day?  

Last week someone wrote about Sen. James Inhofe (R-OK) warning that President Obama was using regulations to kill the economy and everything good about America. Evidently, Sen. Inhofe's warning was just the tip of the iceberg.

 

I don't know if Obama was preparing to enact as much legislation as he could before possibly losing the election or what, but a new report out states that in the last 90 days, the Obama administration has posted 5,932 regulations. This amounts to a whopping 68 per day for 90 days.

 

While many of these are 'proposed' regulations, that's not to say that they won't become reality, but in all likelihood, Obama and his band of thieves will find a way to implement the vast majority of them.

US could be on path to fifth straight $1 trillion deficit after government runs $120 billion October deficit

The federal government started the 2013 budget year with a $120 billion deficit, an indication that the nation is on a path to its fifth straight $1 trillion-plus deficit.
 
Another soaring deficit puts added pressure on President Barack Obama and Congress to seek a budget deal in the coming weeks.
 
The Treasury Department said Tuesday that the October deficit -- the gap between the government's tax revenue and its spending -- was 22 percent higher than the same month last year.
 
Tax revenue increased to $184.3 billion -- 13 percent greater than the same month last year. Still, spending also rose to $304.3 billion, a 16.4 percent jump. The budget year begins on Oct. 1. Officials said last year's figures were held down by a quirk in the calendar: the first day of October fell on a Saturday, which resulted in some benefits being paid in September 2011.

Glenn Beck During his radio show on Tuesday, Glenn Beck and company finally revealed why those "Agenda 21" ads have been airing on TheBlaze TV. The host came clean and admitted that he hired a film crew to create four "Agenda 21" ads to run on his network.

 

Beck said he has been getting tons of emails from viewers threatening to cancel their subscriptions, furious that he would allow the United Nations to promote its "propaganda" on his network. Some have actually cancelled over the ads.

 

"The conspiracy theorists among us say I am part of Agenda 21 and this ad is just proof positive to some," Beck said.

Dear Friends,

We are all discouraged by the outcome of last week's election, but we must keep fighting!  We have been through this before and although the battle is long, we know that they that wait upon the Lord will renew their strength.  They will rise on wings like eagles, they will run and not walk, they will not grow weary, and don't you dare grow weary, we need you now more than ever!

 

My recent column warns about the dangers awaiting us in the Lame Duck session of Congress that begins this week.  Obama's re-election and the liberals' maintaining control of the Senate removes some of the liberals' urgency to cram through their agenda, but our Capitol Hill sources tell us that there is a strong possibility the UN Convention on the Rights of Persons with Disabilities (CRPD) will come to the Senate floor.

 

Massachusetts Senator John Kerry, who chairs the Senate Foreign Relations Committee, is lobbying hard to become Secretary of State.  He is eager to get a UN Treaty through the Senate to boost his stature, and there are many terrible Treaties to choose from, like the UN Small Arms Treaty and the Law of the Sea Treaty, but he believes that the "Disabilities Treaty" will be the easiest to pass.

Before the Senate left for recess, our conservative ally, Utah Senator Mike Lee, obtained signatures from more than 34 of his Senate colleagues asking that no treaties be brought to the Senate floor during the Lame Duck session.  The total has now risen to 36 Senators who have signed this letter.  

 

Take Action! 

 

If your Senator has signed the letter, please take a moment to thank them, and urge them to stand strong against any Treaty that might come to the Senate floor during the Lame Duck session.  If your Senators have not signed this letter, please urge them to do so, and to oppose all Treaties during the Lame Duck session.

THESE are the times that try men's souls. The summer soldier and the sunshine patriot will, in this crisis, shrink from the service of their country; but he that stands by it now, deserves the love and thanks of man and woman. Tyranny, like hell, is not easily conquered; yet we have this consolation with us, that the harder the conflict, the more glorious the triumph. What we obtain too cheap, we esteem too lightly: it is dearness only that gives every thing its value. Heaven knows how to put a proper price upon its goods; and it would be strange indeed if so celestial an article as FREEDOM should not be highly rated. Britain, with an army to enforce her tyranny, has declared that she has a right (not only to TAX) but "to BIND us in ALL CASES WHATSOEVER" and if being bound in that manner, is not slavery, then is there not such a thing as slavery upon earth. Even the expression is impious; for so unlimited a power can belong only to God.

What's Next?

These are indeed "the times that try men's souls." Paine's words still hold true, still remind us of the challenges that continue to confront us today, nearly 236 years later. It's been a week since the election and it has been for me, as I'm sure it has been for many of you, one hell of an emotional rollercoaster ride. Reflecting upon that ride, I think the emotional progression went something like this:

Shock->Depression->Rage->Determination

I felt complete shock last Tuesday night as I watched the election returns come in, expecting a Romney-Ryan 'landslide', only to realize that it was not to be. Feelings of depression were not far behind as I envisioned the end of America as the Founders intended it, as we've come to know it. Was all of our hard work over the past three years for nothing? Depression soon turned to rage. Rage at the republican establishment. Rage at those who didn't vote for Romney or who withheld their vote altogether just to send an empty message. Rage at so many of my fellow Americans. How did Romney end up with fewer votes than John McCain? Rage at myself for becoming over confident, believing the polls. Finally, from the rage rose a renewed sense of determination. I believe in this county! I believe in the founding principles! I believe in the sacrifice, for some the ultimate sacrifice, of so many who went before us and that it cannot be allowed to have been made in vain. I am determined to continue the fight for America, not only because I know it's worth fighting for, not only because I know we must secure the blessings of Liberty for future generations, but also because I know there is no other choice! Let us take inspiration from another great American patriot, Patrick Henry, who said:

"Is life so dear, or peace so sweet, as to be purchased at the price of chains and slavery? Forbid it, Almighty God! I know not what course others may take; but as for me, give me liberty or give me death!"

My friends, we have a lot of hard work ahead of us. We need to start preparing now for the 2014 elections. It is absolutely critical that we retake the Senate and widen our majority in the House if we are to minimize the damage of another Obama term and the socialist ideologies that are sure to accompany it.

Our first post-election meeting will be this Thursday night. We'll take a look at some of the election results, listen to what you all are thinking and figure out "What's Next?" together.

Daniel Greenfield's new Freedom Center pamphlet, The Great Betrayal: Obama's Wars and the War in Iraq, is an effort to understand the politics of the "war on terror" which has now reached a final punctuation point with the U.S. decision to speed its withdrawal from the battlefields of Iraq and Afghanistan (where success was once deemed so crucial to national security), and to practice an incoherent form of regime change in Libya while ignoring more serious threats in Syria and Iran.

 

The war on terror began, Greenfield shows, as an admirable bipartisan commitment soon after the tragedy of 9/11-an effort to transcend party lines not only to punish those who attacked our country but also to interrupt planning for further attacks and try to stop the international spread of the Islamic jihad behind the attacks. But the Democratic Party, with the honorable exception of a few individuals like Richard Gephardt and Joe Lieberman, turned its back on a war soon after authorizing it, and did so at a time when American troops were facing hostile enemy fire.

 

Although Senate Democrats on the intelligence oversight committee had been granted access to every piece of data available to the White House, they now accused President Bush of tricking them to secure their approval. In fact, their own about-face was entirely dictated by political considerations when a Sixties antiwar activist, Howard Dean, surged ahead in the Democratic primary polls and it appeared for a moment that Americans were on the side of retreat and capitulation.

 

Although regime change in Iraq had been official U.S. policy since Bill Clinton signed the Iraq Liberation Act of 1998, Democratic senators such as John Kerry who only months earlier had supported the war effort now launched demoralizing attacks on the American commander-in-chief and his troops in the field, stigmatizing it as "the wrong war in the wrong place at the wrong time." If the truth was the first casualty of their war against the Bush administration, the second casualty was the principle of bi-partisanship that had guided foreign policy debates throughout the Cold War, the principle that "politics stops at the water's edge." Now partisan politics trumped security.

 

The unrestrained attacks on the Iraq War as illegal and unjustified went largely unanswered by Republicans who failed to call the Democratic saboteurs of the nation's war effort to account or to decry the risk their cynical attacks posed to American servicemen and women on the battlefield. As Greenfield demonstrates, the Democrats' partisanship had consequences not only in Iraq but elsewhere in the region: the paralysis that resulted from their "anti-war" campaign led straight to the destruction of Lebanon and the installation of a terrorist army, Hezbollah, there as a regime within a regime. And it emboldened an overtly Islamofascist regime in Iran not only to supply the IEDs responsible for most of our troop fatalities in Iraq but also to proceed with a nuclear program aimed directly at Israel and the West.

 

The Great Betrayal shows that Barack Obama's abandonment of Iraq is a betrayal of all the Americans and Iraqis who gave their lives to establish freedom in that country. And the result of his policies in Afghanistan has been as disastrous. While the President presented his rationale for pursuing war there as the pursuit of al-Qaeda, after abandoning his "surge" (which resulted in two thirds of all America's Afghan casualties there and the resurgence of the Taliban allies of al-Qaeda), he blithely prepared for withdrawal as if national objectives had been met.

High School Hockey Teams Told to Dump National Anthem

Is $7.00 really too much to spend to promote patriotism to hundreds of players and fans?

According to Fox News reporter Todd Starnes, nearly 200 high school hockey teams in Pennsylvania have been advised to eliminate the National Anthem because it takes too much time to perform and costs too much money.

"We are recommending the National Anthem not be played or sung or whatever it is," Ed Sam, commissioner of the Pennsylvania Interscholastic Hockey League (PIHL) told Fox News. "It has absolutely nothing to do with patriotism at all. That's the furthest thing from the truth."

Schools were notified of the directive in an email from the PIHL. He said teams are only allotted a certain amount of time to play matches.

Sam also said it had to do with economics. He said ice time is quite expensive and the national anthem eats into the clock.

Thousands of dollars are spent on equipment, uniforms, officials and facilities for a single ice hockey game. The National Anthem takes between 1:14 and 1:32 to perform. 1. Can We Replace John Boehner With Paul Ryan?

John Boehner has been willing to throw his conference under the bus repeatedly. We know from the Bob Woodward book that he was willing to raise taxes. We know he cut a deal with Barack Obama without consulting the rest of his conference. We know it blew up in his face.

 

We know he now doesn't even want to fight Obamacare, calling it the "law of the land." We know he only walked back that statement because of the outrage that ensued.

 

We know he wants to start putting moderates into leadership positions like Cathy McMorris Rodgers instead of Tom Price. We know he is demanding conservatives "get in line".

2. On the RSC Chairman's Race

The most important vote that will happen very soon is the vote for Chairman of the Republican Study Committee, the conservative group within the House Republican Conference that often finds itself trying to pull the Republicans to the right. These past two years, it was the RSC leadership that pressed the GOP to avoid selling out to Barack Obama repeatedly, insisted the GOP keep its word on cutting spending, and held the line on "cut, cap, and balance." 3.  Rich Idiots and the Republican Gigolos

A lot of Republican donors are idiots. Right now they are licking their wounds. They got played by a bunch of Republican gigolos, largely known as "tech consultants."

 

It wasn't just Team Romney and ORCA. It happened across the Republican Party. Millionaires and billionaires shelled out huge sums of money to outside groups that promised the moon and delivered a crater instead. They became sugar daddies and got played. Heck, they didn't even get a happy ending.

 

Around the country, the rich donors of the GOP fell repeatedly into the exact same trap - they funded people who talked like them, looked like them, and thought like them. 4.  Is It Time to Roll Up the Welcome Mat Here?

Barack Obama won the election.

 

He did not win by stealing the election. Voter irregularities always happen. It is one reason we support voter ID rules. But even in the worse scenario of reports out there, there were not enough tales of voter irregularities to matter nationwide. This is another benefit and built in safeguard of the electoral college.

 

Barack Obama won. He won by turning out the most people in a well run campaign. In other words, he won fair and square. Instances of voter fraud should be taken seriously and we urge their investigation. But any instances of voter fraud would not have altered the ultimate outcome of this election.

In mid-July our staff posed the question of whether there might be a "constructive secession" by various states if Barack Obama was re-elected. Unfortunately he has been reelected and this hypothetical question has become a reality under the name of "peaceful secession." Now just a week past the election and there are already citizen groups in FIFTEEN STATES asking for a peaceful secession from the United States of America.

Where this will take us and when it might reach its climax remains to be seen, but a few things are sure: There will be no peaceful secession nor will there be secession by force of arms by any state. Nevertheless, neither of these facts preclude a "constructive secession" which would serve the ends of a "peaceful secession" perhaps even more effectively.

Military Sex Scandal Grows

Washington has been rocked by the growing scandal involving top military and intelligence officials. CIA Director General David Petraeus was scheduled to testify before congressional intelligence committees this week on the Benghazi debacle. But he resigned suddenly Friday afternoon citing an extramarital affair with his biographer, Paula Broadwell.

Washington is awash in rumors that Petraeus' departure is in fact related to Benghazi. Secretary of State Hillary Clinton is also telling associates that she wants out now.

The story doesn't end there. Over the holiday weekend, the commanding general in Afghanistan, John Allen, was ensnared as well. According to the Washington Post, the FBI has "uncovered between 20,000 and 30,000 pages of documents -- most of them e-mails -- that contain 'potentially inappropriate' communication between Allen and Jill Kelley."

Who is Jill Kelley? She was the source of the FBI's investigation into the Petraeus/Broadwell affair. Kelley knew General Petraeus and General Allen when both men were stationed at Central Command headquarters in Tampa, Florida.

But Kelley had received bizarre and threatening anonymous emails and turned them over to the FBI. In the course of its investigation, the FBI discovered that the messages were coming from Paula Broadwell, and it also discovered the emails between Kelley and Gen. Allen.

Still with me? Now the story gets really strange.

An FBI agent is currently under investigation by the Bureau's Office of Professional Responsibility for sending shirtless pictures of himself to Kelley after he reportedly became obsessed with her.

Members of Congress are furious that they were kept in the dark for so long about this investigation, which reportedly began in June. The White House insists it did not know until after the election.

But Fox News reported yesterday that Attorney General Eric Holder was informed of the investigation "in late summer" -- plenty of time to inform the White House and the heads of relevant congressional committees. Is it plausible that Holder, who is extremely close to Obama, didn't tell the president? I don't think so.

Four days before the election, the FBI concluded that there was no basis for criminal charges in the Broadwell/Petraeus affair. But the investigation appears to be far from over. Monday night FBI agents searched Broadwell's house for four hours. What a mess -- and it clearly isn't over.


The Left Digs In

Predictably, the media are demanding that the Republicans and conservatives must compromise with Barack Obama and accept the demands of the left as a result of last week's elections. But Republicans still control the House of Representatives and compromise suggests both sides will give something. Are Obama and his left-wing troops willing to compromise with House Republicans?

Consider this excerpt from today's Washington Post: "...liberal groups that campaigned aggressively for [Obama's] reelection are mobilizing to oppose concessions" on entitlement programs and welfare spending.

Here's more: "The AFL-CIO kept its field organizers active for a week after the election to lobby lawmakers against entitlement cuts, while MoveOn.org is using its e-mail list of 7 million people to mobilize."

In recent days, I have gotten a number of emails from folks saying they are done and giving up. Friends, one of the reasons we are losing is that too many on our side think there is an "election season." They engage for a month or two then disengage. The left is determined to "fundamentally transform" this country, and it fights day after day after day. It never gives up and we cannot either!


Good News / Bad News

According to a new report by the International Energy Agency, the United States is potentially on track to become the world's largest energy producer by 2020, even outproducing Saudi Arabia. That would be great news for jobs and the economy.

Now here's the bad news. The Hill reported Friday that the Obama Interior Department "issued a final plan to close 1.6 million acres of federal land in the West originally slated for oil shale development." Once again we see Obama vs. American progress!

Honor

In his book Power and Constraint, Jack Goldsmith notes that the military responded to the War in Vietnam, "which left the U.S. military at the lowest point in its history . . . with a renewed emphasis in instruction and training in military honor, ethics, and morality at West Point and other officer-training grounds." Goldsmith connects this emphasis on honor, ethics, and morality to the rise of "lawfare" - the relatively recent phenomenon of law and lawyers significantly affecting the conduct of war. And Goldsmith describes the leading role that Gen. David Petraeus played in the rise of lawfare.

Are those who enter the military from West Point and other officer-training grounds more honorable these days? I don't know. The military is more legalistic and more politically correct, but that's not the same thing.

I suspect that today's military officers behave with approximately the same amount of honor as their predecessors from the Vietnam era and before. This wouldn't be surprising. The politics of an institution sometimes changes in a generation, but human nature doesn't.

 

Let's not make an immigration deal

Our friend Ed Morrissey adds his voice to those urging Republicans to "cut a deal on immigration." He makes both a policy argument and a political one.

Ed's policy argument is that the nation shouldn't go four more years without reforming its broken immigration system:

[T]he issue of border security has been left in limbo for more than 11 years after 9/11, and more than seven years after the 9/11 Commission rightly demanded better security on both borders, and the broken visa program that offers no follow-up on expired entries. If we continue to punt rather than compromise, we will be left waiting for at least four more years to get any kind of solution.

By focusing first on policy, Ed adds to the debate, which, in conservative circles, has focused almost solely on the politics of immigration reform. However, I doubt that improving border security in relation to terrorists requires Republicans to buy Chuck Schumer's immigration reform agenda, including a path to citizenship for millions of illegal aliens (and future Democratic voters).

The Democrats cannot risk a terrorist attack that is traced back to a lapse in border security on their watch. Such an attack might well derail President Obama's second term and adversely affect his legacy. Obama, therefore, is unlikely to tolerate a heightened risk of an attack caused by poor border security.

Accordingly, if the current system is so flawed as to create an undue national security risk, Republicans hold a winning hand. The key for them is to flag this issue big-time by holding hearings in the House and, if necessary, by passing a House bill fixing just this aspect of the immigration system.

Right now, Democrats are convinced that the Republicans will cave on immigration reform, and with good reason. Indeed, they have long understood that strong elements within the Republican Party want to cave; this was clear during the Bush administration's attempt at immigration reform. If Republicans can demonstrate that they won't cave, Democrats will be unlikely to accept a heightened risk of a terrorist attack just to prove a point.

As to the political dimension, Ed argues:

[C]ontinued obstruction means that immigration reform will continue to hang around the GOP's neck like an albatross. Hard-liners argue that a Republican compromise won't convince Latinos to shift to the Republican Party, and they're correct in the short run. However, it's difficult to make the kind of free-market and family values pitches that might make some serious inroads with Latino voters when Republican candidates and activists talk about deportations - self-initiated or otherwise - of family, friends, and others within their communities. That conversation has lasted far too long, and it has caused significant damage.

But Republicans don't need to talk about deportation. There are middle ground positions between deporting illegal immigrants and providing them with a path to citizenship. To be sure, the Democrats won't accept anything short of the citizenship path. Thus, meaningful compromise is impossible.

Under these circumstances, Democrats will continue to have a significant upper hand in the quest for the Hispanic vote. But they will have one anyway, even if Republicans capitulate on citizenship.

However, by proposing a middle ground position, Republicans won't be talking about deportations. If, as Ed says, it is this talk that's standing in the way of a greater Hispanic embrace of Republican "free-market and family value pitches," the problem can be solved without capitulating to the Democrats, as Republican leaders now seem quite inclined to do.

JOHN adds: I think the immigration system should be reformed in a number of ways, so that it will better serve the interests of the United States. We should be encouraging and promoting the immigration of skilled workers from other countries, and we should not be accepting, let alone encouraging, immigration of unskilled workers, with only rare exceptions. The forgotten man in this story is the American citizen who does unskilled and semi-skilled work, and whose wages have been beaten down for many years by competition from unskilled immigrants, especially illegals. Republicans should be on the side of those unskilled and semi-skilled Americans, about whose welfare the Democrats hypocritically pretend to be concerned, not on the side of the Chamber of Commerce types who want cheap labor, and least of all on the side of non-American citizens who came here illegally.

Consistent with that approach, we should be enforcing our existing laws to protect American citizens against inherently unfair competition from illegals. It would be perverse, I think, to facilitate such competition by granting citizenship or even amnesty to existing illegals.

Where, exactly, does the clamor for "comprehensive immigration reform" come from? I don't see any existing problems that would be solved, as a matter of policy, by "comprehensive immigration reform," as opposed to more effective law enforcement, e.g. at the borders. The real motivation on both sides seems to be political: Democrats want to add millions of loyal Democratic voters, and Republicans are afraid that opposing "comprehensive reform" will cause them to lose votes with Mexican-Americans and others who are already citizens. Both sides cannot be right in their political calculations, and when it comes to political calculation, it is generally a good bet that the Democrats are the ones who have it figured out. In my opinion, the idea that the illegals who would become voters by virtue of "comprehensive reform" are Republicans in training is delusional.

So, yes, Republicans should propose immigration reforms: 1) make it easy for skilled workers to come here from every corner of the world; 2) make it difficult or impossible for unskilled workers to come here legally; and 3) tighten up border security and law enforcement. These policies will help lower-income Americans more than just about anything the federal government can do. There will still be a considerable number of illegals here for the foreseeable future, but so what? There is no need to talk about deportation, or anything else.

 

Lindsey Graham poised to sell out to Chuck Schumer on immigration reform

When the smarmiest Senate Democrat and the smarmiest Senate Republican sit down for talks on an issue of fundamental importance to the nation, and to the future of conservatism, conservatives should be very scared. When the smarmy Democrat is Chuck Schumer, a shrewd partisan, and the smarmy Republican is Lindsay Graham, a squish who gets his kicks from cooperating with Democrats, conservatives should panic.

Schumer's objectives in the negotiations are clear: to reach a deal that will enable the Democrats (1) to cement their position as the Party that dragged reluctant Republicans into a breakthrough immigration deal, thereby keeping the Dems' promise to Hispanics and (2) to cement his Party's future success by bringing millions of reliable Democratic voters into American politics.

Graham's objective is also clear. He wants to ensure his status as a star legislator who is able to broker bipartisan deals that address the nation's most important problems.

It's obvious which Party will emerge as the winner in these negotiations.

But we don't have to infer the nature of the impending deal from the character of the dealmakers. We know what a Schumer-Graham deal will look like because we've seen their plan before. As the National Journal reports, it would purport to strengthen border security and enforcement of immigration laws by toughening punishment for businesses that hire illegal workers; require fraud-proof Social Security cards to prevent hiring of workers who lack them; create a temporary worker program; and set a path to citizenship for illegal immigrants already in the country.

The only meaningful part of the upcoming Schumer-Graham deal is the path to citizenship. Employer sanctions don't work, not because the penalties are insufficient but because neither political party (the pro-illegal immigrant one or the pro-business one) has an interest in punishing businesses that hire illegals. By contrast, both parties have a strong interest in protecting the border from threats to our national security. Thus, accomplishing this objective doesn't require a grand immigration bargain.

As for the path to citizenship, it will, over time, ensure that the Republican Party ceases to exist as a conservative force. If Republicans think it's difficult to win elections now without veering to the center, wait until millions of new low income voters enter the electorate.

In fact, the injection of these voters might well sink the Republican Party altogether, since the Party's turn away from conservatism will likely give rise to a third party. Alternatively, Republicans will limp along as a "me-too" party that loses more often than it wins.

I don't doubt that such a future is okay with Lindsey Graham, who isn't much of a conservative and who regards himself as above Party. Graham's name will be on landmark legislature and he will have been at the center of an historic, bipartisan deal, and that's what matters most to him.

I would once again call Lindsey Graham the Arlen Specter of the South, but to do so now would dishonor a dead man.

The Election's Major Implications for Education

What can we expect for education policy during President Obama's second term? From No Child Left Behind (NCLB) waivers to school choice, education policy will surely heat up in the coming months.

  • No Child Left Behind Waivers. NCLB's blunt attempt to drive accountability from Washington has resulted in many schools being labeled "failing" while little is done to improve results. The Obama Administration, however, has chosen to circumvent Congress, offering waivers from selected provisions of NCLB to states that agree to adopt Administration-approved education policies.  
  • Common Core national standards. In the past, the Obama Administration has intimated that it would consider tying Title I dollars for low-income school districts to the adoption of national standards and tests. While it's unlikely we'll see such a brazen federal incentive to adopt the standards, we'll likely see the continuation of policies that tie federal funding to the adoption of "standards that are common to a significant number of states."
  • Race to the Top, federal education programs, and spending. Based on President Obama's "blueprint" for education and his fiscal year 2013 budget request, we can expect the Administration to continue its push to increase federal intervention and spending on education. We'll likely hear louder calls for federal funding to "save" education jobs, despite the fact that nationally, the student-teacher ratio is at a historic low, the number of teachers in America's schools is at a historic high, and the number of non-teaching staff positions equals that of actual teaching positions.
  • D.C. Opportunity Scholarship Program (DCOSP) funding battles. The Obama Administration has been hostile to the DCOSP, a school choice program that provides vouchers to low-income children in the nation's capital. Despite signing (at the urging of House Speaker John Boehner [R-OH] and Senator Joe Lieberman [I-CT]) a five-year reauthorization of the program last year, President Obama has attempted to zero-out funding, placing the future of the DCOSP in question.

The Threats of a Lame Duck Congress

The lame-duck session begins today, with retiring and defeated Members of Congress coming back to Washington to make their last legislative decisions. Because of the lack of accountability to voters, the lame-duck period brings heightened scrutiny.

Congress has 16 working days scheduled between now and the end of the year, though it could add more. Here are some of the contentious issues likely to be debated-and perhaps even decided-during that time.

The "fiscal cliff." Thanks to legislation previously put in place, a series of federal spending cuts and tax increases is scheduled to go into effect automatically at the beginning of the year. This is widely referred to as a "fiscal cliff"-and the economy is headed right off the cliff. The tax increases, which have been dubbed "Taxmageddon," would hit middle-class families with an average tax hike of more than $4,100 in the year 2013 alone. It is the largest tax increase ever to hit America, at nearly $500 billion in one year. The effects would be devastating to the economy, as it would hit job-creating small businesses. With the economy in the state it has been, American businesses and individuals cannot stand a tax increase.

Defense cuts. Liberals in Congress set up a plan called "sequestration" that has held the U.S. military hostage to their desire to raise taxes. The original plan was to convince other congressmen to cave to tax increases, thus preventing the cuts to defense. Now those cuts are scheduled to take effect in January, and they would deeply harm our military readiness. During the presidential foreign policy debate, President Obama declared that sequestration "will not happen." Yet he has already factored these cuts into his fiscal planning for the future-a telling sign. Heritage has suggestions that would fix the sequestration problem without raising taxes.

The debt ceiling. Sound familiar? Yes, the federal government is once more approaching its debt limit-and lawmakers will likely try to raise the limit again. Heritage maintains that the U.S. has no business raising the debt ceiling without getting spending under control.

Disaster funding. Damage from Hurricane Sandy will continue the debate over who should fund disaster recovery efforts. The resources of the Federal Emergency Management Agency (FEMA) are stretched thin after years of record-setting numbers of disaster declarations. The agency has been forced to respond to disasters on the scale of one every one-and-a-half days.

Law of the Sea Treaty or other United Nations treaties. Senator John Kerry (D-MA) had expressed the intention of bringing the Law of the Sea Treaty (LOST) up for a lame-duck vote. But a group of conservative Senators pledged before the election that they would "oppose efforts to consider a treaty during" the lame-duck session. As a rule, the United Nations treaties would give up pieces of American sovereignty in return for little to no benefits to America. LOST in particular would require the U.S. to hand over royalties from oil and gas development and create a massive international bureaucracy that Americans would be forced to fund.

Cybersecurity. Senate Majority Leader Harry Reid (D-NV) has said he wanted to bring cybersecurity legislation back to the Senate floor during lame duck. As Heritage's David Inserra explains, Reid's approach "believes that government-set standards and regulations will make the private sector improve its security. They argue that any defense, however flawed or costly, is better than nothing." At the same time, President Obama has drafted an executive order to put much of the failed legislation into effect. Neither of these would effectively help the nation's cybersecurity-"There is no way that regulations will be able to keep up with the rapidly changing threat, since it takes major regulations from two to three years to be written."

No Need to Panic  

Conservatives are, rightly, disappointed.

A president who's recklessly spent trillions, expanded government and put many of our principles and institutions at risk will enjoy a second term. But it's no time for despair. Now is the time to stand up and declare we will continue to work to rein in big government and defend freedom.

Voters gave conservatives a mandate of sorts two years ago, electing a Tea Party-supported House of Representatives to check President Obama's excesses. And it worked.

After ramming through measures including Obamacare and Dodd-Frank in his first two years, the president failed to deliver any big liberal programs after that.

In 2012, voters returned the president to the White House, yet also made him the first president since World War II re-elected without improving his margin of victory. "The bad news is that Paul Ryan remains in the House," quips Hugh Hewitt. But, "The good news is that he remains in the House, and that the rising generation of governors remains incredibly talented and innovative and they now add Mike Pence to their number."

President Obama won a clear victory in the Electoral College (that's one of the reasons it exists), but:
"Much like Truman, Obama enters a second term with no mandate to speak of, and with roughly half of the country intractably opposed to his policies," writes Jay Cost at the Weekly Standard. Obama's grand themes were Big Bird and birth control.

His campaign mostly consisted of attack ads and personal insults. He won, many say, by managing to stitch together a coalition of those seeking federal largesse.

"The Democratic Party is mostly an incoherent amalgam of interest groups, most of which are vying for benefits for themselves and their members at the expense of other Americans," notes Yuval Levin. "This kind of party is why America's founders worried about partisanship and were, at least at first, eager to avoid a party system. It is a bunch of factions more than a party."

For their part, conservatives must find ways to limit big government. For as William McGurn warned, the recent hurricane exposed its failures. "The irony is that modern American liberalism has become a movement grounded less in practical politics than a sort of religious fervor-and often requiring the same strong faith in the face of disappointment and failure. The difference, of course, is that while religions often promise to deliver in the next world, government is supposed to do it in this one."

Conservatives can make headway in this divisive atmosphere by offering the right policy proposals. The end of the campaign brings the beginning of the governing season. We have a lot of work to do. From entitlement reform to national defense and energy policy, The Heritage Foundation has developed and will continue to advocate for the solutions the country needs.

Obamacare is dragging down our already struggling economy. Our nation is far beyond just broke; our national debt is $16 trillion (a 60 percent increase under President Obama) and climbing every day. A lame duck Congress will return to Washington to try to head off Taxmageddon. The present House of Representatives must hold the line over the next two months and refuse to sign on to even more spending or higher taxes. We must stop our national binge of spending, taxing and borrowing. And we will.

Whatever the policy battles, remember this
above all, happy warriors: It's the First Principles that undergird America that make this country great. Conservatives must work harder than ever before to defend them and to see them translated into the right public policies.

Giant Rats and Tiny Men 

On the corner of the street a giant rat squats over the sidewalk, its shadow blocking the cold winter sun, while at its feet, hired men, some with heavy accents, hand out leaflets and chant, "Who are we, What do we want" in the familiar hymn of the hired union protester, not a member of a union or an employee or a shop, but just a man hired by unions to intimidate some store or company into going along.

There's another giant rat creeping its way up the Potomac through the evening fog. Its snout is the size of a skyscraper and its shadow is the night. And there are hordes of smaller rats inside that rat and smaller rats inside it that come spilling out. Call it the Trojan Rat or the Great Rat of the Potomac. Or just call it Washington D.C.

In the year of the rat, the election came down to a whole bunch of men and women loudly chanting, "Who do we are, What do we want." The Democrats had clear answers to both questions. They wanted the rat. They wanted to be rats. They wanted to be the last rats on the sinking ship of state.

That was the hysterical frenzy of the Democratic National Convention in a nutshell. It was the pied piper calling forth all the rats by name and teaching them to march around when the pan pipes played. And the pipes played, the rats went to the polls, they voted, once, twice, three times and then waited around for their cheese.

And who were the Republicans? What did they want?

Supporters of traditional marriage lost big on Election Day, with four states redefining marriage to include same-sex couples. Marriage defenders acknowledge they have serious work to do on several fronts going forward, even as the nation must now begin to consider the question of polygamy.

Washington State and Maine redefined marriage in their states to include two-man and two-woman couples. In Maryland the legislature recently did so with a new statute that was signed into law by Governor Martin O'Malley, a Democrat weighing a presidential run in 2016, and a statewide ballot measure to overturn that law narrowly failed. And in Minnesota, a proposed state constitutional amendment to reaffirm marriage as one man and one woman narrowly failed to pass.

Supreme Court to Hear Constitutional Challenge to Voting Rights Act

Early next year, the Supreme Court will hear arguments on a constitutional challenge to one of the most powerful provisions in federal law, Section 5 of the Voting Rights Act of 1965, in the case Shelby County v. Holder.

 

The Voting Rights Act (VRA) was passed by Congress and signed into law by President Lyndon B. Johnson in 1965. It gives force to the Fifteenth Amendment of the U.S. Constitution, which forbids voting rights from being abridged on account of race or color. Whenever any unit of government violates voting rights, that government can be sued under VRA Section 2.

Why the Single-Issue Campaign Failed

Maybe not. Mired in the worst recovery since the Great Depression, with unemployment near 8 percent, companies laying off workers over Obamacare, a $16 trillion debt and gasoline at double the 2008 price, America still re-elected Barack Obama.

Mitt Romney ran a single-issue campaign: the economy, stupid.

The missed opportunities were endless. After CNN's Candy Crowley silenced him in the second debate over the attack in Benghazi, Libya, Mr. Romney declined to expose Mr. Obama's shocking lies and transparent cover-up. He also declined to educate Americans about the administration's brazen lawlessness, especially that of the Justice Department, the Environmental Protection Agency and the National Labor Relations Board.

The Fiscal Cliff and America's Coming Recession

Since the end of World War II two thirds of a century ago, federal spending has been stable at around 20% of GDP. America prospered to become the mightiest economic power in the history of the world with the federal government limited to that level of spending.

But President Obama is certain he has a better idea. He wants higher taxes and higher federal spending. Only with that can he "spread the wealth around." He believes that would make the economy grow faster "from the middle class out," as the middle class and the poor spend the money "the rich" were wasting in savings and investment.

The American people lost literally trillions in the financial crisis, in home values, in stock values, and in lost jobs and wages. Obama had a narrative as to what caused the financial crisis. It was Bush's, and maybe even Reagan's, tax cuts, and Republican deregulation. And the argument that won the election for Obama in my opinion was that Romney just wanted to go back to the same policies that caused the financial crisis (the mess we are in) in the first place.

Unless they've been living under a rock, most Americans have heard that the Supreme Court decided a constitutional challenge to Obamacare's infamous Individual Mandate in NFIB v. Sebelius. Plenty of Americans are unaware, however, that out of over 30 cases challenging the Mandate, NFIB was only one of five challenges that were considered serious and credible.
