Trucking Industry Awaiting Court Rulings Over Legality of Banning Felons as Drivers

Attorneys who specialize in trucking issues are closely watching how courts interpret guidance issued by the U.S. Equal Employment Opportunity Commission that could make motor carriers with blanket bans on hiring convicted felons subject to allegations of discriminatory hiring.
The EEOC guidance said that while employers are permitted to check the criminal backgrounds of applicants, they should develop a "targeted approach" in considering whether the offenses of applicants formerly convicted of crimes are relevant to the job for which they are being considered.
"This new approach can result, in the motor carrier's case, in harm to the public by requiring carriers to put individuals with elevated risks behind the wheel," said Prasad Sharma, senior vice president and general counsel for the American Trucking Associations.

TanTara Transportation Corp. Uses Hawkeye Football Trucks to Aid Oklahoma Relief Efforts
The semi-trailers that haul the University of Iowa football team's equipment to each road venue took on a much larger role for the people in tornado-stricken Oklahoma. Mike Riggan, the president of TanTara Transportation Corporation from Muscatine, Iowa, and the designer/driver of the Hawkeye football semis, led the efforts in collecting food and other goods to assist the areas affected by the tornadoes in Oklahoma. The items were delivered to a Food Bank Monday, where members of the Oklahoma football team offered their assistance.

Mixing Medium and Heavy Duty Crash Data
A new study of large truck crash data shows that the number of crashes involving smaller commercial vehicles and intrastate motor carriers is increasing at a faster rate than crashes involving larger trucks and interstate motor carriers. An American Transportation Research Institute analysis found that from 2000 to 2010, Classes 3-6 medium-duty trucks -- which weigh between 10,001 and 26,000 pounds, typically operate in urban areas and do not require commercial licenses to operate -- saw an increase of 38.3 percent in their crash rate index.

Some drivers spend a considerable amount of time performing a good pre-trip and post-trip inspection. Many do not. The result of their efforts can make or break a good company maintenance program, and change the outcome of a roadside inspection. Drivers are often stopped at scales or roadside inspections and it's then that they find out that lights aren't working, brakes are out of adjustment, there is a flat tire on the truck, or other problems. The Iowa Motor Truck Association, along with several other agencies, is working on a campaign to highlight the dangers of distracted driving. In polling a group of professional truck drivers employed by IMTA members, the No. 1 one complaint by this group was the increase in distracted drivers on the road. Obviously, cell phone use and texting is one of the biggest dangers on the road, but these drivers were also very quick to point out that eating while you are driving, putting on makeup or fiddling with the radio are also big distractions. Q: Are the proposed Hours of Service rule changes still going into effect on July 1, 2013?
A: Yes. The changes to provisions regarding rest breaks and the new 34-hour restart are still on track to take effect the first of next month. No decisions have been rendered from the court hearings held back in March to overturn the new rules. Please reference the Summary of HOS Changes that is posted to the IMTA Web site to verify your operation is prepared for the July 1, 2013, compliance date.
