Update on the UFAA vs. Farmers Lawsuit

As you surely already know, in December of 2012 UFAA filed a Declaratory Relief Action again Injustice scales B st Farmers. (referred to as the AGM DRA) The suit challenges FGI's improper violations of the contract with agents, its pattern of sharing agents' data with 21st Century Insurance, and its unconscionable practice of terminating lifetime agency owners on ninety days' notice or less. In an email sent to the Agency Force the first week of December we stated that there was a deposition scheduled in December. That deposition was rescheduled for January and has once again been postponed by Farmers.

As this essential lawsuit moves through the court system UFAA, its members and supporters must stand strong and continue to fight the good fight. Will you stand up and help protect your livelihood and your future by supporting this important effort?

If you would like to donate to the UFAA AGM DRA Fund, or UFAA's General Legal Fund, you may do so by filling out the attached form.

UFAA wishes to thank all agents for any support they have given to the only organization created to support Farmers Agents. We are an association of "Agents Helping AgentsŪ".

TAKE the Hint Farmers
Now, these are realistic rate increases that insureds can understand. Progressive is learning.

Northbrook-based Allstate says in a regulatory filing that rates for customers will climb between 2.5 and 3.5 percent later this month.

Esurance rates are rising about 3.2 percent in late January, while Geico expects to boost prices by 2 to 3 percent in March.

American Family Mutual Insurance Co. expects to boost rates about 2 percent in February.

Progressive will lower rates by 1 percent, although the decrease comes after the insurer hiked rates by 11 percent almost two years ago.

Bloomington-based State Farm Insurance says rates will hold steady. It raised rates 3 to 4 percent in September.

State Farm is Illinois' largest insurer, followed by Allstate.

Echoes from the Agency Force

Hi, Just got a call from a client who said they had received a letter from Farmers stating that I was retiring and telling them they have been assigned to someone else!

Well, thisgraphic moving upset is news to me!

So, of course, I called my district, the "policy transfer specialist", who said yes, this happened about a month ago. when asked how widespread the problem is, she replied "nationwide". When I asked what Farmers is doing about this, she said they are researching it. She said no notification has been given to the agency force and the district office had picked up on it strictly due to calls they are getting from clients! How can this not be a taking of business? Where is Farmers' at in this?

Farmers Dumps the Community Page on Dashboard as being Negative
In the last few issues of the Oklahoma Voice, we have ran excerpts on agent comments posted on the Community Page. Subjects were across the board from 57% increase in Farmers/Aetna medical premiums to rate increases. Concerning rate increases and PIF runoff, according to the Community Page on Dashboard, agents were livid over these issues and has been viewed by the highest number of agents under the most  appropriate subject of "Enough is Enough."
The agents were recently advised by Farmers - "Unfortunately, the tool is now being used as a forum for several agents to create feelings of negativity and disengagement. The public nature of this forum makes it difficult for leadership to effectively address the root cause of the comments or issues raised, and many of our leading agents have asked us to find an alternative to this forum, as these perspectives are not shared by the majority and viewed by many as offensive."

Agents were asking for management to respond to their concerns and management did just that by turning off the community page on Dashboard and remaining silent. "However,
"If it is an urgent matter, you also have the option of contacting your zone officer: Todd Brooks is Head of Distribution for the Central Zone.  The Central Zone is comprised of the states of Alabama, Arkansas, Colorado, Illinois, Indiana, Iowa, Kansas, Michigan, Minnesota, Missouri, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Dakota, Tennessee, Texas, Utah, Virginia, Wisconsin, and Wyoming." Zurich Insurance Group Faces Suspension of Business Operations in Florida Over Non-payment of Outstanding Attorneys' Fees and Costs

WEST PALM BEACH, Fla., Jan. 27, 2014 /PRNewswire/ -- South Florida law firm Searcy Denney Scarola Barnhart & Shipley, PA (Searcy Denney) announced that, on behalf of its client FalconTrust Group, Inc., a suit has been filed directing the Florida Office of Insurance Regulation (OIR) to revoke certificates of authority issued to Zurich U.S. and related entities unless Zurich adequately responds within 20 days of the date of service. According to the ruling issued on January 6, 2014 by Florida's 2nd.

Judicial Circuit Court in Leon County, Zurich must show good cause why, pursuant to state statutory mandates, the Court should not issue a Writ of Mandamus directing the OIR to revoke Zurich's current licenses, and to not issue new certificates of authority. At issue is Zurich's continuing failure to pay the legal fees and expenses in a related case in which Zurich was found to have breached a multi-million dollar commission agreement with FalconTrust.  Read more here

What Consumer Credit Data Reveals
About Auto Insurance Shoppers
The study includes 430 million auto insurance shopping TransUnion transactions from 2009 to 2013 who shop online as well as in-person transactions for which TransUnion receives a request for an insurance score on a new auto insurance policy.

1. Customers with lower credit-based insurance scores shop most frequently while consumers with the highest insurance scores are less likely than the general population to shop for new auto insurance.
2. The data show that younger people tend to shop for auto insurance more frequently, and auto insurance shopping peaks at age 25 for both men and women.
3. Younger women (ages 25-40) are more active auto insurance shoppers than younger men, but that trend reverses at mid-life. After age 40, the percentage of women who shop for new policies declines, while the shopping rate among men stays relatively stable.
4. While auto insurance shoppers tend to be younger, those who are in the process of, or have recently changed their place of residence also tend to be heavy shoppers. Compared to non-movers, consumers who move residences are 200 percent more likely to shop for auto insurance before their move; 130 percent more likely during the month of their move; and 60 percent more likely one month after the move.
5. More than a billion dollars are spent each year on auto insurance advertising, most of which urges consumers to switch their policies to another carrier.
6. The rates of shopping for auto insurance are down about 4 percent in the 12 months ending June 2013 relative to the full year of 2012 and down about 7 percent relative to a year earlier. While 15.1 percent of the credit-active population shopped for new auto insurance policies in the 12 months ending June 2013, this was down from 15.7 percent for the full 2012 year and 16.2 percent for the twelve months ending June 2012.
Comment: "In the competitive auto insurance market, data and analytics can mean the difference between winning and losing, as a result of low retention and adverse selection," said Mark McElroy, executive vice president of TransUnion's insurance business unit.

Other findings by TransUnion:

  • Consumers who shop for insurance and receive a quote are three times more likely to shop again the following year than policyholders who did not receive a quote.
  • More than half (55 percent) of policyholders who shop receive two or more quotes in an annual period.
  • On average, auto insurance shoppers solicit two quotes (2.04); nearly half (45 percent) of auto insurance shoppers solicit only one quote.

Insurance Industry Trends for Agencies to Exploit in 2014

In order to be a step ahead of the competition it is best to be proactive. One can do this by understanding and exploiting current and future trends. It is easy to predict trends by understanding recurring cycles and applying that knowledge to the current insurance marketplace.

So let's determine what 2014 will most likely be like for insurance agents, brokers and wholesalers.  Read more from the Insurance Journal of 01.27.2014

Newest computer attacks referred to as watering hole attacks. How to avoid it.

On April 8, Windows XP's life is coming to an end. On that day, Microsoft will stop issuing security updates to the 12-year-old operating system, and it will end nearly all technical support as well.

You wouldn't think that killing off an operating system that debuted in the first year of the Bush administration would ruffle too many feathers. But an amazing 29% of computers across the globe are still running Windows XP, according to NetMarketShare. That makes it the world's second most widely used operating system, just behind Windows 7.

Microsoft's (MSFT, Fortune 500) plan to end support for XP doesn't mean that a third of the world's PCs will just stop functioning on April 8. But there are some very real consequences of continuing to use the operating system.Thousands of ATMs will be affected or become infected. Read the rest here

Joke
The policeman couldn't believe his eyes when he saw a woman drive past him on the freeway, busily knitting. Quickly he pulled alongside the vehicle, rolled down his window, and shouted, "Pull over!" "No," the women yelled back cheerfully. "Socks!"

An officer pulls over a woman using hand signals to turn left. But she never makes a left turn. The female driver explains to the officer that she was just drying her nails.
