The state of Texas and Farmers Insurance want to settle decade-old claims of overcharging and under serving customers for 117.5 million dollars, which would be one of the largest insurance settlements in state history but less than what some people wanted.
A proposal filed in Travis County district court is expected to be reviewed by a judge in January, The Dallas Morning News reported.
If it's approved, Farmers would pay out the money in refunds and credits to Texas policyholders between 2000 and 2003. The agreement has the approval of both state insurance officials and Farmers executives.
"It's been a long time coming and we are looking forward to helping Texas policyholders get the refunds they deserve," Insurance Commissioner Julia Rathgeber said.
The deal is nearly identical to an agreement reached in 2003, which was held up by a group of Farmers customers who said it wasn't enough.
"It was a sweetheart deal for Farmers 10 years ago, and it is still a sweetheart deal today," said Alex Winslow, of the consumer organization Texas Watch. "It appears that the commissioner and attorney general are just rubber-stamping a bad deal for consumers."
The Texas Department of Insurance had accused Farmers of overcharging customers and cutting coverage in the wake of spiraling claims of mold in homes statewide. The state said some customers didn't get discounts they were supposed to receive, and others paid more for auto and home insurance because Farmers looked at inaccurate credit reports.
Farmers would counter sue. A decade later, it will admit no wrongdoing as part of the settlement, and it will not pay any interest on the money paid to customers.
"Closure of this case has been delayed since 2003 due to appeals filed by a small number of plaintiffs," Farmers spokesman Mark Toohey told the newspaper. "Since the settlement agreement was first announced in this case more than 10 years ago, Farmers Insurance has been and continues to be strongly committed to its finalization." Farmers is the third-largest insurer of homes in Texas.

 AGENT PIF Losses Top 1 Million Through Sept 30, 2013
In the October, 2013 Oklahoma Voice, we reported 664,000 Autos, Homes & Businesses Evaporated from Farmers Agencies in the first 6 months of 2013 (Jan1-Jun30). That's a loss of 110,066 PIF from agencies per month over and above policies written in the same period. Agents wrote 64,000 Specialty policies or 10,066 monthly only slightly helping to offset the PIF drain. However, In the 3rd quarter 2013 (Jul-Sep) PIF drop increased to 111k monthly while there was only a 1k PIF gain in Specialty. <<What's going on here?
As we have stated before, gains in Specialty tends to skew the real PIF loss figures. So, rather than the total PIF loss being 982k, as shown in the Zurich Graph below, we back out the +65k in specialty to reveal the real loss figures for Auto, Home and Business of 1,047,000 in the first 9 months. If that trend continues the loss will nudge 1.4 Million by the end of the 4th Quarter on Dec 31st.
With an increase in seasoned agents bailing out of Farmers, we loosely estimate 10,000 agents with a guessing avg of 2.1 PIF per H/H. That would equate to agents losing 105 PIF or 49 households over a 9 month period, again, over and above PIF written during the period.
According to the Community Page on Dashboard, agents are livid over this issue and has been viewed by the highest number of agents under the most appropriate subject of "Enough is Enough." Take a look at it, as there are some great comments. Remember, the graph below is based on thousands of PIF so, millions appear before the comma and thousands follow the comma.

Farmers Agents to Market 21st Century Products 4th Qtr. 2013??
The 2012 Okla. Insurance Dept. Annual Report shows company GWP in Oklahoma for the year of 2011. According to that report, 21st Century had 10 companies licensed in Oklahoma in 2011. Five appear nearly or totally unprofitable and three have are no activity leaving two companies with $4.1M in 2011 profitable income.

According to the OID, Foremost has filed several changes to place Farmers paper on their policies sold by Farmers Exclusive Agents. 21st did file auto rate changes in their Centennial company of +6.6% in 09/2013 and +11.0% in 03/2013, +2.2% in their Pacific company effective last Sept. 21st C Assurance Co. filed for the FA2 Direct Private Passenger Auto Program auto changes with a rate effect on 08/2013 of +6.0% +273,292.00 It would appear Okla Farmers Agts will sell the 21 C Assurance Co. with the FA2 change. J.D. Power Releases 2013 Auto Claims Satisfaction Study 10/31/2013 Of the 25 insurance companies included in the claims study, 13 experienced an overall satisfaction improvement since 2012. The top 10 include: - 1. Auto Club of Southern California Insurance Group (889)

Claimant satisfaction directly correlates with advocacy and loyalty. The study showed that of respondents who were "delighted" (scored 900 or higher), 80 percent "definitely" would renew their current insurer, while 79 percent of those customers "definitely" would recommend their insurer to others. However, for claimants who were "pleased" (scores of 750-899), only 53 percent would "definitely" renew and likelihood of recommendation drops to 45 percent.

All resident agents/producers, CSRs and adjusters are required to complete continuing education biennial. The requirements are as follows: Resident Producers (Excluding Title producers) are required to have 24 hours of continuing education, including three hours ethics and two hours of legislative updates. - Producers that sell, solicit, or negotiate Medicare Advantage or Part D Products or Plans are required to take a 4 hour Medicare Renewal course each renewal period.
- Producers that sell, solicit or negotiate Long Term Care insurance must take a 4 hour Long Term Care Partnership course each renewal period after the initial 8 hour Long Term Care Partnership course was taken.
- Producers that sell, solicit, or negotiate Annuity products are required to take a one time 4 hour course on Annuity products.
CSRs are required to have 13 hours of continuing education, including three hours of ethics and two hours of legislative updates. Farmers Hikes E&O Rates for 2014
Agents can expect an E&O rate increase effective 01/01/2014 for the third year in a row under the Farmers E&O Program.
Farmers waiting until the last possible moment (they normally file 08/1) but they filed for an average 9.4% rate increase across the group. This means in the last 3 years, the Farmers sponsored E&O plan has increased its rates nearly 18% (17.95%). Farmers did not file for any coverage enhancements, only a rate increase. Zurich Insurance Reports Profit Rebound
In an article titled above on Nov. 15, 2013, the Insurance Journal reported: Zurich is scheduled to give an update on its current three- year targets on Dec. 5. Those targets include improving the combined ratio, a measure of profitability, by as much as 4 percentage points in general insurance relative to competitors including Germany's Allianz SE by the end of 2013, and increasing the market share of its Farmers business. Beware of the "Inequities Agreement"
The Inequities Agreement has been around for decades. It's a company form that is required to be signed by the buyer upon the sale of an agency from another. In the past, it's only been used in family sales based on previous AAA contracts that only allowed an agent to sell to family members.
But, we are in a new era where agents can sell to another person, approved by the companies. One would believe that a current Farmers Agent could purchase a Farmers Agency without problems. And, that may be true. But, in a recent 2009 Oklahoma case of Bilby vs. Farmers where the agent son was selling his agency to his agent dad, the sale was completed and all was well for a several weeks until the dad's agency phone rang.
The company said there was one more form needed signed to complete the family sale and they faxed it to the purchasing (DAD) agent for signature. The form was in legal-ease and difficult to understand.
Per the Inequities Agreement, the purchasing agent would receive (full commissions) on the purchased policies, however, the policies would not accrue to the contract value of the purchasing agent for
5 (five) years. Now, the purchasing agent DAD buying the agency (from the selling son) was 75 years old. The dad was planning on retiring and cashing in his contract value for retirement, including the purchased policies from the son as part of that contract value. This spurred the lawsuit.
When this was brought to the attention of the judge, she stood up from the bench demanding from the company's lawyer, "Who owns the purchased policies in the event the DAD dies or becomes disabled within that 5 year period and has to sell out"? The attorney sheepishly replied, "The Companies!" "Not in my court" stated the judge."This form is null and void and the sale is completed, as previously stated by the companies, without limitations. I find for the plaintiff Bilby on this issue. Court dismissed!"
Let this be a lesson. If their is no IMMEDIATE contract value, or retirement value in you purchasing another agents business, let that send up the red flags. In the past, this form has been presented for signature to the purchasing agency weeks or even months after an approved sale is allegedly completed. It's a permission form to give the companies a right to reclaim your purchased business income property, within a stated period, without payment. That is, If the purchasing agent ceases his/her farmers agency for any or all reasons while the contract value delay period still is in effect. It also contains other limitations during the delay period, such as not counting purchased policies in calculations of a contract value bonus and qualifications of contests and company trips. Today, that agreement may be incorporated in the companies sale contract, or an addendum and may have a completely new name, if it even still exists in any form.
A lawyer is REQUIRED for a Farmers Agency purchase transaction by the buyer and perhaps, even the seller. Period! In God we trust. With Farmers, we must get a legal opinion!

As we [the OID] work to help you comply, we will vigorously enforce 59 O.S. § 1310 (A) (21) which relates to failure to notify of change of address. ADDRESS CHANGE:
Okla Ins Dept: Change of address or name more than 30 days after the change occurred shall be no less than a $100 fine. The Oklahoma Insurance Department encourages all licensees to update their mailing personal and business addresses and email addresses as often as possible. Law enforcement officers in Oklahoma will soon have the option to seize license plates from uninsured drivers and assign temporary insurance under a new law passed this year by the Legislature. The law went into effect Nov. 1 allowing the seizure, but the Oklahoma Insurance Department said agencies won't implement the changes until January as procedures are established. "This is an innovative approach," state Insurance Commissioner John Doak said. "It gives that law enforcement official, whether they be in rural Oklahoma or a metro area, a chance to make that decision" to seize the license plate instead of towing the vehicle, as allowed under a 2010 amendment. "The ability to have both as an option will be a good thing," said Maj. Shannon Clark of the Tulsa County Sheriff's Office. Under the law, temporary liability insurance can be assigned when a citation is issued for failure to comply with the compulsory insurance law. The Oklahoma Insurance Department estimates that about 563,700 vehicles are uninsured in the state, the Tulsa World reported Tuesday. The January enforcement date will allow the state time to establish the plan and coordinate training efforts with organizations such as the Oklahoma Sheriffs Association, the plan administrator. The Oklahoma Sheriffs Association will also be responsible for receiving and disbursing a 125 dollar administrative fee incurred by a driver when a license plate is seized. Portions of the fee will go to the county sheriff's office, the law enforcement agency that issued the citation, the temporary insurance premium pool and the plan administrator.
