Farmers to pay Taos agent millions after verdict.

A jury in Santa Fe, NM awarded $3 million to a local former Farmers Insurance Agent after a two-year legal battle against the company.
Craig Beaudry, who owns Beaudry Insurance in Taos, filed suit against Farmers Group, Inc., in Santa Fe District Court on February 22, 2011 after the insurance company terminated the agent's contract.
The civil complaint was filed three weeks after the plaintiff argued Farmers arbitrarily sought to sever ties with his Taos-based agency.
"They took away the business I had built for 12 years," Beaudry told The Taos News, Tuesday (May 14). "I had no recourse to defend myself. Farmers closed the door and said it was over."
Four Farmers executives and agents were included in the lawsuit for breach of contract.
The case culminated in a six-day jury trial in Santa Fe during which the plaintiff's attorneys, Pierre Levy and Barry Green, argued against the company's contention that it had the right to terminate its contract at will.
Citing a legal statute known as prima facie tort, Beaudry's attorneys argued Farmers sought to hurt his business in terminating their contract with thirty days notice. "I was hired to do a job, I did it very well. I was a leading agent for them in the state," Beaudry said, adding that he was still not entirely clear as to why Farmers sought to sever ties with his agency. "I still do not understand why they changed horses."
Seeking several million dollars in damages, the plaintiff's attorneys called expert witnesses to testify on the financial losses Beaudry claimed to have suffered as a result of Farmers terminating his contract.
The jury deliberated for about nine hours over the course of two days before reaching a verdict in Beaudry's favor.
The defendants [Farmers] were ordered to pay $1 million in compensatory damages and $2 million in punitive damages. Though the award was less than what he had originally sought, Beaudry said the verdict was a relief. "I felt like we had a scarlet letter on us for several years," he said.
The attorney representing the defense declined to comment on the case but the opportunity to file an appeal remains open.

Josef Ackermann, chairman [of the board] of Zurich Insurance Group AG, said he was stepping down after members of Chief Financial Officer Pierre Wauthier's family accused him of sharing responsibility for the death.
Zurich to look at 'undue pressure' on CFO: Zurich's acting chairman, Tom de Swaan, said Friday that the company's board would look into the possibility of "undue pressure" placed upon Pierre Wauthier, who was found dead Monday and left a note describing his dealings with former chairman Josef Ackermann. Swiss newspaper Tages-Anzeiger of Zurich also reported there was disagreement between Ackermann and Wauthier over how the company's financial results should be presented in its reporting to investors

Farmers Launches New Corporate Logo

Farmers Insurance has unveiled a new corporate logo as part of the company's next "evolutionary step," the Los Angeles-based carrier announced on Wednesday.
New York City based-Lippincott is the creative partner on the new Farmers logo. Lippincott is the firm behind a number of brands, including 3M, eBay, Infiniti, Samsung, Starbucks and Walmart. The firm was also behind the Campbell's soup can, the Coca-Cola label and the Chrysler brand.
In developing its new logo, Farmers relied upon its first logo designed in 1928, when the company was founded. That logo included the sparkle of a sunrise, the warmth of which the company said represented the optimism of a new day. Roughly 30 years later a shield image was added.
Although it still has the sunrise and shield elements, the latest logo is intended to connect the 85-year-old company's rich past with its promising future.
"Our new logo is meant to be evolutionary rather than revolutionary," Mike Linton, chief marketing officer for Farmers said in a statement. "We are really proud of our logo, but it is time to hit the refresh button. To distinguish yourself in today's saturated insurance marketplace, it's critical that our logo stands out on television, the Web, mobile devices and other media - considerations no one could have imagined in the 1950s when the Farmers logo was last updated."
The sunrise and shield represented an organization that safeguarded its customers, while the new logo "captures our belief that by helping customers make more informed insurance decisions, we can provide them with greater knowledge, confidence and security," Linton said.
He added, "The new logo is part of the Farmers transformation to an organization that not only serves our customers better, but also helps empower them."
The logo is also in keeping with Farmers current "We Believe in Smart" advertising campaign, the company said.

Zurich Relocating ChicagoOffice to Greener Work Environment07.31.2013 IJ
Zurich North America will relocate its Chicago office to a LEED-certified building in a location that accommodates its downtown-based employees, the company announced on Wednesday.
Its new Chicago office space at 300 South Riverside Plaza on the 20th and 21st floors aligns to Zurich's corporate responsibility strategy by contributing to the insurer's worldwide goal of reducing its global carbon footprint, the company stated.
Zurich has already begun remodeling its new Chicago office space. The move will take place during the second quarter of 2014.

Zurich announced it would add 150 employees to its Chicago office over the next three years, raising its total Chicago employee base to 500 insurance and risk management professionals by 2015.
Accommodating that larger workforce was another reason for Zurich's decision to relocate from 10 South Riverside Plaza, the company stated.
"Having a strong presence in the City of Chicago, as well as our North American headquarters in Schaumburg, Ill., underscores our continued commitment to growth and partnership in Chicagoland," Mike Foley, CEO of Zurich North America Commercial, said in a statement.
Zurich's ties to Chicago include insuring the construction for the first section of the Chicago Subway in 1930 and insuring the 1933 World's Fair in Chicago. It's also where Zurich chose to open its first U.S. headquarters in 1912 in the Chicago Loop's then-tallest skyscraper - the Insurance Exchange Building. In 1980, Zurich moved its North American headquarters to Schaumburg, Ill. Zurich employs roughly 2,500 people at its Schaumburg headquarters.

Farmers Insurance Moving Headquarters to Valley

Farmers Insurance Group is moving its headquarters to the San Fernando Valley, the company said Tuesday.
The Los Angeles firm will be putting its landmark Park Mile headquarters on the market and begin shifting the 1,400 employees that work there to the company's Warner Center offices at 6301-6303 Owensmouth Ave.

"We were looking at having to do some expensive and time-consuming renovations to be able to stay in (the Wilshire location)," said Erin Freeman, a spokeswoman for Farmers. "We decided it would be better to move into a newer, more modern location."
The renovations would have included a seismic retrofit of the Wilshire Boulevard building, which was constructed in 1937. Farmers, founded in 1928, is now owned by Zurich Financial Services Group of Switzerland.
Farmers moved into the Valley buildings in 2011 as part of a consolidation of its Simi Valley location and the offices of 21st Century Insurance, which it acquired in 2009 for $1.9 billion. The campus has since been renamed Farmers Plaza.
The company inked a lease for the 274,000 square feet it currently occupies through 2027, according to Freeman. Terms of the deal were not disclosed.
As the leases of other existing tenants expire, Farmers plans to take those spaces, eventually occupying all of the 540,000-square-foot campus. That full transition could take five years to complete.
While the earlier Farmers real estate consolidation resulted in the loss of nearly 600 jobs, the company is not anticipating any job losses with the current move. Local officials welcomed the news.
"More people working in the Valley means a more robust economy," said Rep. Brad Sherman, D-Van Nuys, in a statement.

Court of Appeal Affirms Summary Judgment in Favor of Farmers Insurance on Independent Contract Issue
On July 11, 2013, the Second Appellate District in Beaumont-Jacques v. Farmers Group Inc.concluded as a matter of law that a worker's ability to exercise meaningful discretion in her job-related efforts rendered her an independent contractor, regardless of Farmers' input regarding the "quality and direction of her efforts." The court held that Farmers did not exercise the "control of the details" of the appellant worker's efforts necessary to create an employer/ employee relationship. As discussed below, the court held that the key consideration was the right to control the manner and means of how the worker performed her duties. The court further held that summary judgment was proper notwithstanding that some of the minor elements of the independent contractor test arguably supported an employer/employee relationship. Oklahoma Insurance Claims from May Tornadoes Top $1 Billion
Zurich/Farmers estimated losses @ $138 million or 13.8% of losses
Insurance payments from the May tornado outbreak across central Oklahoma have now topped $1 billion, state insurance regulators report.
"These numbers are staggering," said Oklahoma Insurance Commissioner John D. Doak. "We've topped $1 billion in payments and the rebuilding is just beginning. We expected to see these amounts and they continue to go up every week. This is a major catastrophe that's impacted thousands of Oklahomans. Some survivors are still dealing with insurance and rebuilding issues. We can't fix everything overnight, but we will be here for them until the last claim is paid."
Oklahomans have filed nearly 91,000 claims since May 19, but some are still dealing with unresolved insurance claims, which is not uncommon three to four months after a large-scale disaster.

Tornado trouble: the aftermath of May's tornadoes in Oklahoma - Zurich Insurance Group is expecting losses of some $138 million as a result of the damage caused by the tornadoes.
Stung by catastrophe losses, Zurich Insurance Group Ltd. on Thursday reported net income of $789 million for the second quarter of 2013, a 27.6% decrease from the company's profits in the same period a year ago. On six-month basis, net income fell 16.9% to $1.85 billion, while gross written premiums rose 3.2% to $19.8 billion.
The Zurich-based insurer's combined ratio for the first six months of 2013 was 95.6%, compared with 94.8% during the same period a year ago. "We delivered these results in a period characterized by natural catastrophes and large weather-related events, including severe flooding in Eastern and Central Europe, tornadoes in Oklahoma as well an unusual number of midsized, weather-related events in the U.S., Canada and Europe," Zurich CEO Martin Senn said in a statement. "The economic environment remains challenging with continued low interest rates exerting pressure on our investment income."

All resident agents/producers, CSRs and adjusters are required to complete continuing education biennially. The requirements are as follows:
Resident Producers (Excluding Title producers) are required to have 24 hours of continuing education, including three hours ethics and two hours of legislative updates.
Producers that sell, solicit, or negotiate Medicare Advantage or Part D Products or Plans are required to take a 4 hour Medicare Renewal course each renewal period.
Producers that sell, solicit or negotiate Long Term Care insurance must take a 4 hour Long Term Care Partnership course each renewal period after the initial 8 hour Long Term Care Partnership course was taken.
Producers that sell, solicit, or negotiate Annuity products are required to take a one time 4 hour course on Annuity products.

60% of Direct Buyers Eventually Return to Independent Agents Hanover Study August 6, 2013
Most customers who are lured away from independent agents by direct insurers promising lower prices will ultimately return to an independent agent.
According to a recent study commissioned by The Hanover Insurance Group, nearly 60 percent of consumers who had purchased insurance through a direct channel 10 or more years ago reported switching back to an independent agent because they wanted more value.
This study was conducted for Hanover, an independent agency company, by the research firm InsightExpress, which surveyed 1,000 consumers who purchased insurance through direct channels 10 or more years ago.
Most consumers who switched back to independent agents cited expertise and convenience for their decision. According to the survey, the motivators for consumers who switched to work with independent agents also included the benefits of having one point of contact to handle insurance needs and questions and having the guidance of an experienced personal insurance professional.
"This research demonstrates that consumers really value the advice provided by independent agents and the personal relationships they build with their customers," said Mark R. Desrochers, president, personal lines insurance at The Hanover. "The majority of respondents said their number one reason for switching from a direct insurance provider was to have someone to guide them through their insurance buying decisions. Clearly trust and expertise are important to consumers."
"The study shows that consumers realize the value that independent agents bring. That's why we deliver our products exclusively through agents who are 'the value creating channel,'" said Dick Lavey, president of field operations and chief marketing officer at The Hanover.
Humana sues Farmers over Medicare secondary payer practices 07.26.2013 Yahoo NewsDouble Damages Sought
Humana Inc. has filed four federal lawsuits against Farmers Insurance Group of Cos. and related entities, arguing that the Medicare Secondary Payer Act entitles it to reimbursement from Farmers for benefits that Humana paid for Medicare Advantage and Medicare Part D plans. 'Deceptive practices' alleged- The lawsuits were filed in U.S. District Courts in Kansas, Missouri, Tennessee and Texas within the past two weeks, court records show. Each of the complaints filed by Humana argues that Farmers entities used "deceptive practices" to "shift their financial obligations under the Medicare Secondary Payer law to Medicare Advantage organizations and ultimately to the Medicare Trust Funds and to elderly and disabled Medicare Advantage enrollees."
The Medicare Secondary Payer Act requires self-insured employers, insurers and others to notify the Centers for Medicare and Medicaid Services of workers compensation and liability settlements or payments that involve Medicare recipients. CMS can use settlement funds to recoup "conditional payments" that it previously has made on behalf of beneficiaries to medical providers. It also can require insurers, employers and other "primary payers" to set aside funds to pay for future medical costs related to a beneficiary's injury.
Humana argues in the court filings that Farmers entities served as primary payers, and that Humana and its entities are secondary payers because they acted on behalf of CMS as a Medicare Advantage plan. Therefore, Humana contends that Farmers companies are required to reimburse Humana under the Medicare Secondary Payer Act.
"Plaintiff, Humana Health Plan, has charged Defendant, Farmers Insurance Company, for those services, but Defendant, Farmers Insurance Company, has refused to make appropriate reimbursement to Plaintiff, Humana Health Plan," according to Humana's complaint filed in Missouri on Monday.
Double damages sought
Humana is seeking double damages against Farmers for its alleged failure to "make payment 'promptly' for medical costs for which they are responsible.'"
Humana previously sued pharmaceutical company GlaxoSmithKline P.L.C. in federal court for reimbursement under Medicare Secondary Payer rules. That suit is based on at least $460 million in settlements that Glaxo has paid for patients who suffered complications from using the Avandia diabetes drug.
The 3rd U.S. Circuit Court of Appeals ruled in June 2012 that Humana had a right to pursue its claim against Glaxo. The U.S. Supreme Court declined in April to hear Glaxo's appeal of that case, which was remanded to the Philadelphia County Court of Common Pleas.

Illinois Man Repays Insurance Money With 4 Tons Of CoinsAugust 2, 2013 IJ
A southern Illinois businessman has paid off part of a court-ordered legal settlement with nearly four tons of quarters packed into dozens of bags.
Roger Herrin, of Harrisburg, was ordered by an appellate court to repay $500,000 in insurance money related to a 2001 car accident in which his teenage son died.
The reimbursement followed years of legal disputes about how the insurance money was apportioned to the crash victims.
So in protest, Herrin repaid nearly a third of the money - $150,000 - with 50-pound bags of quarters he had trucked in by the Federal Reserve bank in St. Louis. The coins were delivered Wednesday to a Marion law firm. Herrin says he paid in quarters because paying in pennies wasn't feasible.

So far it's tricked an estimated 800,000 users, and it's still spreading like crazy. You don't want to fall for this one. For her 40th birthday, a wife told her husband, "I'd love to be 10 again."
So that Saturday, they had a heaping stack of chocolate-chip pancakes, her favorite childhood breakfast. Then they hit the playground and a merry-go-round. They finished the day with a banana split.
"So how did you enjoy being a kid for a day?" the husband asked.
"Great," the wife replied. "But when I said I wanted to be 10 again, I meant my dress size."
