United Farmers Agents Association Bestows First-ever Humanitarian Awards 
During the UFAA Convention held June 11-13 in Las Vegas, Membership Director, Cindy Eggert completed her UFAA Membership Report. Then, she asked Chapter 15 President, Glenn Johnson and Chapter 15 Treasurer, Terry Wilson to approach the podium.

Chapter 15 was honored with a first-ever Crystal UFAA Humanitarian Award for their involvement and donations to the victims of the EF-5 tornado in Joplin in May of 2011 and their more recent involvement in arranging for 1,500 hand tools and safety equipment items delivered by t
he Salvation Army to the cities of Moore and Shawnee, Okla. The latest delivery followed the May, 2013 EF-5 Tornados. Harbor Freight Tools Tulsa Store #64 teamed up with Chapter 15 and tripled the chapter order of tools for victims.

 Oklahoma Continuing Education

All resident agents/producers, CSRs and adjusters are required to complete continuing education biennially. The requirements are as follows:

Resident Producers (Excluding Title producers) are required to have 24 hours of continuing education, including three hours ethics and two hours of legislative updates.

  • Producers that sell, solicit, or negotiate Medicare Advantage or Part D Products or Plans are required to take a 4 hour Medicare Renewal course each renewal period.
  • Producers that sell, solicit or negotiate Long Term Care insurance must take a 4 hour Long Term Care Partnership course each renewal period after the initial 8 hour Long Term Care Partnership course was taken.
  • Producers that sell, solicit, or negotiate Annuity products are required to take a one time 4 hour course on Annuity products.

CSRs are required to have 13 hours of continuing education, including three hours of ethics and two hours of legislative updates.

Homeowners Confused About Insurance Coverage

Many homeowners do not understand what exposures are covered under their home insurance policy, according to a new consumer survey.

More than two in five Americans (41 percent) believe that a standard homeowner's insurance policy protects against mold damage, according to new InsuranceQuotes.com survey.

"This misconception could prove extremely costly," said Laura Adams, senior insurance analyst, InsuranceQuotes.com. "Mold remediation can cost tens of thousands of dollars. It's often not covered by homeowner's insurance, especially if it was caused by neglected maintenance such as a leaky pipe."

Oklahoma Commissioner Advises Insurers to Delay Nonrenewals June 17, 2013

Insurance Commissioner John D. Doak has issued a bulletin to all Oklahoma-licensed property and casualty insurers and insurance producers, advising them to keep customers on their current policies for at least 60 days after the completion of repairs. The move should give the policyholders enough time to make repairs and obtain coverage from another insurer.

"As a result of the devastating tornado outbreak, thousands of Oklahomans have filed property claims," said Doak. "Because of that, insurers are now reassessing risks and issuing nonrenewal notices. Due to the backlog of work that contractors and repair shops are currently experiencing, many repairs won't be completed before the policy expires. That results in open and pending claims that prevent the policyholder from obtaining replacement coverage. We want to prevent that."

Affected homeowners should also remember that homeowners' policies may not reflect a surcharge for weather-related claims. Additionally, state law states that insurers shall not cancel, refuse to renew or increase the premium of a homeowner's policy which has been in effect more than 45 days, solely because the insured has filed a first claim against the policy. Both provisions are part of the Insurance Consumer Bill of Rights passed by the Oklahoma Legislature earlier this year.  Source: Oklahoma Department of Insurance

Have you been Charged for Appointment Fees by Farmers
For you as an x-agent and/or your agency producers that no longer exists?

Dear Okie Voice,  I left the agency force in December, 2012. Farmers was aware of my leaving as they gave me a 90 day notice in September, 2012.
However, six months later, in June 2013, they deducted appointment fees from my Contract Value Check. I thought this was okay as they use to deduct all of the bi-annual fees from the folio in January. But, it seems they changed their procedures and only deducted 1/2 of the bi-annual fees every year on the March Folio. My Okla. Insurance license only renews bi-annually in odd years.

Then I realized, that one-half of my 2011 appointment fees had been deducted in March of both 2011 & 2012. So, the hit on my Contract Value check had to be for 2013 appointment fees- And, I am no longer an agent appointed with the companies. Checking with the OID Licensing Div., I discovered appointment fees are just like insurance policies and are billed and paid in advance by the companies to the State Insurance Dept.

So, called KC Agency Services and inquired about the fees charged to my Contract Value Check. I received this response.
"The termination cut off for the 2012 Appointment Renewal billing was
10-31-12. Since you were still an active agent as of 10-31-12, the state
billed Farmers for your annual appointments ($150.00) and in turn, you were
folio deducted for these fees in March 2013."

"Regarding the yearly billing I was explaining, below you will find the
notification we received about the Oklahoma Appointment Renewals. In the
first paragraph, it explains that the Renewals starting with the year 2012
will renew every year rather than every other year as they were previously
billing. If you have any other questions, please let me know."

 That sounds like a rejection of my refund request, I thought. But, their explanation simply doesn't jive with their actions. The so-called 2012 Appointment Renewal Billing is just that- a billing dated in 2012. But, just like an insurance policy, that billing is for another term of coverage- in this case, an advance billing for appointment fees for the year of 2013 !
"Me being an agent on 10-31-2012 has nothing to do with the appointment fee charge for 2013. In fact, my name should have been removed from the active agent billing list by Farmers months ago, as I am not appointed with the companies in 2013," I pleaded.

And, there has been serious debate by the agency force whether Farmers can pass the appointment fee charge to the agents as simply explained in the Okla. Statutes Para: D & C-

Oklahoma Statutes Citationized   Title 36. Insurance 
  Section 1435.15 - Producer Acting as Agent 

D. An insurer or authorized representative of an insurer shall pay a biennial appointment fee, in the amount and method of payment set forth in Section 1435.23 of this title, for each insurance producer appointed by the insurer for each insurer for which the insurance producer is appointed.

 

E. It shall be unlawful for any insurer to discriminate among or between the insurance producers it has appointed. Any person or company convicted of violating the provisions of this section shall be guilty of a misdemeanor and shall be punished by the imposition of a fine of not more than Five Hundred Dollars ($500.00) or imprisonment in the county jail for not less than six (6) months nor more than one (1) year, or be punished by both said fine and imprisonment.
