Dealing with Difficult Tactics*

Mediation can provide tremendous opportunities for change and growth, but it can also bring out the worst behavior in people. In order to get what they want, disputants sometimes scream, refuse to listen, withhold information, make threats, stall, lie, or engage in other challenging tactics.  

 

In this clinic, we will identify common patterns of difficult behavior, discuss why people use these tactics, and learn how to get the conversation back on track. Most of the clinic will be focused on hands-on practice, so please come prepared to discuss the tactics you find most difficult and to practice defusing them in a low-stakes environment.

In preparation, we recommend imagining your least favorite disputant. You'll gain successful strategies for future mediations. 

Emily Epstein    
Emily specializes in teaching negotiation, facilitation, mediation, and communication skills. She is currently adjunct faculty at the University of California at Berkeley School of Law. In the past, she has served as associate faculty at Harvard Law School's Program on Negotiation and adjunct faculty at the Georgetown University Law Center.  

 

Emily is principal of Oakbay Consulting, a company that teaches negotiation and communication skills to corporations and non-profits worldwide.  She has taught conflict management skills to professionals in a wide range of public and private sectors.  Representative clients include Deutsche Bank, Nokia, Child Soldiers International, the Equal Employment Opportunity Commission, and Harvard Law School.
