Greetings!
As a month of wonderful programming in July comes to a close, BALIF is excited about some unique opportunities arising in August. The stars are aligned this year for LGBT Bay Area attorneys, as San Francisco is hosting both the ABA Annual Convention and Lavender Law. In conjunction with the ABA conference, on August 9, 2013 Navigant Consulting is sponsoring an LGBT Reception at Bisou French Bistro, 2367 Market Street, from 6:30 to 8:00 p.m. BALIF members are invited. BALIF is also co-sponsoring a Reception with Seyfarth during the Lavender Law Conference on August 22, 2013 at 111 Minna Gallery. We hope to see you there!
In our excitement about August, we should not forget that there is still some programming to squeeze out of July. This Wednesday, July 31st, we have a panel co-sponsored with JAMS discussing important family law issues - Implications of DOMA and Prop 8 Rulings: The new frontier in same-sex family law and estate planning.

Implications of DOMA and Prop 8 Rulings: The new frontier in same-sex family law and estate planning
|
On June 26, 2013 the United States Supreme Court issued the long anticipated rulings in the first marriage cases to reach the high court - United States v. Windsor, No. 12-307, and Hollingsworth v. Perry, No. 12-144. Taken together, the decisions represent a significant step in the central civil rights issue of this era - the rights and responsibilities of same sex couples to marry and to raise children.
Please join BALIF and JAMS for a complimentary panel discussion that will address the immediate family law and financial planning implications of these decisions and the questions that remain. Topics to be addressed include:
- Overview of Windsor and Perry rulings and questions that remain
- Key issues in pending Ninth Circuit cases
- Financial planning issues for California residents before and after DOMA, including estate plans, ERISA, and estate, income and gift tax issues
- Issues for California employer benefit plans
- The impact of the cases on dissolution actions and resolving disputes in an ADR setting

Lavender Law Donations

Hey BALIF members! Did you know that almost half of BALIF membership is made up of law students? And with the National Lavender Law Conference being held in beautiful San Francisco August 22 through 24 - it is BALIF's goal this year to send as many law students to attend this exciting and invaluable event. Unfortunately, due to the high cost of registration, many law students are unable to attend. Therefore, BALIF is seeking the help of our generous members to donate a minimum of $135 (the cost of registration) to help support a law student to attend Lavender Law 2013. This year will be especially electrifying with the demise of DOMA and Prop 8 and we don't want our Bay Area law students to miss this once-in-a-lifetime opportunity!

"Connections" Mentorship Program
|
It's that time of year again! BALIF's "Connections" Mentorship Program is looking for mentees seeking to gain valuable insight into the profession, and mentors who want to provide guidance and experience to the "younger" crowd. Both mentors and mentees must be able to commit to constant communication, and must be able to meet at least a few times during the course of the mentorship year (September-May).
Mentors should be more senior, experienced attorneys or judges in their field(s) of practice. Mentees can be law students, attorneys just beginning their careers, or even more senior attorneys looking to expand their horizons or to move into a different legal focus.
Applications are available for the program. Please email younglawyers@balif.org, and in the subject line note either "Mentor" (if you are seeking to be a mentor) or "Mentee" (if you are looking to be mentored). The ABA National Task Force on Stand Your Ground Laws To Hold Western Regional Hearing in San Francisco

You are cordially invited to attend and/or present testimony at a significant public forum concerning the proliferation of Stand Your Ground Laws, which have substantially expanded the contours of self-defense law in over half of jurisdictions in the United States and received increased national attention in connection with recent high-profile cases.
Expert witnesses drawn from local and regional community and government stakeholders, law enforcement prosecutors, public and private criminal defense attorneys, and legal academicians will testify on the impact of Stand Your Ground laws in the Western region, where several states have enacted similar expanded self-defense statutes.
Topics will include:
- The utility of Stand Your Ground laws from legal and policy perspectives
- The impact of Stand Your Ground laws on public safety
- The impact of Stand Your Ground laws on traditionally marginalized communities and racial and ethnic minorities
- The impact of Stand Your Ground laws on the criminal justice system, with a particular focus on law enforcement and the prosecutorial function

On November 27, 1978, the nation's first openly gay elected official, San Francisco Supervisor Harvey Milk, and Mayor George Moscone were shot to death in City Hall by former city supervisor Dan White. In White's murder trial, the defense team successfully argued diminished capacity based in part upon his junk food diet. Was this right, or should White have been convicted of murder? Join the prosecution or defense team, and argue the case yourself, with help from leading trial lawyers Vincent Chang and Garrick Lew, Judge William Kelly, and trial consultants David Weinberg and Dr. Darlene Shelton.

LGBTQ Domestic Violence Information and Resources (DVIR) Workshop

The DVIR Collaborative, the Office of Women's Policy, and the Billy de Frank Center are excited to invite you to this August 12, 2013 Workshop, from 4:00 to 7:00 pm at the Billy de Frank Center. Details are set forth in the attached flier here. This workshop is intended for professionals, advocates, attorneys, social workers, probation officers, counselors, medical care providers, and other service providers who work with clients who have experienced intimate partner or domestic violence in their LGBT relationships. A panel of experts from the Court and other agencies will participate in a Question and Answer Session. Topics that will be discussed are law enforcement response, how to obtain a restraining order, immigration concerns, safety planning, recognizing DV, and other issues. The Q&A will be preceded by a presentation regarding unique domestic violence issues in LGBT relationships and the most respectful lexicon to use when working with your LGBTQ clients. The Q&A will be followed by a resource fair with 30 to 40 services represented. You can network and obtain brochures and referral information for your clients.

Nominations Now Being Accepted for 2014 Barristers Club Board of Directors

The Barristers Club Board of Directors is accepting applications for 2014. Directors determine the club's mission and set policy and procedures to fulfill the club's mission.
Directors supervise and facilitate Barristers Club activities by serving as liaisons to Barristers Sections and Committees, and participating on ad hoc committees in connection with major events (e.g., the Judges Reception). Directors represent the Barristers to the legal community and the public.
Candidates must be BASF members who were admitted to the bar on January 1, 2004 or later. The Barristers Club and its board encourage diverse eligible members of BASF to apply for the Barristers board.
To be considered for a nomination, you must submit a personal statement no later than September 3, 2013.
The statement should include your education and legal background, area of practice, your involvement with the Barristers Club, other bar associations, or community service organizations. We encourage you to include any other information that you believe will assist the committee in making an informed decision. Your statement should not exceed 350 words and should not include the names of endorsers. In addition, you may include your resume, if you like.

Tax Implications for Same-Sex Couples After DOMA. Where Does the Code Go From Here?
On June 26, 2013, the Supreme Court in Windsor v. United States invalidated Section 3 of the Defense of Marriage Act (DOMA). What will be the implications of the Court's decision on the application of Federal tax laws to same-sex couples? Panelists will discuss the tax planning challenges faced by same-sex couples and other Federal and state laws, such as estate and gift tax complications, taxation of Social Security benefits and employer-provided health coverage, the availability of certain deductions and exemptions, and the possibility of filing amended returns. The panelists will share their insights on the Supreme Court's rulings in Windsor and inHollingsworth v. Perry. The panel will also share ideas on necessary IRS guidance in light of these decisions.

This new exciting initiative called "Mind the Gap" (MTG) is to provide recent law school graduates and young attorneys who are unemployed or underemployed with training, work experience, mentorship connections and debt reduction information. BASF is looking for attorneys to serve as mentors to MTG participants. A mentorship Listserv consisting of MTG participants and interested mentors will be created where mentees can post questions and mentors can respond with answers and general advice.
