Taco hell: Lawsuit against food truck claims employee was overworked without pay

By Kathryn Brenzel | NJ.com

December 9, 2013

Taco Truck has until Dec. 23 to answer a lawsuit accusing it of overworking and underpaying a Hoboken employee.

Former Taco Truck employee, Jonathan Velazquez, lobbed a proposed collective action against the business alleging he logged upwards of 70 hours per week without being paid overtime, according to court records. Velazquez filed the suit Oct.14 in New Jersey federal court, which names the Taco Truck, CEO Jason Scott and COO Chris Viola...

The business faces a proposed collective action, which allows individuals with similar experiences to Velazquez to opt-in to the lawsuit. In class actions, potential class members must opt-out of the lawsuit to not be bound by its resolution.

The Legal Blitz
December 9, 2013

We all have that one golfing buddy who can't seem to hit a single straight shot and always requires a baker's dozen worth of mulligans. But thanks to a recent ruling by a New Jersey Superior Court judge, only the golfer hitting the ball is responsible for yelling "fore!" for errant shots.

Last week Judge Thomas Vena of the Essex County Superior Court dismissed claims against two members of a threesome who kept quiet while the third took a mulligan that struck and injured another player.

A federal judge has refused to dismiss putative class actions alleging that L'Oreal made outlandish claims about its anti-wrinkle products, such as that they "boost the activity of genes" and "stimulate cell regeneration."

U.S. District Judge William Martini let stand 24 of the 26 counts in a dozen cases centralized in New Jersey, In Re L'Oreal Wrinkle Cream Marketing and Sales Practices Litigation, finding the plaintiffs sufficiently alleged fraud and other wrongs.
