Visa Bulletin Update: Priority Date Jump

 

Beginning in July, the priority date for Indian nationals with approved I-140s in the EB-2 category is moving from 15 November 2004 to 01 September 2008. This means that any Indian nationals with priority dates preceding 01 September 2008 will be able to file their adjustment applications for US legal permanent residency. Additionally, those with adjustment applications already pending may receive requests for updated medical exams. Please contact Challa Law offices today to begin your adjustment application.

Supreme Court Rules Narrowly Interprets Provisions of Child Status Protection Act

  


On June 9, the U.S. Supreme Court issued a 5-4 decision upholding the Board of Immigration Appeals' restrictive interpretation of the Child Status Protection Act (CSPA). In Scialabba v. Vuellar de Osario, the Court addressed the issue involving immigrant (permanent) petitions on behalf of individuals with dependent children who age out, or turn 21 during the pendency of the petition. The court found that the CSPA only benefits a very small percentage of immigrants who "age out" of the visa application system when they turn 21. According to the decision, the majority of immigrant children do not qualify for the immigration status granted to minors under the act, and thus once they age out, they must go to the back of the queue, restarting the process as an adult. This is in stark contrast to previous interpretations of the law which preserved a child beneficiary's priority date upon turning 21. Only children applying in their own right will now receive this particular benefit.

Writing for the majority, Justice Elena Kagan stated that the act does not offer any protection that would not have already been granted to certain immigrant children and only protects immigrants "who qualified or could have qualified as principal beneficiaries of a visa petition..." rather than only as derivative beneficiaries piggy-backing on a parent." Opponents of this new interpretation argue that its net effect will be to separate families.

Medical Exams Expire?

 

Beginning this month, new USCIS policy will limit the validity period for all I-693 "Report of Medical Examination and Vaccination Record" strictly to one year. Medical examinations are a requirement for most adjustment of status applications to legal permanent resident, but given considerable backlogs, it is not uncommon for an adjustment application to remain pending for well over a year. 


Given the policy change, USCIS may issue individuals who have I-485, Adjustment of Status applications pending for over a year a Request for Evidence (RFE), requesting a new medical exam. If our office has filed an I-485 on your behalf, and it has remained pending for more than a year, please wait for us to contact you before attempting to schedule a new medical exam. Our office will contact you to fully explain the specific circumstances of your case, if an RFE is received for your pending I-485. Please note that it can take up to three weeks for the formal RFE notice to arrive from USCIS. At this time, USCIS may also request documentation concerning your employment confirmation, and if so, we will guide you through the appropriate steps. Importantly, you should not proactively schedule a medical examination. Please wait until we receive an RFE for your case requesting the medical. 

New DACA Renewal Guidlines Released

   
On June 5, Secretary of Homeland Security Jeh Johnson announced the formal process for individuals to renew enrollment in the Deferred Action for Childhood Arrivals (DACA) Program. USCIS has submitted a new form to allow individuals previously enrolled to renew for a period of two years. Applications for DACA renewal will be accepted immediately, but USCIS suggests individuals submit approximately 120 days before their current DACA expires. DACA is a discretionary determination that allows certain individuals without lawful immigration status who came to the US as children remain without fear of removal action. Individuals in DACA are able to stay in the United States and apply for employment authorization for a period of two years. Since the program began, more than 560,000 individuals have taken part.

Individuals who have not requested DACA previously, but meet the criteria established, may also continue to request deferral for the first time. It is important to note that individuals who have not continuously resided in the United States since June 15, 2007, are ineligible for DACA. Individuals may request DACA renewal if they continue to meet both the initial criteria set forth by DHS and these additional guidelines:
  • Did not depart the United States on or after Aug. 15, 2012, without advance parole;
  • Have continuously resided in the United States since they submitted their most recent DACA request that was approved; and
  • Have not been convicted of a felony, a significant misdemeanor or three or more misdemeanors, and do not otherwise pose a threat to national security or public safety.

-          Thank you for the Morale Booster! Our soldier's faces lit up as I started laying out all the goodies from your care package. As soon as I announced the box, some soldiers made a beeline for it to see what was up for grabs! Two of my younger soldiers (21 and 20) have immediately started tossing around the mini footballs...a few others went straight for the magazines...  I try to think of the small things that will keep them going and help them remain positive, but as I get to know a number of them, many join the Army to get away from a rough upbringing and a number of them will not receive mail or packages at all from loved ones throughout this deployment. Thank you for making a difference --- my soldier, Donovan, in particular will remember your kindness... P.S. That candy kept most of our staff alert and awake for one of our late night planning sessions! Perfect timing!
