Our offices have noticed a recent trend in Requests for Evidence (RFE) on pending Adjustment of Status applications. We are proactively addressing this issue with the American Immigration Lawyers Association (AILA) as it appears that some of the RFE's may have been issued erroneously.  Once we have a resolution from USCIS, we will send you an update.

The Following is a Sample I-485 Request for Evidence which appears erroneous:

Fact: Beneficiary is the 10 year old dependent of a pending adjustment of status applicant

RFE: USCIS requested the ten year old provide evidence of a valid job offer, proof of continuous employment authorization and current job offer letter from her employer.

Clearly employment of a 10 year old would violate U.S. Child Labor Laws and therefore we suspect that this request was issued in error.
