Travel During H1-B Cap Gap
Challa Law Offices reminds clients that a student granted a cap-gap extension who decides to travel outside the United States during the cap-gap extension period will not be able to return in F-1 status.
The student will need to apply for an H-1B visa at a consular post abroad prior to returning. An H-1B beneficiary may enter the United States up to 10 days prior to the start date, i.e. September 20, but be advised that the H-1B beneficiary cannot start H-1B employment until October 1. The student should be prepared to adjust his or her travel plans, accordingly.

| J-1 Exchange Visitors Referred to "Secondary Inspection" at the Airports
According to the NAFSA which is a key source for international students and school DSO visa issues, it appears that DHS has instituted an interim policy of referring all arriving F, M, and J visitors, including students who have never had a SEVIS record termination, to secondary inspection where SEVIS can be accessed. This is to ensure that individuals whose SEVIS records have been terminated are not readmitted without a thorough review of the students' situation.
Under the unusual circumstances, the NAFSA recommends the following to travelling F, M, and J visitors: An individual referred to secondary inspection should be prepared for the admission process to take significantly longer, and should take this into account when arranging connecting flights and airport pickups.
Being prepared with the right documentation can help the process go more smoothly. For example, before leaving and reentering the United States, returning individuals should make sure that their visa is valid, their SEVIS record is in Active status, and their SEVIS form has been properly endorsed with a travel signature. They may also wish to travel with other documentation showing that they are in good academic and SEVIS status. Also see Arrival Procedures for Students or Exchange Visitors on the CBP website, which, even though it has not yet been updated to reflect these new procedures, does provide some helpful information.
Anyone reentering who may have had a SEVIS record terminated in the past should be prepared with current documentation and reasoning that establishes their ability to resume their program in the United States.

Supporting Our Troops and Showing Our Love for the Military
Challa Law continues to send a box every month to our Military men and women who are overseas. If you would like to be a part of our continuing effort, you can donate and we will purchase the items to send them on your behalf, along with hand written notes to our troops.

This months box will go to a Marine Unit, which is originally from North Carolina. They ask for basic items such as socks, snack foods, and laundry detergent.
