Owner-Operator Alert Available
Owner-Operator Classification Alert is now available to MCM members by clicking on the aforementioned link. The Alert provides an overview of federal and state legislative and administrative proposals that would impact independent contractor classification if enacted. Highlights in this Alert include an Arkansas law modifying the labor code's "ABC" test; a Hawaii bill that would replace the state's current ABC test in the UI context; a Massachusetts bill that would authorize stop-work orders and license revocation for businesses upon a finding of failure to pay employment taxes or unemployment tax payments; a Minnesota bill that would prohibit exclusive use of an independent contractor; a Nevada bill that would establish a new multifactor independent contractor test for wage payment purposes; a number of North Carolina bills that would establish new enforcement bodies and create a standalone misclassification violation using an ABC test; an Oregon bill that would use "integral part of the business" as the touchstone for employee classification for wage payment purposes; a Vermont bill that would establish a new uniform IC definition for UI and WC purposes; and a Washington bill that would establish an ABC/separate business entity test, and create express joint employer liability. For more information, contact Rich Pianka at rpianka@trucking.org. If you have trouble accessing the Alert, please contact Lashon Harris at lharris@trucking.org.

Federal State Trucking Associations
When you are a member of the Motor Carriers of Montana, you are part of a federation that includes 50 state trucking associations and industry related conferences and councils. Altogether, these organizations make up the federation of the American Trucking Associations, which traces its origins to a meeting in Montana in 1933 between the American Highway Freight Association and the Federation Trucking Associations of America. The Federation is the largest national trade association for the trucking industry. For your convenience, here is a list of association and affiliates.
