RAD News 


1.  HUD issued a housing notice providing PHAs with program resources and relocation requirements of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended, (URA) for arranging residential relocation as a result of a Rental Assistance Demonstration (RAD) conversion under RAD's first component. 

2. HUD has issued the following RAD Frequently Asked Questions (FAQs):  

a) the RAD Project-Based Rental Assistance (PBRA) Housing Assistance Payment (HAP) contract to conform with the Section 8 Multifamily-Assisted Housing Reform and Affordability Act (MAHRA) HAP provisions relating to future legislative or administrative changes affecting contract rents 

b) changes to the  RAD Use Agreement and RAD Conversion Commitment (RCC) to address concerns raised by residents, lenders and investors regarding rights of foreclosure

Provides PHAs and their partners with information and resources on applicable program and relocation assistance requirements when planning for or implementing resident moves as a result of a Rental Assistance Demonstration (RAD) conversion under the first component of the demonstration. This Notice provides guidance on RAD relocation requirements and requirements of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended, (URA), as they relate to the public housing conversion process under the first component.

Updated Requirements for Pre-Foreclosure Sales (PFS) and Deeds in Lieu (DIL) of Foreclosure

Sets forth the Department's policies on Pre-Foreclosure Sales and Deed In Lieu transactions and describes:

 Requirements for real estate agents and brokers participating in PFS transactions;

 An initial listing period requirement for PFS transactions;

 Updated sample language for the PFS Addendum;

 Documentation requirements for verifying assets, income, and expenses;

 Use of the Deficit Income Test (DIT);

 The elimination of the financial hardship/deficit income PFS requirement for a service member who has received Permanent Change of Station (PCS) Orders;

 Validation requirements for appraisals;

 The criteria under which the Department will permit non-arms-length PFS transactions; and

 The minimum marketing period for all PFS transactions.
