Notice on Appeals for the FY2012 Continuum of Care (CoC) Program Competition

2013-08

This Notice provides guidance to CoCs and applicants of the CoC Program funds regarding the information that must be submitted to HUD in order to appeal one of the following decisions:

A. the project applicant believes that it was denied the right to participate in the CoC planning process in a reasonable manner; or

B. the applicant was denied CoC Program funds by HUD, or was awarded less funding than requested; or

C. the jurisdiction refused to sign the Consolidated Plan certification for the project.

For HUD to consider an appeal, the applicant must follow the applicable process set forth in this Notice.

The purpose of this Notice is to provide program occupancy guidance for the Section 811 Project Rental Assistance (PRA) program, as authorized under Section 811 of the Cranston-Gonzalez National Affordable Housing Act of 1990, as amended by the Frank Melville Supportive Housing Investment Act of 2010.

 

Updated Guidelines for Continuation of Interest Reduction Payments after Refinancing: "Decoupling," as allowed by the National Housing Act, under Section 236(e)(2).

This Notice establishes updated procedures for the optional continuation of Interest Reduction Payment (IRP) assistance when projects assisted under Section 236 are refinanced.

 

Rider to HUD-92323-ORCF, Operator Security Agreement

This Notice announces the availability of a Rider to Operator Security Agreement. The Rider pertains to HUD-92323-ORCF ("Operator Security Agreement"), the publication of which was announced in the Federal Register on March 14, 2013 (Volume 78, No.50, pp. 16279-16286).

 

Annual Base City High Cost Percentage and High Cost Area Revisions for 2013

HUD has reviewed the High Cost Percentages (HCP) for each Base City, and each Base City HCP has been recalculated based on Marshall & Swift construction data. The results are reflected in the attached list of authorized Base City HCPs, effective January 1, 2013.

HUD is issuing this new Notice along with a Mortgagee Letter to provide additional guidance based on our initial experience and feedback. This Notice supersedes Notice H 13-05 in its entirety.

Delayed Implementation of "PFS Participation Requirement" Section included in Mortgagee Letter 2013-23, Updated Pre-Foreclosure Sale (PFS) and Deed in Lieu (DIL) of Foreclosure Requirements

Implementation of the "PFS Participation Requirement" section stipulated in Mortgagee Letter (ML) 2013-23 has been delayed until further notice. PFS participation requirements denoted in ML 2008-43, 2002-13, and 2000-05remain in effect. All other provisions included in ML 2013-23 remain in effect.

 

FHA Consolidation of Title I and Title II Lender Identification Numbers

The purpose of this Mortgagee Letter is to announce the consolidation of Title I and Title II Lender Identification (Lender ID) numbers. Lenders will now have a single Lender ID.

 

Eligible Properties in Presidentially Declared Major Disaster Area Super Storm Sandy for 203(k) insured mortgages

This Mortgagee Letter implements policy changes to the 203(k) rehabilitation insured mortgages for properties located within Presidentially Declared Major Disaster Area Super Storm Sandy.
