News of Note:

1. Comments Sought for CDFI Bond Guarantee Program. The Treasury Department's Community Development Financial Institutions Fund (CDFI Fund) released the interim rule for the CDFI Bond Guarantee Program. The interim rule includes responses to the July 1, 2011 request for public comment and discusses program application eligibility and evaluation, terms and conditions of guarantee, eligible uses of bond proceeds, reporting requirements, and compliance with government requirements. Comments are due April 8, 2013.
 
a) Guidance under §42 relating to the application of the design and construction accessibility requirements under the Fair Housing Act.
b) Regulations under §42 relating to compliance monitoring, including issues identified in Notice 2012-18.
c) Revenue Procedure updating Revenue Procedure 2007-54, which provides relief under §42 in the case of a presidentially declared disaster.
d) Notice providing relief from certain §42 requirements following Hurricane Sandy.
e) Guidance concerning the exception under §42(d)(6) for any federally or State assisted building.
f) Final regulations under §45D that revise and clarify certain rules relating to recapture of the new markets tax credit as well as other issues.
g) Regulations under §45D on new markets non-real estate investments. Proposed regulations and an advance notice of proposed rulemaking were published on June 7, 2011.
h) Guidance on the energy credit under §48.
 
3. Public Notice Announcement from the HUD Technical Assistance Center (TAC): All users with a 12/31 fiscal year end date are encouraged to submit their electronic filings, reset passwords and/or reactivate user names, if necessary, as soon as possible. For users who need to reactivate user IDs, they must contact TAC at 1-888-245-4860 or by email.
