We are well in the swing of our 2014-15 year of the Gwinnett County Bar Association. Our Friday, October 17 meeting will be held at the 1818 Club at noon, when we are pleased to welcome Georgia's 82nd Governor, the Hon. Nathan Deal.
We are receiving a warm response to our Assisting Practitioners Program and are looking forward to welcoming new lawyers to the Gwinnett legal community in this ambitious program we are co-sponsoring with the State Bar of Georgia, and are currently planning a reception for the second week of November. If you are interested in mentoring a new attorney and welcoming them into your practice in the coming year, you can contact either myself or Michelle West, director of the Transitioning Into Law Program for the State Bar of Georgia at

Please mark your calendars for our annual holiday party on December 13, 2014 at the Payne-Corley House. In recent years, this event has been a highlight of the bar year and is a welcome opportunity to catch up with fellow members of the bench and bar.
Finally, we are looking for sponsors to help purchase a new case for the Gwinnett County Bar Association to preserve our legacy at the Gwinnett County Justice and Administration Center. Chief Superior Court Judge,
Melodie Snell Conner, joined the
Supreme Court
On Monday, October 6, 2014, Chief Judge Melodie Conner was designated to assist the Georgia Supreme Court to serve in place of Justice David Nahmias in the appeal of Greene County Development Authority et al., v. State of Georgia wherein the appellant was seeking to reverse a lower court's decisoin denying the validation of revenue bonds to build facilities for a local charter school.
Congratulations to Chief Judge Conner for well-deserved recognition.

IT DOES LOOK DIFFERENT

Years ago, this publication regularly featured an article authored by one of our local judges, titled "View From The Bench." The focus of the article was to provide a Gwinnett jurist's perspective on the legal process in which all of our Association's members were routinely engaged. When I read those articles, I learned that judges, like juries when you talk with them after a trial, often see the process and your case much differently than you may see it. After being appointed a full-magistrate judge nineteen months ago after twenty-four years as an Assistant District Attorney, that former observation from those old articles rings true: It does look different from here. Georgia Supreme Court Analyzes
Ante Litem Notices

On October 6, 2014, the Georgia Supreme Court determined that the ante litem notice requirements of the Georgia Tort Claims Act ("GTCA") required strict compliance, particularly with respect to the amount of loss claimed. Under O.C.G.A. § 50-21-26, certain requirements must be met in order to effectuate proper notice under the ante litem statute. Included within these requirements is that a party with a potential tort claim must identify "the nature and the amount of loss suffered." In Board of Regents of the University System of Georgia v. Myers, the Georgia Supreme Court determined that Ms. Myers did not meet this requirement. Read more....

Res Judicata Issues in a Divorce?

Hardman v. Hardman, No. S14A1187, Sept. 22, 2014
In the recent case of Hardman v. Hardman, the former husband brought action for contempt against his former wife seeking reimbursement and a declaratory judgment as to whether wife was required to pay private school tuition for parties' children out of her monthly alimony payments. He further sought an injunction to prevent the former wife from removing their minor children from the private school in which they had been enrolled, which he had paid for the tuition in advance, and for that, he asked that the former wife be held in contempt. Estate Planning & Probate Section

Probate & Estate Planning Meeting

The next meeting of the Estate and Probate Section will be at noon, Tuesday, October 21st, at Dominick's on the Square. We will be hearing from Eldercare Advisor, Caroline Ventry, from "A Place For Mom." She will discuss ways of helping families with free eldercare advice, resources and options.
Probate Court Pro Bono Clinic
The next session of the Gwinnett County Probate Court's Pro Bono Clinic will be Thursday, October 23, 2014 from 1:30 - 4:30 p.m. in Courtroom "1-H" of the Gwinnett Justice and Administration Center. (3rd Thursday of the month)
Another great way to get involved!
Each month, attorneys meet with low income and indigent Gwinnett residents seeking assistance on simple legal matters. The Probate Clinic offers advice and information on decedent's estates, guardianships, and wills. The Consumer Clinic offers advice and information for people who have been sued on consumer debts in either in State or Magistrate Courts.
- Convenient and Reliable Scheduling: Your pro bono commitment would be on a set afternoon once every few months, depending on your schedule.
- No long term commitments: Your commitment to the client ends at the end of the meeting. You are not required to attend court, have follow ups, and under Rule 6.5, the advice you give does not create a conflict of interest with other clients.
