President's Corner

Greetings! As your outgoing President, this will be my final written communication to you, as my term will end on June 30th. I hope that you can join me for the Bar's final events for the program year. On Thursday, May 9th, we will host the Law Day Judicial Reception to thank our dedicated members of the Gwinnett County bench for their service. It will be held from 11:30 a.m. until 1:30 p.m. in the GJAC Auditorium Breezeway, and it is free to all financial Bar members and $10 for non-members. Our final luncheon meeting will be held on Friday, May 17th at noon at the 1818 Club, located on the third floor of the Gwinnett Chamber of Commerce Building, 6500 Sugarloaf Parkway, Duluth, GA. The cost for lunch is $10 for members and $15 for non-members. John Rogers and Bill Jones are partners at the Law Firm of Carlock, Copeland, and Stair, and they will share valuable tips on malpractice avoidance. We will also recognize the Law Enforcement Appreciation Day (LEAD) donors and conclude the Law Day Education Campaign at this meeting. (read more...)

Law Day Chair, Carlton Rouse put together an excellent evening of events. Our guest speaker was Chief Justice Robert Benham, our special guest was Attorney General Sam Olens. Our honorees were N. Wallace Kellerman, Pro Bono Award, Frances Smith, Liberty Bell Award and Capt. Melinda Allen of the Gwinnett Sheriff's Department, Law Enforcement Officer of the Year.

GREAT DAY OF SERVICE - GCBA @ HABITAT FOR HUMANITY,1074 Redwood Drive, Norcross, GA
Two shifts of Gwinnett Bar volunteers and respective family members participated in constructing a Habitat Home in Norcross, off Rockbridge Road. Walls were built and raised, windows cut-out and landscape leveled. At the end of the day progress was made and a $1500.00 contribution was made by GCBA to the home's on-going construction.

Court Erred in Denial of Motion for New Trial in Divorce Without Holding a Hearing,

In the recent case of Triola v. Triola, Supreme Court of Georgia, Civil Case (4/15/2013, 4/18/2013) S13F0538, the Supreme Court held that the trial court erred in denying the Husband's motion for new trial without first conducting a hearing, holding as 'Uniform Superior Court Rule 6.3 requires, "unless otherwise ordered by the court," that a motion for new trial in a civil action "shall be decided" by the trial court only after an "oral hearing," even if the moving party does not request such a hearing. Dividing Retirement Assets in Divorce Cases
-IRA accounts - No QDRO Needed-
Most attorneys are aware that when some types of retirement assets are divided in divorce cases, a special order is needed. This is a QDRO, or qualified domestic relations order. This can be a complicated order that may have to go through revisions to be acceptable to the financial institution that maintains the account. It can add significant expense to a divorce case.
A QDRO is not necessary to divide an Individual Retirement Account (IRA). (read more...) |
