But federal Judge Timothy Black has
issued a temporary restraining order against it requiring the state to recognize the marriage of two homosexuals who traveled to Maryland, where same-gender marriage is legal.
Phil Burress of
Citizens for Community Values says the judge leans far to the left, comparing Black's ruling to the California judge who overturned Proposition 8 in that state and "invalidated the vote of 7 million people."
"Judge Black has the same agenda," says Burress. "So we're seeing one man in a black robe telling everyone how they ought to live."
The Washington Post
reported the two homosexual men needed a marriage certificate so one of them, who is dying, can be buried in a family-only funeral plot.
The two men flew to Maryland and "wed" inside the plane on an airport tarmac, then returned to Ohio, the newspaper reported.
Burress says Judge Black's ruling is another clear example of the harm the Supreme Court did in its rulings on Proposition 8 and the Defense of Marriage Act.
"First of all, they shouldn't have even ruled on it," says Burress, "but we have a court now that's dictating and writing legislation. And if they don't like it, they're changing it to fit their own personal beliefs."
Ohio Attorney General Mike DeWine, who will fight the ruling, intends to "defend the right of Ohioans to define marriage," The Washington Post, quoting a spokesman for DeWine, reported.
The spokesman called the judge's ruling "a temporary ruling at a preliminary stage under sad circumstances."
