Greetings!
Really? Is January over already? We just celebrated the holidays! As time flies by, we are all looking ahead and making plans for 2013. Certain employers and foreign nationals have set their sights on April Fools Day. Here's why. It's no "joke" that April 1 will mark the release of 85,000 H-1B visas under the annual "cap" for certain foreign nationals with university degrees who will work in a "specialty occupation." It's important for employers and foreign nationals to get a head-start in preparing for H-1B season. Given the improved economy, the demand for H-1B visas could be high this year and the visas could be gone before we know it! For example, in 2007, when the economy was booming, the cap was reached on April 2, just one day after the visas were released. In 2008, the cap was reached as early as April 7. Below is a table showing when the cap was reached each of the last 6 years. Fiscal Year Date Cap Reached
FY 2008 (Oct. 1, 2007 to Sep. 30, 2008): Apr. 2, 2007 FY 2009 (Oct. 1, 2008 to Sep. 30, 2009): Apr. 7, 2008 FY 2010 (Oct. 1, 2009 to Sep. 30, 2010): Dec. 21, 2010 FY 2011 (Oct. 1, 2010 to Sep. 30, 2011): Jan. 27, 2011 FY 2012 (Oct. 1, 2011 to Sep. 30, 2012): Nov. 22, 2011 FY 2013 (Oct. 1, 2012 to Sep. 30, 2013): Jun. 11, 2012 What's the lesson to be learned? Get ready to file your H-1Bs before it's too late!
