On September 16 CMS finally made public the financial results of MSSP ACOs through 2013. Of the 210 ACOs (not including Pioneer ACOs), 53, or 25.2%, achieved sufficient shared savings to obtain monies from CMS. Some - like our client PBACO in Palm Beach County - were fabulously successful, but almost 75% received nothing. Interestingly, of the 27 ACOs in Florida, 10, or 37% - much better than the national average - achieved shared savings.
For 2014, the 210 ACOs will be in their second contract year and will be rated on 25 of the 33 quality measures. Slippage on the quality measures will reduce the ability to share in any shared savings achieved. It will be interesting to see if the winners can continue to prosper, and if the losers can turn things around.

Joshua Boxer Earns Board Certification in Health Law
|
Joshua Boxer, senior counsel in the Miami office of Broad and Cassel, has earned Florida Bar board certification in health law. Boxer joins an elite group of less than five percent of The Florida Bar membership that has pursued this level of recognition and is one of only 127 attorneys in the state who has achieved the board certification in health law.

September 24, 2014: Deadline for HIPAA-HITECH and Business Associate Compliance

One of the requirements of HIPAA-HITECH is that many of the obligations previously imposed on Covered Entities to comply Privacy Security Rules now also are imposed on their Business Associates. In addition, Business Associates are obligated to ensure that their sub-contractors ("sub-Business Associates") who perform services (either directly or indirectly) on behalf of a Covered Entity also comply with these obligations.

Trending: Country's Top Hospitals forming Alliances with Regional Health Systems

A few years ago, the Cleveland Clinic, ranked the top cardiology hospital in the country by U.S. News & World Report, started contracting directly for healthcare services with large employers like Lowe's, Wal-Mart and Boeing. Under these national contracts, self-insured employers pay for their workers throughout the country to travel to the Cleveland Clinic, for certain complex procedures, including heart surgery. The goal is to improve outcomes and save costs for the most complex treatments. It is estimated that some 2.5 million people across the country are covered by such national contracts.
