OIG Issues Fraud Alert for Lab Payments to Physicians
The Office of Inspector General issued a Special Fraud Alert on Laboratory Payments to Referring Physicians on June 25, 2014. It deals with both compensation paid by laboratories to referring physicians and group practices for blood specimen collection, processing and packaging and for submitting patient data to a registry or database. There has been a series of alerts and advisory opinions over the years that have categorized providing free or below cost goods or services to physicians that are a source of referrals, or paying a physician more than fair market value for his or her services, could constitute illegal remuneration under the anti-kickback statute.
This new Fraud Alert provides a list of characteristics for arrangements involving either specimen processing or registry payments that may be evidence of unlawful purpose under the anti-kickback statute. Click here for a link to the Fraud Alert.
