T1MU:  What is the new deadline for submitting Medicare MU 2015 attestations?
CMS extended the attestation deadline for the Medicare and Medicaid EHR Incentive Programs to March 11, 2016 at 11:59 pm ET, from the original deadline of February 29
Eligible professionals (EPs), eligible hospitals (EHs) and critical access hospitals (CAHs) participating in the Medicare EHR Incentive program can attest through the CMS Registration and Attestation System. Providers participating in the Medicaid EHR Incentive Program should refer to their respective states for attestation information and deadlines. Certain Medicaid eligible professionals may use the Registration and Attestation System as an alternate attestation method to avoid the Medicare payment adjustment (80 FR 62900 through 62901).

T2MU:  What is the new deadline for submitting 2015 Hardship Applications?
The 2015 reporting Hardship application deadline has been extended to July 1, 2016 for those eligible professionals (EPs), eligible hospitals (EHs) and critical access hospitals (CAHs) that are unable to attest for Meaningful Use in 2015 and want to apply for an exception from the Medicare Electronic Health Records Incentive Program 2017 payment adjustment.  
 
This new, streamlined application process is the result of the Patient Access and Medicare Protection Act (PAMPA), which established that the Secretary may consider hardship exceptions for "categories" of EPs, EHs and CAHs that were identified on the CMS website as of December 15, 2015.  Prior to this law, CMS was required to review all applications on a "case-by-case" basis.

T3MU:  Is there an easy way to determine if a provider is considered hospital based?
CMS recently updated FAQ 9844 which states that a hospital-based eligible professional (EP) is defined as an EP who furnishes 90 percent or more of his/her services in either the inpatient or emergency department of a hospital.  Hospital-based EPs do not qualify for Medicare or Medicaid EHR incentive payments.

If you are a new EP and need to determine your hospital-based status, contact the EHR information center at (888)734-6433 and choose option 4 in the interactive voice response system (IVR). You will need your National Provider Identifier (NPI) and the last 5 digits of your Tax Identification Number (TIN). If you are an existing EP, review and resubmit your registration on the Registration & Attestation website to determine your hospital based status.

T4MU:  What are the details of the new CMS FAQ that eases the public health measure?
Prior to February 25, CMS stated that eligible professionals (EPs) had to actively engage in two public health registries by February 29, 2016, for the 2016 program year.

On February 25, 2016, four days before the active engagement deadline, CMS released a new FAQ that allows EPs to use alternate exclusions for 2016 reporting as well.  See CMS FAQ 14401.

EPs can now claim alternate exclusions for syndromic surveillance reporting and specialized registry reporting.  Here is an excerpt from
"We will allow providers to claim an alternate exclusion for the Public Health Reporting measure(s) which might require the acquisition of additional technologies the providers did not previously have or did not previously intend to include in their activities for meaningful use ... EPs ... [m]ay claim an Alternate Exclusion for Measure 2 and Measure 3 (Syndromic Surveillance and Specialized Registry Reporting)."

Our interpretation of CMS's new FAQ is that if you planned to only connect to an immunization registry to meet the Modified Stage 2 Public Health Reporting objective, EPs can do so by claiming alternate exclusions for syndromic surveillance and specialty registry reporting.

T5PQRS:  What is the 2015 new QRDR submission deadline?
CMS extended the submission date for 2015 Quality Reporting Document Architecture (QRDA) data submission for the EHR reporting mechanism to March 11, 2016, for individual eligible professionals (EPs), Physician Quality Reporting System (PQRS) group practices, Qualified Clinical Data Registries (QCDRs) and qualified EHR data submission vendors.
  
Key dates for PQRS Submission:
  • Electronic Health Record Direct or Data Submission Vendor (QRDA I or III) - March 11
  • Qualified Clinical Data Registries (QCDRs) (QRDA III) - March 11
  • Group Practice Reporting Option Web Interface - March 11
  • Qualified Registries (Registry XML)  - March 31
  • QCDRs (QCDR XML) - March 31
The Quality Reporting Portal  may be unavailable during these scheduled Maintenance Times:
  • February 26 at 8 pm through February 29 at 6 am ET
  • March 11 at 8 pm through March 14 at 6 am ET
  • March 16 at 8 pm through March 21 at 6 am ET

OCR Releases Crosswalk to Address Gaps in Cybersecurity
The sensitive health information maintained by health care providers and organizations has become an increasingly attractive target for cyberattacks.
 
To help health care facilities increase their security the Office for Civil Rights (OCR) released a crosswalk between HIPAA Security Rule and NIST Cybersecurity Framework on Feb 24, 2016.  This crosswalk is intended to identify "mappings" between the NIST Framework for Improving Critical Infrastructure Cybersecurity (the Cybersecurity Framework) and the HIPAA Security Rule.
