Making our Congregations Safe Space for All:
Living into Pennsylvania's New Child Protection Laws

Beginning in 2015, Pennsylvania congregations will be required to make sweeping changes to how we retain, recruit and screen employees and volunteers who work with children as a result of new state laws passed in the wake of the Jerry Sandusky child-sex-abuse scandal.

The new laws expand the definition of "mandatory reporters" to include all rostered leaders, paid church employees who work with children, and also volunteers over age 18 who work with children in activities and programs. For churches this means ALL Sunday school teachers, nursery attendants, VBS volunteers, youth group leaders, etc.

Mandatory reporters are those who, when they have reasonable suspicion of child abuse are required to call the state ChildLine. The new law puts the burden on each mandatory reporter to notify state authorities.They are required to follow up with a written report. Willful failure to report is punishable by law.

The new law requires these two background clearances for ALL mandated reporters every 36 months. 
1) Child Abuse History Clearance Form (CY-113) ($10) - Obtained from the Department of Human Services.
2) Pennsylvania State Police Request for Criminal Record Check Form (SP4-164) ($10)

FBI Fingerprint Record Checks are additionally required for all employees (including rostered leaders) and for any volunteers who have not lived in PA for 10 years.

Here is a link to the Pennsylvania Department of Human Services that provides links to online forms or instructions for all three clearances.

The new laws give volunteers until July 1, 2015 to obtain the background checks, and employees until Dec. 31, 2015.

As a Synod, we are gathering authoritative information to assist congregations in complying with the new laws and to equip their mandatory reporters to understand their responsibilities.

To help train your mandatory reporters, here is a flyer that describes and provides a link to a FREE online three-hour course for mandatory reporters. Developed by University of Pittsburgh, the Department of Public Welfare, Office of Children, Youth and Families, the Pennsylvania Children and Youth Administrators, the course covers how to recognize and report suspected child abuse. Registration is required. Participants can then print out a certificate signifying their completion of the course.

 Meet Pastor Jeffrey Truscott, ELCA Missionary to Singapore

The Rev. Dr. Truscott serves as a lecturer at Trinity Theological College (TTC) in Singapore. TTC is a multi-denominational seminary attended by ministerial candidates from Lutheran, Methodist, Anglican, and Presbyterian churches. He teaches courses in worship, theology, and preaching.  He also serves as chaplain, responsible for organization of daily chapel services and special worship events (e.g. graduation, anniversary service). Dr. Truscott consults with the Lutheran Church in Singapore on various issues, such as first communion of children and design of new worship spaces for congregations.

 

Dr. Truscott served as pastor of churches in Maryland, Pennsylvania, and Indiana for 11 years and as instructor at the University of Notre Dame, Wartburg Theological Seminary and Japan Lutheran College/Theological Seminary for five years before beginning his ministry with the Lutheran Church in Singapore. He has been teaching in Asia since 2000, but the Lower Susquehanna Synod is his home base. 

 

Dr. Truscott earned his Master of Divinity from Trinity Lutheran Seminary in Columbus, Ohio, his Master of Sacred Divinity from Gettysburg Lutheran Seminary, and his Ph.D. and M.A. in liturgical studies from the University of Notre Dame in South Bend, Indiana. He enjoys music, travel, cooking, and reading.

New Child Protection Laws Will Impact Congregational Children & Youth Policies

 

The Commonwealth of Pennsylvania has passed new legislation that will likely impact the way congregations recruit and train volunteers, and may cause congregational leaders to re-examine their current child protection policies. Many leaders have already begun calling our office to learn what the new law means as it relates to who is required to have a background check, and the nature of those checks. Our synod staff are working diligently to help familiarize congregations with the new guidelines, but even more importantly to provide training to congregational pastors and lay leaders that will help them to come into compliance and to create congregational policies that are thorough, and provide the maximum safety to children, youth, and volunteers.

 

We will offer a "boundaries" workshop on three dates to give all congregational leaders an opportunity to attend. Staff youth leaders, Christian ed directors, pastors and even volunteers who are able, should plan on attending. The event dates are listed here in Carings and Sharings, along with web links and other content pertinent to the new laws and to helping make your congregation a safer environment for children and their families. In addition, we will create a link from the Children, Youth & Family home page to the "boundaries" and child protection information on our website, to give you even more accessibility to that information.

 Congregational Leadership as Spiritual Practice

Alban Institute author Bruce Epperly writes: "Congregational leadership involves seeing the holy in the congregation's members and the quotidian activities of the church and trying to bring that holiness out in partnership with God and others. But in the business of congregational life, it is easy to lose our way, focus on product rather than persons, become overwhelmed by the tasks of ministry, and forget that we are always on holy ground as we interact with God's beloved children." In this insightful article, Epperly offers powerful suggestions how to stay focused on the big picture. 

 

Upcoming Brown Bag Leadership Lunch: 

January 8 - Year Round Stewardship

Does your congregation need a financial boost? Plan on coming to the Brown Bag Leadership Lunch on Thursday, Jan. 8, when the topic will be "Year-Round Stewardship." We will explore strategies and resources to help make stewardship a 12-month effort that emphasizes how we use not only our financial gifts, but the cornucopia of abundance that God gives us. Assistant to the Bishop Rob Blezard will lead discussion and give all participants a DVD copy of the ELCA stewardship resource "Make It Simple" and other handouts. We gather at 10 a.m., work for a couple hours and then eat at about noon as we finish up our discussion. All congregational leaders are welcome. Registration is not required but it would be great if you could let Cathy Deitrich of the synod office (cdeitrich@lss-elca.org) know if you're attending so we can make sure to have enough materials.

LARC Vespers Planned for Week of Prayer for Christian Unity

 

Join with our brothers and sisters in faith for the annual LARC (Lutherans-Anglicans-Roman Catholics) Vespers during the Week of Prayer for Christian Unity. This year's event will be a service of evening prayer for the Feast of the Conversion of St. Paul. NOTE:  2015 IRS MILEAGE REIMBURSEMENT RATE

Beginning on Jan. 1, 2015, the standard mileage rates for the use of a car, van, pickup or panel truck will be:

  • 57.5 cents per mile for business miles driven, up from 56 cents in 2014
  • 23 cents per mile driven for medical or moving purposes, down half a cent from 2014  
  • 14 cents per mile driven in service of charitable organizations

The standard mileage rate for business is based on an annual study of the fixed and variable costs of operating an automobile, including depreciation, insurance, repairs, tires, maintenance, gas and oil. The rate for medical and moving purposes is based on the variable costs, such as gas and oil. The charitable rate is set by law.
