Florida Causes of Action for Which a Broker Could Be Sued

In Florida, brokers must disclose known and suspected material facts, including defects and deficiencies in a vessel. Failing to adhere to this duty in the listing and sale process can expose them to legal liability. The possible lawsuits a vessel buyer can sue for due to a vessel broker's failure to disclose are:
- Breach of Contract
- Breach of Warranty
- Violation of Magnuson-Moss Act
- Negligent Misrepresentation or Omission
- Breach of Fiduciary Duty
- Fraud in the Inducement/Concealment
- Deceptive and Unfair Trade Practices

Department Of Interior Releases 2012 Economic Impact Report
The U.S. Department of the Interior contributed over $371 billion dollars to the domestic economy in 2012, according to the agency's latest Economic Impact Report. Secretary Sally Jewell summarized the agency's goals succinctly, "The missions of the Department of the Interior contribute to our nation's economy in ways big and small," she said. "From the billions in revenues generated from oil and gas development, to the jobs created from tourism to our national parks and public lands, Interior's activities are an important source of business development and employment for communities and families in all 50 states."

Latent Defects In Marine Insurance

There are lots of potentially hidden issues in a boat. I have seen engines destroyed by the use of aluminum and iron together. I have seen stringers with saturated, rotten plywood cores; hulls full of soaked balsa coring and massive delamination caused by improper foam cores or improper installation of foam cores. These sorts of issues lead to severe losses and sleepless nights. For new boats under warranty, these losses will first be the responsibility of the builder. For the rest, the main question will be whether there is any coverage from the marine insurance.
When a boat owner reports a loss that is not obviously due to a collision, the adjuster and surveyor will certainly be looking for evidence of an excluded manufacturer's defect. In the case of core problems, the insurer is very likely to deny coverage on that basis unless there is clear evidence of a collision that punctured the outer hull.

Brakenhoff Honored With 2013 Bennett Award
