Dealing Effectively with Low Offers
By Don Finkle, CPYB, RCR Yachts Inc.
Sometimes it seems that if it were not for low offers we would have no offers at all. That might be an exaggeration, but from where we stand, low offers are much more common today than in years gone by. It is helpful to recognize why this is the case so we can deal effectively and create sales for our buyers and sellers. As with any negotiation, it is helpful to understand what the other parties are thinking and why... put yourself in their shoes.

Professional's Perspective
By Jeff Merrill, CPYB - Nordhavn Yachts, Garden Grove, CA
Last year I did something that I had kept putting off...I signed up for, took and passed the CPYB exam. While I didn't think I needed it (in CA you have to pass a state exam to get a yacht sales license), I felt that it was an investment in myself, and that since this is my chosen profession I might as well be earn the distinction of truly being called a "professional". Little did I know how much that little bit of initiative would help me raise my sales game. Inspired, I decided to become active in the broker community as a volunteer and have joined committees in the CYBA and YBAA. Connecting with fellow brokers, networking and sharing ideas and experiences has really been an eye opener.

Wetlands - Highs and Lows (Depending On Your Perspective)
By J. Dirk Schwenk, Baylaw, LLC
Wetlands protectors and Developers have each scored some points this week in the ongoing fight over wetlands protection. In Crofton, the permits to build a Walmart in non-tidal fresh water wetlands received the blessing of Maryland's Court of Special Appeals. The Developer asserted that the proposed location for a "big box retail store" (a Walmart) was the only feasible location and that it had minimized the removal and impact of wetlands and also traded additional lands to the State for protection. The permits were obtained despite the fact that "[f]urther degradation and loses of nontidal wetlands due to human activity [should] be prevented wherever possible" under the Clean Water Act. Para v. 1691 Ltd. P'ship, 211 Md. App. 335, 65 A.3d 221 (2013).
