MSDC's Prior Authorization Bill Re-introduced

  Earlier this week, DC Councilmember Yvette Alexander, Chair of the Committee on Health, re-introduced the Medical Society's prior authorization legislation. The Uniform Prior Authorization Form Amendment Act of 2013, co-introduced by Councilmembers Barry, Cheh and McDuffie and co-sponsored by Councilmember Bonds, was referred to the Committee on Business, Consumer and Regulatory Affairs, now chaired by Councilmember Vincent Orange. It is not clear when a hearing on the bill will be scheduled.

    Successful passage of the bill will streamline the health insurance prior authorization process, help stem the rising tide of health care costs and protect access to timely and effective care for patients in the District. Last year, MSDC released the results of a membership survey examining the impact of health insurance prior authorization protocols on patient care in Washington, DC. The study revealed that prior authorization protocols are a burden on medical practices and undermine patient care, with over 93% of respondents saying that insurance company requirements are having a negative impact on their ability to treat patients.

   This legislation will help bring the prior authorization process into the 21st century, alleviate the time-consuming burden on doctors and their staffs, and ensure that Washingtonians have access to timely, effective and affordable care.  

MSDC Leadership Opposes Government- Mandated Nurse Staffing Ratios
   The Medical Society Board of Directors opposed government-mandated nurse staffing ratios in response to recently introduced legislation related to nurse staffing. Specifically, the Board opposed B20-0101, the Patient Protection Act of 2013, which adopts a one size fits all approach to nurse staffing that could negatively impact patient care, while taking no position for the time being on B20-0111, the Nurses Safe Staffing Act of 2013.  
   A public hearing has not yet been set for these bills, but the Medical Society will continue to update members on this legislation. Want to voice your opinion?  Then:

Medicare Physician Payments Will Be Reduced Under Sequester

Sequester to Cut Medicare Physician Payment, Other Health Care Spending
   Physicians will see a 2 percent reduction in Medicare payments beginning April 1, thanks to the federal budget sequester that took effect last Friday, March 1st.
    "Our lawmakers have failed to act, and Medicare patients and physicians will now feel real pain in the form of new cuts that come at an already difficult time for the nation's economy," AMA President Jeremy A. Lazarus, MD, said in a statement last week
   The Medicare program has been on shaky ground for many years as Medicare's sustainable growth rate formula has meant that physician payments increased by just 4 percent since 2001, while the cost of caring for patients has grown by more than 20 percent.
    The AMA continues to urge Congress to reform the Medicare program by eliminating the failed formula and implementing new models of care delivery and payment-a system outlined in the AMA's principles for a high-performing Medicare program.

   In addition to Medicare physician payments, Medicare funding for graduate medical education will be reduced by 2 percent. Other federal health care spending will undergo cuts of about 5 percent. Among the areas hit are research and public health programs of the National Institutes of Health, the Centers for Disease Control and Prevention, and the Substance Abuse and Mental Health Services Administration.

CDC Update on Patients Who Received Contaminated Steroidal Injections

Clinicians Urged to Use Continued Vigilance for Fungal Infections among Patients Who Received Contaminated Steroid Injections

     CDC continues to receive new reports of fungal infection among patients who were given injections of contaminated methylprednisolone acetate (MPA1) from the New England Compounding Center (NECC) in Framingham, Mass. Most of these recent cases have been localized spinal or paraspinal infections (e.g., epidural abscesses) in patients, although new cases of meningitis or arachnoiditis also have been reported. Because many of these new cases are among patients with minimal symptoms, CDC is re-emphasizing the recommendation for clinicians to remain vigilant for fungal infections, especially in patients with mild or even baseline symptoms, and consider evaluation with magnetic resonance imaging (MRI) if clinically warranted. This Health Alert Network (HAN) notice provides the following
  • Information about the current status of the outbreak;
  • Recommendations for clinical management and follow-up of exposed patients;
  • Information about new revisions to web-based interim clinical guidance; and
  • Notice of an upcoming CDC conference call to provide clinicians with additional diagnostic and treatment information.

   The DC Chapter of the American College of Physicians (ACP) is pleased to launch a new adult immunization education and quality improvement initiative partnership with the national ACP and CDC. This free opportunity for physicians and members of their health care team will provide new information about recommended vaccines, strategies for increasing vaccination among your patients, and access to performance measurement tools, other educational and QI tools including ACP's Medical Home BuilderŽ, Maintenance of Certification practice improvement credit, HIPAA compliant professional networking and communications tools, and hands-on support for your practice or program at no cost.

CDC: Patients Should Strictly Follow PrEP Guidelines to Prevent HIV
CDC Stresses Importance of Adherence When Using PrEP to Prevent HIV

    This week, the National Institutes of Health released results of an HIV clinical trial that evaluated two oral antiretroviral prophylaxis regimens and a vaginal microbicide among sexually active women. Compared to placebo arms, the intervention arms provided no protection. These results likely occurred because women were not taking the drugs consistently as directed. Less than one- third of participants assigned to all study arms evaluated had any study drug detected.

   The Vaginal and Oral Interventions to Control the Epidemic (VOICE) trial was designed to evaluate safety and efficacy of two daily oral regimens - TDF (tenofovir) or TDF/FTC (brand nameTruvadaŽ) -and one daily vaginal TDF gel. The gel and daily oral TDF arms were found safe but were stopped last year because neither was found to be effective in preventing HIV in this population.  Today's results indicate that oral TDF/FTC was also safe, but did not provide protection to women in this study, and adherence data from all three arms indicate low levels of product use.

   There is strong evidence from previously completed trials that daily oral pre-exposure prophylaxis (PrEP) is safe and effective in reducing the risk of sexual HIV acquisition among multiple high risk populations including men who have sex with men (MSM) and heterosexual women and men, if taken consistently. On the basis of those previous trials, the Food and Drug Administration (FDA) approved the use of TruvadaŽ to reduce the risk of sexual HIV infection. To help ensure the safe and effective use of PrEP among adults, CDC issued  interim clinical guidance. Today's results reinforce the need for clinicians to closely follow that guidance and counsel patients about the need for high levels of medication adherence.

   Given the limited resources to combat the HIV epidemic, we have to maximize the combined impact of all available strategies for prevention. CDC and partners are now working to address critical remaining questions and issues for delivery in real world settings such as acceptability, access, cost, adherence, behavior risks and patient outcomes.

How to Actively Appeal a Claim ... from the AMA
Resources to take an active approach to the appeals process
American Medical Association  The AMA developed the interactive resource " Appeal that claim" to simplify the claim audit and appeals processes for physicians and their practice staff. This interactive resource can help reduce the administrative burden by delivering a step-by-step course of action to appeal an underpaid, delayed or inappropriately denied claim.
    Access the National Managed Care Contract Database (available to AMA members) to look up state laws and regulations, which may need to be cited or quoted directly in an appeals letter. Also refer to the issue brief, "Overpayments and underpayments" (available to all) for additional information.
