Elder law and special needs planning attorneys who work with individuals who win personal injury claims sometimes feel that trial lawyers should be more concerned about the issues that come up for clients after the case is resolved. These can include Medicare set aside rules, continuing eligibility for public benefits and appropriate financial management and budgeting of the settlement funds.
Special Needs Trust Payments Cause Section 8 Ineligibility

The Massachusetts Federal District Court ruled that the Brookline Housing Authority properly counted payments from a special needs trust as income when it determined that a Section 8 beneficiary was no longer eligible for a housing voucher.  DeCambre v. Brookline Housing Authority (D.Mass., No. 14-13425-WGY, March 25, 2015).

Turning 22: Media Coverage About Aging Out
Karen Mariscal and her autistic son Billy were featured in a recent article regarding what happens when children with autism age out of the educational system, which in happens in Massachusetts when they turn 22. In particular, the article focuses on housing, and the fact that in most cases autistic children remain at home when they become adults, with their parents as caregivers. In addition, on April 12, NBC's Dateline aired a segment called "On the Brink," which tells the story of two New York families who are struggling to help their young adult children with autism become independent. Dateline reports that over the next ten years, a million young people with autism will "age out" -- losing their eligibility for help through the education system.
