ILS Member, Michelle A. Estlund, Successfully Represented Former CIA Agent in INTERPOL Matter

Michelle Estlund is the founder and principal attorney of Estlund Law, P.A., located in Miami, Florida.  Michelle's practice focuses exclusively on criminal and INTERPOL (International Criminal Police Organization) defense cases, with an emphasis on international criminal prosecutions, human rights violations, and politically motivated prosecutions.  Michelle regularly advises individual and corporate clients, fellow attorneys, international journalists, and human rights organizations on issues related to INTERPOL.  Michelle has successfully represented Red Notice subjects before INTERPOL by achieving the removal of Red Notices in their names, as well as having Red Notices modified or corrected.  She writes extensively about INTERPOL matters on her blog, the Red Notice Law Journal. She is a recipient of the President's Award of the Florida Association of Criminal Defense Lawyers Miami Chapter and has twice been awarded "Best in Blogs" for her legal blog, the Red Notice Law Journal.

Michelle recently represented a former CIA covert operative, Robert Seldon Lady, who was facing criminal charges in Italy for his role in a CIA-led extraordinary rendition of a suspected terrorist, Egyptian Islamist Osama Mustafa Hassan Nasr. In an authorized operation, Mr. Lady and others took Mr. Nasr off the streets of Milan and delivered him to an interrogation cell in Cairo. This extraordinary rendition began a series of events that soured America's relations with Italy and upended the life and career of Mr. Lady and other CIA agents.

An Italian magistrate obtained indictments for 26 Americans and five Italians, including Mr. Lady.  This was the first known time that CIA operatives had ever been prosecuted by a friendly government for doing their jobs as directed by their supervisors. Mr. Lady was tried and convicted in absentia and sentenced to eight years in prison. Even though his cover in Italy was that he was working as deputy consul for the U.S. State Department, the U.S. government never fought to honor his diplomatic immunity.  Italian authorities requested and received an INTERPOL arrest warrant against Mr. Lady, and by all appearances, the U.S. government did nothing to assist with the INTERPOL matter.

His work, his marriage, and his life all suffered profoundly as a result of the pending charges and INTERPOL activity.  Michelle worked with Mr. Lady's long-time and dedicated attorney, Tom Spencer, to understand the case, and then applied to INTERPOL to remove the Red Notice.  INTERPOL removed the Red Notice, thus allowing Mr. Lady, who is not currently in custody, to travel without risking detention or extradition due to the Red Notice.

Michelle can be contacted at [email protected] or through her blog dedicated to INTERPOL matters: www.rednoticelawjournal.com.  Her office contact information is: Estlund Law, P.A., 147 Sevilla Avenue, Coral Gables, Florida.
