James Meyer Speaks at Annual RPPTL Section Meeting

Michael Dribin, outgoing President of the RPPTL Section, with James Meyer. Dribin and Meyer are partners at Harper Meyer.

The Real Propery, Probate & Trust Law Section of The Florida Bar, the Bar's largest section, invited James Meyer to speak at its annual meeting. As a member of the ILS Executive Council and the Cuba Task Force, Meyer provided the RPPTL insight on the ILS's recent exploratory trip to Cuba. Given the recent interaction between ILS and the Business Law Section, as well as this speaking engagement, the ILS has become increasingly prominent among the other sections of the Bar, which has been one of the key objectives during Peter Quinter's tenure as Section Chair.

Legislative Update

Senate Bill 806 "Regulation of Financial Institutions" was signed into law late May 2015 (click here for the version that passed). An amendment to this bill (formerly SB 828) was added as Section 7 to Senate Bill 806. This section addresses civil action subpoena enforcement for foreign bank entities located in Florida.

This amendment to Senate Bill 806 was pushed forward by the Florida International Bankers Association ("FIBA") and sponsored by Senator Diaz de la Portilla. The ILS Legislative Committee worked closely with FIBA over the legislative session to amend the original proposed language to ensure the preservation of the "possession, custody or control" standard for subpoenas.

The ILS Legislative Committee is pleased with its efforts to persuade various amendments to the original bill. More importantly, the ILS Legislative Committee ensured the inclusion of the  "possession, custody or control" standard. As a result, ILS was instrumental in avoiding language that would create a different standard for subpoenas directed to foreign bank entities operating in Florida.

Special thanks go to Carlos Osorio, Arnie Lacayo and Andres Sandoval for their assistance with these legislative efforts.

With an eye to the future, the ILS Legislative Committee is looking for eager volunteers to joint the committee, as it expects a very active upcoming legislative year. If you are interested in joining, please email Katherine Sanoja (katherine.sanoja@gommsmith.com)  or come to our ILS committee meeting on Friday, June 26 at 9 a.m. at this year's Florida Bar Annual Convention taking place at the Boca Raton Resort & Club.

Warmest greetings to all,

Katherine Sanoja
Chair, ILS Legislative Committee
