Filing Reminderstwenty

For insurance companies, the following items for the Virginia Insurance Premiums License Tax are due March 2, 2015:
  • Insurance Premiums License Tax Return (Form 800) and tax due payment for any amount due.

Don't forget to include Schedule 800RET with the return.

 

Although Form 800 must be filed as a paper return submission, payments can be made electronically. See our electronic payment options page for details. 

 

Note: If your Form 800 is not filed by the due date, a $50 per day late penalty will be assessed, along with a 10 percent penalty that will be added to the amount of unpaid tax.

When filing your 2014 Insurance Premiums License Tax Return (Form 800), be aware of the following:


 

New Form 800 Items
  • New subtraction codes added to Schedule 800ADJ.
    • Code 57 - Use this code when subtracting your S/B Workers' Compensation Finance and Service Charges. 
    • Code 58 - Use this code when subtracting your Medicare Part D Premiums.
  • New tax credit added to Schedule 800CR
    • Education Improvement Scholarships Tax Credit - For taxable years beginning on or after Jan. 1, 2014, an income tax credit may be claimed for monetary or marketable securities donations made to scholarship foundations included on an approved list published by the Virginia Department of Education.

General Information
  • Some sections of the Form 800 or its schedules may need additional clarifying information/and or explanation. Please include those as attachments.
  • Do not submit blank forms or schedules not needed.
  • An amended return must include all applicable schedules and attachments as if it is the original return. Otherwise, missing documents will be requested.
  • Additional calculation schedules are encouraged and can be submitted as attachments to clarify information and/or explanations.
Other Filing Details
  • All non-domestic insurers, except insurance companies domiciled in Canada, are required to file Schedule 800RET.
  • When completing Schedule 800RET, Column B - Enter rates and fees as if you were a Virginia company doing business in your domicile state. 
  • If the Uninsured Motorist Premium Distribution and/or the Virginia Property Insurance Association (FAIR Plan Premium Distribution) are included in your Premium Written Income Reported on Line 1, be sure to enter these amounts on Line A and/or B on Form 800. If the premium distributions are not included on Line 1, they must be added by completing Schedule 800ADJ.

Agent Appointment Fee Computations


 
When calculating the appointment fees reported in Column A, Line 19 of the Schedule 800RET, remember to use the information on your company's quarterly Bureau of Insurance statements regarding fees billed.These quarterly statements are usually:
 

  • Initial agent appointment statements for April, October and January and
  • The July agent appointment renewal statement

For example: When computing your 2014 appointment fees, use your April 2014 (initial appt fees), July 2014 (renewal appt fees), October 2014 (initial appt fees) and January 2015 (initial appt fees) fees billed statements.
 

Mergers
 

In the event of a merger, remember: 

  • If a merger is recognized in the state of domicile and in Virginia within the same calendar year, only the surviving company is required to file an annual return.
  • If the merger is not recognized in Virginia within the same calendar year, both the surviving and the non-surviving companies are required to file annual return.
