Creditable Coverage Model Notice Letters

 

The Medicare Modernization Act (MMA) requires entities (whose policies include prescription drug coverage) to notify Medicare eligible policyholders whether their prescription drug coverage is creditable coverage, which means that the coverage is expected to pay on average as much as the standard Medicare prescription drug coverage.

 

Entities may modify the Model Disclosure Notices to notify affected individuals whether their drug coverage is creditable or non-creditable. 

 

Employers will need to distribute the notice to employees by October 15th, 2012.

Determining Full-Time Employees for Purposes of Shared Responsibility for Employers Regarding Health Coverage

 

This notice describes safe harbor methods that employers may use (but are not required to use) to determine which employees are treated as full-time employees for purposes of the shared employer responsibility provisions of 4980H of the Internal Revenue Code. 

Guidance on 90-day Waiting Period Limitation

 

This notice provides temporary guidance regarding the 90-day waiting period limitation in Public Health Service Act section 2708. The guidance will remain in effect at least through the end of 2014. 

A Preventative Maintenance Schedule for Men's Health

 

Men are notorious for disappearing from their doctors at age 18, avoiding checkups until age 40 or 50. Unlike women, men aren't handed a preventive maintenance schedule. That doesn't mean there aren't things that men can do to take care of themselves at every stage of life. 

 

A man's family history can play a far more important role in his risk of disease than his age. Experts say the average guy can help protect his health by paying attention to some of these issues as he ages:

Shared Responsibility for Employers Regarding Health Coverage

 

Provisions of PPACA include shared responsibility for employers regarding health coverage, coverage to be offered by State Exchanges, premium tax credits to assist individuals in purchasing coverage through State Exchanges, and related provisions.

 

Those provisions, which apply for months beginning on or after December 31, 2013, refer to certain standards relating to the offering of health coverage by employers to their full-time employees. An "applicable large employer" that does not meet these standards may be liable for an "assessable payment" if at least one of its full-time employees is certified as having enrolled in health insurance through a State Exchange with respect to which a premium tax credit, a cost-sharing reduction or an advance payment of such credit or reduction is allowed or paid.

 

Notice 2011-36 does not constitute guidance. Instead, it describes potential approaches, which could be incorporated in future proposed regulations with regards to the issue of who is a full-time employee.
