Buyer's Agent changed the Buyer's Agency Compensation on Contract to Purchase
REALTOR® B contacted REALTOR® A, the listing broker, and notified him that she was a buyer's agent and was interested in showing one of his listings to her client, a prospective purchaser. REALTOR® A made an appointment for REALTOR® B and her client to view the property. Shortly thereafter, REALTOR® B presented REALTOR® A with a signed offer to purchase from his client. REALTOR® B noted her commission to a higher amount than was offered through the MLS. REALTOR® A presented the offer to his client, the seller, explaining that REALTOR® B had increased the compensation from what was agreed to on the listing agreement.
REALTOR® A then filed a complaint with the Monmouth County Association of REALTORS® charging REALTOR® B with violating Article 16 as interpreted by Standard of Practice 16-16. In his complaint, REALTOR® A stated that REALTOR® B had interfered in his agency relationship with the seller by communicating directly with the seller to justify the extra compensation to be paid to REALTOR® B.
REALTOR® B defended her action arguing she had the listing for a long time, (her listing had expired) and that REALTOR® A had only had the listing for two days and she was entitled to a larger compensation.
The Hearing Panel concluded that REALTOR® B's actions to modify the BAC to a different amount than what was on the listing agreement was an unwarranted interference in their contractual relationship. They concluded that REALTOR® B had violated Article 16 and imposed a $1,500 fine. Failure to comply with the ruling would result in automatic suspension of membership.
