A seat at the property tax reform table. Pennsylvania legislators are considering substantial reforms to the current property tax system. A Note from SRA...Act 99 of 2000 

The Pennsylvania Municipal Code and Ordinance Compliance Act ("MCOCA") requires that "a
municipality shall not refuse to issue a use and occupancy certificate ... on the basis of a substantial
violation or require the correction of a substantial violation as a condition to issuing a use and
occupancy certificate ... unless the substantial violation renders the property unfit for habitation."

In other words, unless a municipality is condemning a property because it is "unfit for habitation," they must
issue a temporary use and occupancy permit that allows a real estate transaction to close.

Furthermore, the Pennsylvania Supreme Court has held that local ordinances that attempt to force repairs
prior to settlement "may not stand as an obstacle to the execution of the full purposes and objectives
of the [MCOCA]." Holts' Cigar Co., 10 A.3d 907.
