Don't Hide Under a Rock: It can be easy to bury the complaint under a stack of papers on your desk and hope it will all go away. Unfortunately, this rarely works. While the best course of action is to be proactive, this does not mean that you should correspond with the other party or its attorneys until you have consulted with an attorney. You don't want to say something that could come back to haunt you.

 

Verify Your Insurance Coverage: It is important to review both the complaint and your insurance policies very carefully. In some cases, your insurer may be obligated to provide coverage. If so, you should notify the company immediately and begin the claims process.

 

Gather Relevant Contracts, Correspondence, and Other Documents: One of the first steps to successfully defending a business lawsuit is to gather all of the relevant documents. Contracts, emails, invoices, and other paperwork related to the dispute will help your attorney build your case and explain your side of the story.

 

Plan Your Response: It is also not too early to think about how you can rebut the allegations asserted in the complaint as well as whether your have any claims of your own. For instance, do you have legitimate reasons for your conduct? Has the other party also failed to live up to the terms of the agreement?

 

Keep Emotions In Check: While lawsuits can be frustrating and time consuming, it is important to keep a level head. If the two sides are willing to work together, it may even be possible to settle the lawsuit before stepping foot in a courtroom.
