January 2016

The first month of 2016 sped by and here we are halfway through February.  Time for my January 2016 Newsletter! I'm late for a good reason, as always.  I've been busy delivering training in various formats: Onsite, Webinars, two-days, 4-hours, updates and refreshers, initial for new employees, HazMat, hazardous waste, even the international regulations of IATA and the IMO.  Whatever training you need, whenever you need it, don't hesitate to contact me.

Unknown Solid Waste The 2015 Definition of Solid Waste Rule

My contribution to this article series for January (in bold below) is the last of the conditional exclusions revised or created by the new rule.

Conditional exclusions created or revised by the 2015 DSW:

New regulations created by the 2015 DSW for the above conditional exclusions:

I believe only one topic remains in the 2015 DSW for which I must write an article:  Nonwaste Determinaions and Solid Waste Variances.  Look for that in my February Newsletter.

Are State-Certified Labs Required for the Hazardous Waste Determination? - Recently Updated!

Let's all pitch in to build a nationwide list of the state environmental agencies and their requirement - or lack of a requirement - to use a state certified lab for the hazardous waste determination.  Contact me to add your state to the database:   State-certified labs for the hazardous waste determination.

I don't just write articles!

Sometimes a Power Point presentation is better than an article for summarizing complex regulations.  Take a look at mine on SlideShare.

YouTube allows me to provide audio and live animation to my presentations.  I hope to use it more.

What's Coming Down the Pipeline for January?

The Regulatory Pipeline

Not much for January.  A few announcements from EPA and PHMSA but nothing - that I could find - from FAA, FRA, or FMCSA.  See for yourself  Federal Register Publications for January 2016.
Interested in Reusing Your HazMat Packaging? Empty HazMat Packagings

What I thought would be a simple article about 49 CFR 173.28 and the reuse of HazMat packaging grew into four separate articles and consumed a significant portion of my time.  But my research is to your benefit if you have any interest in reusing a packaging for the transportation of HazMat.  See below for the articles I created on this subject.  Note:  All of them are referenced and linked to the first one: DOT 39 Cylinder
State-Specific Regulations.  This Month:  Texas! Texas
Though Texas regulations can be more strict than those of the EPA.  When it comes to waste management, the TCEQ has a very good program available to businesses who may only generate a waste once or infrequently.  It's known as the One-Time Waste Shipment Program.

Do you have a question?

Man with Question Mark

I receive a lot of questions.  Some come from past customers.  Some from - I hope! - future customers.  And some come from others who are in the business of transporting HazMat or managing hazardous waste and just need a little help.  Here's a sample of some of those questions with my answers:

California CUPA Forum Attend the California CUPA Forum With Me Feb. 22-25

I'm looking forward to this opportunity to learn more about the waste management regulations from this very strictly-regulated state.  The four days are packed with workshops and learning opportunities.  If you do business in California you must attend the Cal CUPA Forum.

Training Question  If you generate a waste the type and frequency of training you require varies by the type and amount of waste you generate - and the state(s) you do business.

The HazMat regulations of the USDOT/PHMSA are simpler:  Anyone involved in the transportation in commerce of a hazardous material must receive triennial training.

Not certain what training regulations apply to you?  Or how to get the training you and your employees need?  Contact me for a free consultation.
