Medical Boards Keep Wary Eye on Doctors' Social Media Posts

When doctors go to social media Web sites, they may want to think twice about posting patients' photos without permission. Using the images could be considered unprofessional conduct by a state medical board, according to a new study.

Other online physician behavior viewed as troublesome by boards: citing misleading information about clinical outcomes; misrepresenting credentials; and inappropriately contacting patients.

The survey of 48 state medical board executives, published in the January 15 Annals of Internal Medicine, found that these social media activities likely would prompt a board investigation of a doctor. The study concluded that physicians should never engage in such behaviors.

HIPAA Changes Could Create New Bureaucratic Burdens

Changes coming to the HIPAA Privacy and Security Rule mean added administrative work, and they could mean additional reporting, said Lisa Sotto, head of Hunton & Williams' global privacy and data security practice in an interview with InformationWeek Healthcare.

The Department of Health and Human Services recently announced what Office of Civil Rights (OCR) director Leon Rodriguez called "sweeping changes" to HIPAA that will strengthen the OCR's ability to enforce HIPAA.

Report Urges Coordinated Approach on Preventive Care

The not-for-profit Trust for America's Health is calling for a revamp of public health management at the federal, state and local levels in a report that urges a greater focus on preventive care.

The report, called "A Healthier America 2013: Strategies to Move From Sick Care to Health Care in the Next Four Years," argues that the different agencies in HHS involved with preventive healthcare should work more closely together to coordinate efforts, and existing attempts to become more coordinated have been too slow in creation.

Even within parts of HHS, programs are too separated, the authors of the 98-page report wrote, describing programs at the Centers for Disease Control and Prevention as "often siloed and based on diseases and conditions," instead of offering integrated and focused prevention strategies.

Similarly, the authors wrote that while the Substance Abuse and Mental Health Services Administration and the Health Resources and Services Administration "focus on different health problems, the two agencies have many overlapping functions and serve overlapping populations."

In Second Look, Few Savings From Digital Health Records
The conversion to electronic health records has failed so far to produce the hoped-for savings in healthcare costs and has had mixed results, at best, in improving efficiency and patient care, according to a new analysis by the influential RAND Corporation.

Optimistic predictions by RAND in 2005 helped drive explosive growth in the electronic records industry and encouraged the federal government to give billions of dollars in financial incentives to hospitals and doctors that put the systems in place.

President's Message
#124 Is Not Good Enough

Daniel
Lieberman, MD

On December 22, for my 47th birthday, I hiked the Grand Canyon with my two sons. Whether it's rafting, hiking, or fishing, the Canyon always produces a strong reaction from me - it makes me proud to be an Arizonan. Our State is a young, independent, frontier where Barry Goldwater and Sandra Day O'Connor grew up. This is where a small cowtown like Phoenix, with no natural water source, can grow fast and strong from the desert floor to be the sixth largest city in the United States. Our people are as dynamic and amazing as our geography. We deserve a healthcare system that is just as incredible and unique.

Last year the Commonwealth Fund issued Rising to the Challenge: Results from a Scorecard on Local Health Systems Performance, 2012. The authors make the case that all Americans deserve the same opportunities for quality care but that "...where one lives has a major impact on the ability to access healthcare and the quality of care received". The full report is available under "Publications" at www.commonwealthfund.org.

The study ranked 306 hospital referral regions using 43 performance metrics in four dimensions:
  • Access - Insurance coverage and affordability.
  • Prevention and Treatment - Quality of ambulatory, hospital, long-term, post-acute, and end-of-life care.
  • Potentially Avoidable Hospital Use and Cost - Indicators of what might have been prevented or reduced with appropriate care and resources.
  • Healthy Lives - The degree to which people are able to enjoy long and healthy lives.

Phoenix ranked in the third quartile of regions for access to care, and in the second quartile for the other three dimensions. At first blush, one might conclude that being #124 is acceptable under the circumstances. After all, as a result of rapid growth, most people don't have strong roots here, leaving them disconnected from their traditional health network; our Native American tribes pose unique geographical issues with regard to care; and a large population of undocumented workers create their own logistical challenges.

Maricopa County Medical Society Moves to a Smoke-free Campus

Professional physician organization dedicated to promoting excellence in the quality of care and the health of employees

When the employees of the Maricopa County Medical Society (MCMS) report to work on Friday, February 1, 2013 they will be working at a tobacco-free campus.

The new policy bans the use of all tobacco products, including nicotine cigarettes, electronic cigarettes and chewing tobacco, on property owned or controlled by MCMS. That includes MCMS' Business Services such as the Bureau of Medical Economics, a medical collection agency, Greater Arizona Central Credentialing Program, a primary source verification company, Round-up Magazine, and building tenants.

"Reducing death and disease caused by using tobacco products or second-hand smoke is a win for our employees and our community. At MCMS, we are winning the battle by building on the Arizona law that prohibits smoking in indoor areas of workplaces to now banning smoking outdoors in our workplace," said Dr. Daniel Lieberman, MCMS Board President.

"I call upon our fellow physicians in Maricopa County to ban tobacco in the outdoor areas of your workplace. If you do not have a tobacco free office or facilities, change the culture.  We are the doctors and we set the standard for our employee policies regarding tobacco-free environments," states Lieberman.

"We want physicians to know MCMS is here to support them with the resources they need to manage a quality practice in the most cost-effective manner," said Sara Presler, MCMS CEO.  "Our doctors in Maricopa County understand that what happens outside of their offices and hospitals is just as critical as what happens inside of their offices and hospitals.  A tobacco-free policy is a good step in that direction.  MCMS represents doctors in Maricopa County.  It makes good sense that we are taking this step, side by side, with our Members."

Doctors Align and Support the Availability of High Quality Health Care

Continuing the Society's commitment to strategically communicate as the voice of medicine in Maricopa County, on January 17 in a join statement to the press and Arizona Business Leaders, MCMS, the Arizona Medical Association, Arizona Osteopathic Medical Association, and Pima County Medical Society said they are pleased the Governor has included, in her goals for 2013, expansion of the AHCCCS program.

"Availability of high quality healthcare remains one of our most pressing concerns in Arizona and the AHCCCS program is a key component of providing essential medical services. We stand ready to support the Governor in this effort and pledge to work with her administration, and the legislature, to secure this result on behalf of physicians and their patients."

Stay tuned for more position statements and information as the Medicaid situation continues to unfold.
