NYSAR Triple Play
Last week I attended NYSAR's Triple Play REALTOR Convention & Trade Expo in Atlantic City, with over seven thousand REALTORS, brokers, appraisers, and other real estate professionals.
SIBOR and the Brooklyn Board of Realtors jointly hosted a Cocktail Reception on December 5th. Over 200 Realtors from Brooklyn, SI and other locales networked and had a great time.
As a member of SIBOR for the past 30 years, I have witnessed first-hand the generosity of the Realtor community. During this Holiday season fellow realtors, their families and friends, have once again come together to support some of the neediest in our community, our seniors.
For the past 11 years, the SIBOR Adopt-A-Senior program coordinated by Annmarie Izzo has delivered gifts to over 500 Seniors annually at 10 Staten Island nursing facilities.
SIBOR Holiday Party
One of the highlights of the SIBOR year is the Holiday Party, which this year will benefit Hurricane Sandy victims through the Stephen Siller "Tunnel to Towers" Foundation. The Holiday Party will take place on Thursday, December 13, 2012 at 7PM, at the Hilton Garden Inn. With over 400 tickets sold, there are still a few seats available.

PENDING HOME SALES
Pending home sales rose strongly in October with mixed regional results, according to the National Association of Realtors«.
The Pending Home Sales Index,a forward-looking indicator based on contract signings, increased 5.2 percent to 104.8 in October from an upwardly revised 99.6 in September and is 13.2 percent above October 2011 when it was 92.6. The data reflect contracts but not closings.
Lawrence Yun , NAR chief economist, said buyers are responding to favorable market conditions. "We've had very good housing affordability conditions for quite some time, but we're seeing more impact now from steady job creation, and rising consumer confidence about home buying now that home prices have clearly turned positive."

EPA AUDITS ON THE RISE
BROKER NONCOMPLIANCE WITH LEAD PAINT DISCLOSURE RULES
It has come to the attention of many in the real estate brokerage community that the United States Environmental Protection Agency (EPA) has stepped up its audits of brokerage firms with the result of the imposition of excessive monetary fines when finding non-compliance.
The Real Estate Notification and Disclosure Rule for Lead-Based Paint (Disclosure Rule), codified at 40 CFR Part 745, Subpart F, requires the agent/seller/lessor, for the purpose of selling or leasing housing built prior to 1978 (target housing), to disclose to the potential purchaser or tenant the existence of any lead based paint or lead -based paint hazards in the target housing.
Failure to comply with the Disclosure Rule results in the imposition of civil penalties of up to $16,000.00 per violation. The EPA investigator will request a review of several of pending and/or closed files in order to assess the number of violations which will result in separate monetary penalties.

GET AHEAD OF THE LAW
Last year some big-name companies and organizations got hit by data breaches. LinkedIn comes first to mind. According to news reports, its system was breached and millions of account passwords were potentially compromised. eHarmony, the University of Nebraska, Yahoo! and many others were also in the news because of data breaches.
Congress has been looking at data security and privacy for years, and the Federal Trade Commission has done a lot of work on the issues, studying them and creating best practices for protecting against violations. But as of right now, for the most part, data security and privacy are issues mainly addressed at the state level, and virtually all states have some laws on the books.
Unfortunately, a survey NAR conducted in 2010 found that real estate brokers and sales associates are neither well-informed about these laws nor have in place anything close to a rigorous system for protecting against security breaches, or protecting customers' privacy.

|DISASTER UNEMPLOYMENT ASSISTANCE|
YOU MAY BE ELLIGIBLE
If you live or work in Bronx, Kings, Nassau, New York, Orange, Putnam, Queens, Richmond, Rockland, Suffolk, Sullivan, Ulster or Westchester counties and you lost your income due to the effects of Hurricane Sandy, you may qualify for DUA.
You may qualify for DUA even if you would not normally be able to get unemployment insurance benefits. To find out if you might be eligible for DUA, call the Telephone Claims Center (TCC) at 1-888-209-8124, or 1-877-358-5306 if you live out of state. Answer the questions to indicate that you lost your job as a direct result of Hurricane Sandy.
File your application with the New York State Department of Labor as soon as possible. The application deadline is February 4, 2013.

|HOUSING FOR SANDY VICTIMS|
FEMA TRAILERS POSSIBLE OPTION
For a lot of Staten Islanders who view the misery of people left homeless by Superstorm Sandy, it's a no-brainer: Bring in trailers so these people can use them as temporary homes until they get back on their feet and figure out what they're going to do for permanent housing.
Many victims are still up in the air about the fate of their own homes which were damaged in the storm and they want to figure that out before they move into new houses.
