It may seem like a long way away, but based on what you  need to do, you may want to start NOW!
Here is a quick snap shot of things to do:
  • Ensure job descriptions are appropriate, updated and compliant
  • Ensure compensation for each position is assessed appropriately
  • Classify the jobs accordingly
  • Those remaining Exempt, ensure salary is raised to equal $913.00 per week (this law focuses on weekly, not "annual" pay);  If you provide non discretionary bonuses, you can include this toward average weekly pay if they are paid quarterly...contact JBM for details.
  • Consider the paying "salary/non exempt" option (seems to be the most cost effective method)
  • Those going from Exempt to Non Exempt need proper notifications (consider the psychological effects of such a change and morale related)
  • Budget accordingly, keep in mind the salary changes are going to be reviewed and likely to change every 3 years with mandatory raises announced by DOL.
  • Policies related need to be updated, for example, compensation, benefits, time keeping, wage/hour policies, breaks, meal times, travel time, handling emails, texts etc..basically any policies that are specific to exempt, non exempt status need review
  • Changes to "how" they do their work, no more "off the clock" work is allowable
  • Train managers/supervisors, they need to manage time much more closely
  • Consider how this effects PTO, some policies are based on exempt, non exempt rather than years of service
  • Develop effective communication methods for a positive transition
  • Train employees and supervisors
This is a change that requires expertise in many aspects of the implementation and takes time. If you need assistance with any and all aspects of this transition, please contact JBM!
