Overlooked Site Exposures

Non-owned locations are often one of the key overlooked exposures on the combined general liability and site pollution policies. When we discuss non-owned locations we typically think of non-owned disposal sites, which is one important offsite waste exposure.  However, non-owned locations outside of waste disposal facilities are also typically addressed in combined forms and are equally important.  For example, chemical manufacturers' non-owned locations may include third-party warehousing or toll manufacturing where the insured is not manufacturing the product but instead having a contract manufacturer produce to their specifications.  Additional exposures include warehousing of the insured's manufactured products as they are transported across the country and left at distribution sites until picked up by the next transporter.
 
When considering this exposure it is important to think about additional coverage parts that could be triggered in the event of a claim involving your product such as transportation, newly acquired locations, and products pollution.
 
Evaluating non-owned exposures includes:
  • Considering contract manufacturing sites that might manufacture, store or treat your product
  • Considering transportation of your product to and from the site
    • What is considered to be in due course of transit and what is not?
    • Is your transportation coverage providing coverage to and from your site or to and from your contract manufacturer?
    • When is your product considered to be at a non-owned location versus in transit?
  • Warehousing locations for products
Many carriers provide coverage but require that you schedule non-owned locations in order for coverage to be provided.
