IRMI Conference Wrap-Up 
Construction Risk Conference November 7-10, 2016  
 
New Day is proud to have been a sponsor of the 36th IRMI Construction Risk Conference held in November in Orlando, Florida.  This year, our team included Jeff Lejfer, Jeff Slivka, Tim Farrell, Joe Nawa, and Nicole Jeffers.  The team had a very busy and informative week with constructive meetings with insureds, brokers and carriers.  We are especially proud of our President, Jeff Slivka, who received the prestigious Words of Wisdom (WOW) award, which has been presented to a select group of IRMI speakers for their outstanding contribution to the construction industry and the conference. 

Some additional highlights from the conference include:
  • An informative and well received presentation by Joe Nawa on Creating an Environmental Risk Profile
  • Many meetings with insurance carriers indicate that the professional marketplace is dynamic and still evolving with many strong players
  • Discussions with attendees indicate that more and more customers are buying pollution coverage

  • Informative presentation by FMI that discussed the continued growth in the construction industry.

Recitifcation/mitigation coverage is a complex part of a Contractor's Professional Liability (CPrL) program.  In his article titled "What Contractors Need to Know About Rectification and Mitigation Coverage" recently published in Property Casualty 360, Jeff Slivka discusses how rectification/ mitigation coverage differs from other first-party coverages under a CPrL program. He elaborates on the types of rectification and mitigation coverages as well as the differences in how carriers may apply this coverage.

Dawn Myers Promoted
Controller of New Day   

New Day recently announced the promotion of Dawn Myers to Controller, where she oversees the company's accounting, financial, human resources and IT practices and procedures.  Dawn joined New Day in 2014 as Director of Office Services with over 20 years of professional accounting and office management experience.  In the past two years, she has formalized all financial reporting and established herself as a focal point on all IT and HR matters. She has established processes and procedures that have increased New Day's overall efficiency.  

"Dawn has repeatedly demonstrated her ability to work independently, tirelessly enhancing efficiencies companywide," says Jefferey S. Lejfer, New Day's CEO. "We are proud to have her grow through our ranks. Her initiative has been instrumental in improving our organization."

Annual Holiday Party and Adopt A Family

It's been a busy holiday season for the New Day team.  Once again our team adopted two families for the holidays. We pulled together our resources and provided gifts so that these families in need could enjoy the holiday. 

Our employees enjoyed an offsite, holiday party that included great food, drink and even a wonderful magician.  A great time and a lot of laughs were had by all.  Our annual office pot luck lunch and Pollyanna offered a time for employees to take time out of their busy workday to enjoy each others company and exchange gifts.

Water Intrusion and Mold Prevention Planning

Talk to your clients about the importance of a water intrusion or mold prevention/management plan.  Mold liability is an issue faced by nearly every type of contracting operation, and it's an issue that is not foreseeably going away anytime soon.  So, it's important that organizations establish administrative controls to respond to such issues.  The foundation of a water intrusion or mold prevention plan should be to educate employees on mold prevention and proper protocols and procedures in the event of a water intrusion or mold event.  Also, have your clients consider the following when constructing their plan:
  • Establish responsibility - assign an employee as the person accountable with oversight and carrying out the mold plan.  That said, a mold plan should be a top-down approach from executive management to field personnel.
  • Establish a response protocol - establish guidelines for field personnel in terms of how to react in the event of a water intrusion or mold event.  Pre-qualify third party firms such as mold abatement firms in the event cleanup is necessary.
  • Manage subcontractors and owners - for subcontractors, ensure you include proper indemnity language and environmental insurance requirements in contracts to further protect yourself if the subcontractor exacerbates a situation.  For owners, ensure you have a communication procedure with such parties to let them know of an issue if it arises.  You'd much rather be forthright with them about an issue than hear from their attorney.
  • Administration - not only is it important to establish these plans and guidelines, but it's imperative the plan be executed on.
