Risk TipClaims Handling by the Retail Broker - Tips for Improving Carrier ResponsivenessBy: Jon Polevoy, Consultant |
|
When a retail agency gets involved in a claim we have found that the most successful agencies have a process that usually assists the Insured in getting a more favorable outcome. The following tips can help you effectively resolve claims:
- Review and understand the coverages provided, including the exclusions and exceptions
- Provide timely notice of a claim to all carriers that may potentially provide coverage. For example, a liability claim may be covered, in whole or in part, under multiple policies (e.g. general liability and professional liability)
- Handle the claim proactively
- Build a team to support the claims handling process
- Understand the facts and prepare a clear, complete and concise summary
- Identify the key decision maker(s)
- Be prepared to challenge the carrier's coverage position
- Set realistic expectations of claim resolution
- Consider a global resolution of the claim
- Carefully select outside counsel when appropriate

OSHA Issues Crystalline Silica Rule
Protecting Construction Workers from Exposure
OSHA is issuing two standards to protect workers from exposure to respirable crystalline silica - one for construction, and the other for general industry and maritime - in order to allow employers to tailor solutions to the specific conditions in their workplaces. This may or may not impact your current commercial general liability program and/or contractor's pollution liability program. Contact your New Day consultant to learn more. You can review the OSHA Fact Sheet to learn:
- Who is affected by the construction standard?
- What does the standard require?
- What is Table 1?
- Alternative exposure control methods
- When are employers required to comply with the standard?
