New Day is proud to once again participate in the 35th IRMI Construction Risk Conference to be held November 8-12, 2015 in Las Vegas, NV.  We hope that you will join Jeff Lejfer, Jeff Slivka, Tim Farrell and Joe Nawa as they represent New Day at the conference throughout the week.   

This year, Jeff Slivka will host the workshop "Contractors Professional and Pollution Liability Market Update" on Monday, November 9th. The session will cover the recent trends and developments in the construction insurance marketplace such as newly identified exposures, the growth in mitigation coverage, availability of desirable coverage enhancements, and recent entries and exits. This includes providing a Market Update on the latest forms, advancements and supplemental coverages surrounding the evolving Contractors Pollution Liability (CPL), Pollution Legal Liability (PLL), Contractors Professional Liability (CPrL) and Owners Protective Professional (OPP) marketplace. Contractor's Pollution Liability

Contractors Pollution Liability (CPL) coverage originated in the 1980s as a result of pollution exclusions in General Liability insurance policies.  With the "total pollution exclusion" that exists now, in most cases, coverage for environmental exposures is very limited in general liability forms.  Similar exclusions also exist in the Auto and Umbrella policies. Without a separate CPL policy, potential claims can cost contractors thousands and possibly millions of dollars.

Initially, CPL was seen as coverage that was needed only by environmental contractors and didn't apply to non-environmental contractors (general contractors, street/road, MEPs, roofers, painters, etc.).  Clearly, environmental exposures existed for those specialists that dealt with remediation, abatement, etc. (think of the workers in Tyvek suits and using breathing apparatus!).  The consensus among non-environmental contractors - and their insurance brokers - was that they did not have environmental exposures and therefore, had no need for CPL coverage.  Read more.

Risk Tip

Many contractors perform only construction tasks, with no in-house or subcontracted design.   As a result, they believe they are not subject to contractors professional liability exposure. In reality, they just may not fully understand their exposure.  All contractors, trade contractors and subcontractors must:  
  1. Manage budgets, maintain the construction documents, assess work and progress; and
  2. Manage the construction schedule as to not exceed the time frame allocated for their work.   

Many times, they also might oversee subcontractors working for them or make field changes to plans and specifications to simply save time and money.  All of these tasks or services may expose the contractor to professional liability but many times they are simply looked at as "the work" with little regard to professional risk.  If the contractor goes over budget or exceeds the schedule due to an error in sequencing the work properly they may be responsible for any resulting third party damages.  If they fail  to select competent subcontractors, make field changes that result in some type of failure, apply the inappropriate product under performance specifications, they can be subject to professional liability, specifically the economic damages that may result. Today, every contractor should round out their insurance program by ensuring they also have contractors professional liability or at minimum, assess their risk properly.
