Ironshore Updates Its Environmental Protection Insurance Coverage (EPIC) Policy Form

As the new year rolls around it is always good to reassess the current forms in place with Insureds and also to ensure that the most current policy form is in use.  In 2013, the Insurance Service Office (ISO) improved and upgraded their 2013 General Liability form.  As a result, some carriers updated their forms to align with the ISO changes and at the same time to enhance or take the opportunity to clarify their forms.   

Ironshore has taken the opportunity to update their Environmental Casualty Form in response to ISO's updated form.  Ironshore's Environmental Protection Insurance Coverage Package (I.E.COV.EPIC.001 5/13) form provides General Liability coverage along with Site Pollution, Contractors Pollution and Professional Liability in a combined form.  Among the changes you will find include:   
  • General Liability change - Liquor Liability Exclusion - amended to be in line with the ISO April 2013 changes and addressed that BYOB is not considered to be in the business of distributing alcohol. Intent was to follow thinking in line with ISO changes.
  • Personal and Advertising Injury (PA&I) includes consequential Bodily Injury. To clarify coverage, a PA&I exclusion was added to the General Liability portion of the form and directs coverage back to the Miscellaneous Coverage Part, which includes Personal and Advertising Injury.  
  • Coverage E - Non-Owned Site Pollution - added a 2nd item to Prior Pollutants or Pollution incident.  Clarifies that an incident/claim in prior term will not preclude coverage on current term so long as incident/claim was reported in prior term. Similar exclusion was under Prior Professional incidents.
  • Exclusion for Your Product under Common Exclusions has been amended to provide an exception so exclusion does not apply to bodily injury, property damage or environmental damage arising out of your products migrating from an insured site.
  • Definition of Environmental Damage has been amended to include not just physical damage to land, but also includes conveyances, structures on land or water, the atmosphere, any watercourse or body of water including surface water or groundwater, giving rise to clean up costs or emergency response expense.
  • Available classes include:  chemical, manufacturing, distributors, waste facilities, metal workings facilities, biodiesel, pollution related products
