Court ruling says workers compensation benefits not affected by Social Security

The Kansas Court of Appeals recently ruled on a workers compensation case. In their decision, the court says that an insurance carrier is not entitled to reduce workers compensation benefits for permanent partial disability by the amount of Social Security benefits the worker may be receiving. There is also no reduction in Social Security benefits if the worker is age 66 or older and continues to work.

KAIA offering free contract review for member agencies

KAIA is offering a new service for member agencies. Agents may submit their carrier or broker contracts to KAIA for review by attorney Will Larson. Larson has represented the association since 1980 and has worked with agents in defending E&O cases for Westport Insurance Company since 1977.

"Will has more than 35 years of experience reviewing and analyzing agency contracts," said Kerri Spielman, KAIA Executive Director. "With this new service, our members can draw on his experience to make sure contract provisions are fair and equitable, and agents can use Will's recommendations to leverage any necessary contract changes."

FIO initiates study on affordability of auto insurance

The Federal Insurance Office (FIO) has launched a study on the availability and affordability of auto insurance. The FIO says it is acting under its authority to "monitor the extent to which traditionally underserved consumers ... have access to affordable insurance products." Industry groups like NAMIC have expressed concern that such studies often lead to vague criteria, which have been used to subject the industry to arbitrary rules.

AAA cancels contracts with independent agents in Missouri

AAA of Missouri recently notified independent agents that the company is canceling all independent agent contracts and will only market through captive agents from now on. The company stated it would comply with Missouri contract cancellation statutes by giving 90 days notice and offering renewals to policyholders for one year.
