Restraints of Trade in Employment Contracts
The courts are now more willing to enforce restraint of trade clauses if the employer is able to demonstrate that the restraint is reasonably necessary to protect the employer's legitimate business interests and is not so large as to interfere with the interests of the public.
Alistair Macpherson (Director) and Tina Boules (Lawyer) put together an excellent paper on 'Drafting and Enforcing Restraint of Trade Clauses: Recent Development and Trends'. This paper was presented by Alistair on the 4th March 2015 at the Employment Law Conference which is held annually to help inform and protect organisations with up-to-date legal knowledge in employment.
Addressing Mental Health and Injury in the Workplace
Mental health in the workplace is becoming a more regular occurrence and the effect of these conditions on the workplace as a whole and on individual performance can be very significant and quite damaging. Tina Boules in her latest paper writes that it is therefore critical that employers take reasonable care to provide a safe system of work and ensure they act appropriately in accordance with their legal duty.
