Executors & Taxation

One of an executor's many responsibilities in relation to the estate of a deceased person is to finalise the deceased's taxation matters. Whilst there is no longer an 'inheritance tax' in Australia, there are likely to be income tax and capital gains tax issues in most estates, which must be finalised by the executor prior to distributing the estate among beneficiaries. The ATO has recently revised some of the information available on its website to make these matters simpler.

Treatment of Trust Property in Family Law Disputes
The Spry decision resulted in trust assets of a Discretionary Trust forming part of a property pool in family law proceedings. It also resulted in the 'reversal' of several complex amendments to the Discretionary Trust which had removed the husband and wife as beneficiaries of the Trust.
